The hot topic in legal circles is the decline of professionalism. In this often negative age, it ranks right up there with "What's wrong with American schools?" and "Where will we live when the ozone is gone?" and "How can we get a handle on drugs?"-all those terrible things.

The Lesson Of The Red Squirrel: Consensus And Betrayal In The Environmental Statutes, William H. Rodgers, Jr.

The subjects of legislation and legislative change are undergoing a revival of sorts in United States' law schools. The academic community has offered a variety of theoretical visions on the nature of legislation—purposive and rational, irrational and political, the accidental outcome of competing interests, the imperfect product of high philosophy; the legislative process—formal and ritualistic, markets and auctions, plots and cabals, or publicregarding negotiations; and the individual legislators themselves—ritual players, auctioneers, maximizers of political gain, profiteers, and philosopher kings in shiny suits.
This author's personal approach to legal affairs of this sort is to draw on the laws of biology …

Diversity Combining In Fh/Bfsk Systems To Combat Partial Band Jamming, R. Viswanathan, Kashfieh Taghizadeh
Diversity Combining In Fh/Bfsk Systems To Combat Partial Band Jamming, R. Viswanathan, Kashfieh Taghizadeh
Articles
For a FH/BFSK system, a new type of combiner termed the product combining receiver (PCR) is investigated. The performance of the PCR is evaluated for the cases of on/off partial band noise with optimum jamming fraction, and worst case partial band tone jamming. The performance of PCR is shown to be comparable to that of the clipper receiver. The effect of diversity combining along with convolutional coding and ratio threshold technique is also analyzed. Whereas the clipper requires the knowledge of signal-to-noise ratio for threshold adjustments, the PCR does not require this knowledge for its operation.
Optimal Serial Distributed Decision Fusion, R. Viswanathan, S. C. A. Thomopoulos, R. Tumuluri
Optimal Serial Distributed Decision Fusion, R. Viswanathan, S. C. A. Thomopoulos, R. Tumuluri
Articles
The problem of distributed detection involving N sensors is considered. The configuration of sensors is serial in the sense that the (j - 1)th sensor passes its decision to the jth sensor and that the jth sensor decides using the decision it receives and its own observation. When each sensor employs the Neyman-Pearson test, the probability of detection is maximized for a given probability of false alarm, at the Nth stage. With two sensors, the serial scheme has a performance better than or equal to the parallel fusion scheme analyzed in the literature. Numerical examples illustrate the global optimization by …
Evaluating A Computer Program With A Structured Expert Review Process, Dennis G. Watson, Mary P. Andrews, Roger C. Brook
Evaluating A Computer Program With A Structured Expert Review Process, Dennis G. Watson, Mary P. Andrews, Roger C. Brook
Articles
A structured expert review process was implemented to evaluate the technical content and usability of a program on aeration system design for grain storages. Technical evaluation was used to determine if the computer program generated solutions similar to expert solutions. Other aspects of the evaluation focused on measures of ease of use, effectiveness of information conveyance and usefulness of solution. The evaluation procedure and questionnaires are described and results from the evaluation of an aeration system design program are summarized. The evaluation process served to validate the aeration system design program, generate suggestions for improving the program, identify areas for …

Becket At The Bar--The Conflicting Obligations Of The Solicitor General, Eric Schnapper
Becket At The Bar--The Conflicting Obligations Of The Solicitor General, Eric Schnapper
Articles
This Article suggests that the Solicitor General has five quite distinct responsibilities: to provide the Supreme Court with accurate and balanced information, to help to shape the Court's docket, to assure that the government's presentations maintain a high level of professionalism, to frame government positions which strike an appropriate balance between justice and advocacy, and to identify the interests and policies of the government client whom he represents. These responsibilities at times place the Solicitor General under conflicting obligations, not merely conflicts between his or her duties to the Court and to the administration, but conflicts in the Solicitor General's …

Academic Freedom And Academic Values In Sponsored Research, Rebecca S. Eisenberg
Academic Freedom And Academic Values In Sponsored Research, Rebecca S. Eisenberg
Articles
In this Article I examine the traditional American conception of academic freedom and analyze its implications for universities formulating policies on the acceptance of sponsored research. I begin by reviewing the basic policy statements of the American Association of University Professors (AAUP) on academic freedom to identify both the academic values implicit in those statements and the assumptions about institutional relationships and individual incentives underlying their prescriptions for advancing those values. I then evaluate the validity of those underlying assumptions in contemporary sponsored research and argue that academic freedom as traditionally conceived might no longer effectively advance academic values in …

Redefining The Antitrust Labor Exemption, Daniel J. Gifford
Redefining The Antitrust Labor Exemption, Daniel J. Gifford
Articles
Congress urgently needs to reformulate the antitrust labor exemption. Courts and legal scholars alike 1 have largely neglected the legal significance of the impact of industry-wide collective bargaining on price-output decisions in concentrated industries. They have, moreover, attended even less to the skewing tendencies produced by the almost universally practiced seniority system on labor union bargaining strategies.
Proprietary Rights And The Norms Of Science In Biotechnology Research, Rebecca S. Eisenberg
Proprietary Rights And The Norms Of Science In Biotechnology Research, Rebecca S. Eisenberg
Articles
As basic research in biotechnology yields increasing commercial applications, scientists and their research sponsors have become more eager to protect the commercial value of research discoveries through intellectual property law. Some scientists fear that these commercial incentives will weaken or even undermine the norms that have traditionally governed scientific research. In this Article, Professor Eisenberg examines the interaction of proprietary rights in inventions with these traditional scientific norms. Trade secrecy, she argues, is an undesirable strategy for protection of basic research discoveries because it impedes dissemination of new knowledge to the scientific community. She finds that patent law is in …
Law And Enchantment: The Place Of Belief, Joseph Vining
Law And Enchantment: The Place Of Belief, Joseph Vining
Articles
The question I wish to raise is whether one must believe what one says when one makes a statement of law. The language of belief that we know, and from which moral discourse and the moral never stray far: do judges, lawyers, law participate in it? Any such question is but an aspect of a larger question, indeed issue, of what we may call the objectivity of legal language. It is raised perhaps most acutely by the broad claims now being made for artificial intelligence and in particular for the computer programming of legal advice (as a species of what …

Optimal Decision Fusion In Multiple Sensor Systems, Stelios C.A. Thomopoulos, R. Viswanathan, Dimitrios C. Bougoulias
Articles
The problem of optimal data fusion in the sense of the Neyman- Pearson (N-P) test in a centralized fusion center is considered. The fusion center receives data from various distributed sensors. Each sensor implements a N-P test individually and independently of the other sensors. Due to limitations in channel capacity, the sensors transmit their decision instead of raw data. In addition to their decisions, the sensors may transmit one or more bits of quality information. The optimal, in the N-P sense, decision scheme at the fusion center is derived and it is seen that an improvement in the performance of …

One of the most significant advantages of VSAT Networks is the ability to link together many terminals at remote sites under a single manageable network and to adapt the performance characteristics of the network to the requirements of the type of data traffic presented to the network.

How To Argue About Health Care, Don Herzog
How To Argue About Health Care, Don Herzog
Articles
Despite the aggressive title of this article, my goals are modest. I begin by explaining briefly what should at any rate be obvious: that health care policies inescapably raise moral and political difficulties, difficulties that no technical fix could resolve. I move on to puzzle over the connections between some of the more abstract issues of moral and political theory and medical policy: here I urge that we develop a more sustained taste for exploring the moral conflicts embedded in our current practices. Finally, I suggest a strategy for making nitty-gritty facts-from the concrete world of third-party payment, expensive technology, …
Accurate Spectral Estimation From Unequally Spaced Samples Of Exponentially Damped Sinusoidal Signals, Tapan Sarkar, Huanqun Chen, Sohail Dianat
Accurate Spectral Estimation From Unequally Spaced Samples Of Exponentially Damped Sinusoidal Signals, Tapan Sarkar, Huanqun Chen, Sohail Dianat
Articles
In this paper a method is presented to interpolate and extrapolate unequally spaced signals that are not bandlimited. This is achieved by utilizing the Gregory-Newton quadrature formula which circumvents aliasing without bandlimiting. Also with the Gregory-Newton quadrature formula, it is possible to compute the Fourier spectrum of the unequally spaced signals, which is not bandlimited. Finally, the effect of noise on the Gregory-Newton quadrature formula is observed. Specifically, the quality of interpolation, extrapolation, and the spectrum as a function of various signal-to-noise ratios is observed. This may be a useful technique for computing unaliased spectra of unequally spaced amped sinusoidal …
