Catholic Social Teaching, The Right To Immigrate, And The Right To Regulate Borders: A Proposed Solution For Comprehensive Immigration Reform Based Upon Catholic Social Principles, Chad G. Marzen, William Woodyard Ii
San Diego Law Review
A number of scholars have commented on the significance of religious traditions to the debate concerning immigration policy in the United States.[1] In this Article, we contend that the Catholic legal tradition is relevant to the contemporary debate among policymakers, as it balances policy considerationsof the right to immigrate as well as the right of a nation to regulate its borders advocated on both ends of the policy debate. Section I of this Article discusses the current policy debate concerning comprehensive immigration reform and recent major legislative proposals for comprehensive immigration reform, including the plan of the “Gang of Eight” …
California’S Curse: Perpetual Drought And Persistent Land Development, Gabrielle Kavounas
California’S Curse: Perpetual Drought And Persistent Land Development, Gabrielle Kavounas
San Diego Law Review
This Comment argues that the California state legislature should take direct control of private water use rights through legislation that amends California’sConstitution Article X, Section 2, providing the state with the police powerto take back private water rights and centralize control over water management and distribution.[1] It also recommends imposing higher requirements for land development and water agency cooperation in standard form, state-controlled“general plans” to create efficiency in distributing water throughout the stateand in planning new land developments. The public trust doctrine, eminentdomain doctrine, and regulatory takings doctrine are possible justifications the state could use to effectuate the new legislation. …

Chinese Glass Paintings In Bangkok Monasteries, Jessica Lee Patterson Phd
Chinese Glass Paintings In Bangkok Monasteries, Jessica Lee Patterson Phd
Art, Architecture + Art History: Faculty Scholarship
Reverse glass paintings, a form of Chinese export art, were extensively traded in the nineteenth century. Several examples are on display in prominent Thai Buddhist monasteries in Bangkok. King Nangklao of Siam, Rama III, encouraged Sino-Siamese trade that brought Chinese objects and images to nineteenth-century Siam. The ideals of accretion and abundance characteristic of Thai Buddhism and the sinophilia of Rama III facilitated the construction of “Chinese-style” Thai temples. Glass paintings with scenes of the Pearl River Delta, Romance of the Three Kingdoms, auspicious objects, and bird-and-flower compositions were installed in temples and inspired new directions in Thai mural …

Negotiating The Terms Of Corporate Human Rights Liability Under Federal Law, R. George Wright
Negotiating The Terms Of Corporate Human Rights Liability Under Federal Law, R. George Wright
San Diego Law Review
This Article first addresses, by way of example, questions of mens rea, or required mental states, through the basic purposes and relevant assumptions underlying general tort and criminal law. Whichever approach the law adopts, with or without negotiation, toward corporate aiding and abetting liability in human-rights-oriented torts cases should at least be generally compatible with these basic purposes and assumptions. Next, this Article addresses several possible approaches to the mens rea issues before adopting a model of negotiation or bargaining bounded by general moral constraints.
Secondly, this Article discusses a number of issues associated with the Alien Tort Statute ATS …

Virgil In Virginia: Eighteenth-Century Pastoralism And The Novus Ordo Seclorum, Alley Jordan
Theses
This work examines classical reception in early America. Specifically, it addresses the role of classical ideas on pastoralism in the thought of one of America’s founders, Thomas Jefferson. Jefferson is best known for his role in the forming of United States government, but he was also influential on developing the idea of “America.” As such, his political theory on agrarian republicanism has strong ties to how the classical poets, such as Virgil and Theocritus, likewise thought about the relationship between land and government.

There’S No Place Like (Your) Home: Evaluating Existing Models And Proposing Solutions For Room-Sharing Regulation, Lara Major
San Diego Law Review
As urban housing grows increasingly unaffordable, city-dwelling millennials are forced to consider novel ways to pay the rent. The intersection of costs outpacing a reasonable share of income, demand for short-term housing, and ubiquitous personal technology has spawned an entire “room-sharing” industry, dominated by start-up Airbnb. Facilitated by Airbnb’s smartphone application, millennials open up their condominiums, houses, and apartments to complete strangers for short-term use. But, with the growth of the room-sharing economy come concerns for its participants, such as apportioning liability and, the focus of this Comment, determining how room-sharing fits within existing regulatory schemes.
Article Iii Standing For Private Plaintiffs Challenging Greenhouse Gas Regulations, Bradford C. Mank
Article Iii Standing For Private Plaintiffs Challenging Greenhouse Gas Regulations, Bradford C. Mank
San Diego Law Review
An important unresolved question is whether non-state plaintiffs have standing under Article III of the U.S. Constitution to sue in federal courts in climate change cases. In Massachusetts v. EPA, the Supreme Court held a state government could sue the U.S. government to address climate change issues, and suggested, but did not decide, that private litigants might have lesser rights than states. In Washington Environmental Council v. Bellon, the Ninth Circuit held that private groups did not have standing to challenge Washington State’s failure to regulate greenhouse gas (GHG) emissions from five oil refineries, and implied that private plaintiffs may …
David Lion Gardiner: A Yankee In Gold Rush California, 1849-1851, Molly Mcclain
David Lion Gardiner: A Yankee In Gold Rush California, 1849-1851, Molly Mcclain
History: Faculty Scholarship
The US-Mexico War (1846-48) transformed the San Diego region by drawing in new investors, among them David Lion Gardner (1816-92) who came from New York to seek his fortune during the Gold Rush. Uncomfortable with the reckless pursuit of profit that he witnessed in San Francisco, Gardiner set up a mercantile business in San Diego. His surviving letters to family members tell the story of his experience in California between 1849 and 1851. They also reveal the capitalist origins of modern San Diego.

Tijuana: The Third Space, Maribel Tovar
Tijuana: The Third Space, Maribel Tovar
Undergraduate Honors Theses
The war between the United States and Mexico took place in 1846. It was in 1848 that the Treaty of Guadalupe Hidalgo was formed and México lost more than half of their territories. Nearly one hundred thousand Mexicans who lived in these lands at this time became displaced. Around ninety-eight percent of the Mexicans chose to remain where they lived. Faced with territorial changes, Mexicans were then forced to devise defensive strategies of adaptation and survival in an intermediate, “third” space located in between the dominant national and cultural systems of both the United States and Mexico.
This bicultural region …

A Structured Telephonic Transition Program For Heart Failure Patients, Julia E. Robinson
A Structured Telephonic Transition Program For Heart Failure Patients, Julia E. Robinson
Doctor of Nursing Practice Final Manuscripts
HF is a fatal condition affecting more than 5 million Americans leading to frequent hospitalizations, poor quality of life and death. The annual cost to the healthcare system is approximately $38 billion, ranking HF as one of the costliest conditions to manage. Significant evidence exists that HF self-care management programs improve patient self-care and decrease HF-related readmissions. Current guidelines recommend health professionals provide comprehensive HF education focused on knowledge, skills of management, and self-care behaviors.
The Iowa Model of Evidence Based Practice provided the foundation for the practice change. Structured telephonic support (STS) was based on Bandura’s Self- Efficacy behavior …

Health Care Transition Program For Adolescents With Spina Bifida, Teresa M. Scavone
Doctor of Nursing Practice Final Manuscripts
The purpose of this evidence-based project was to evaluate the feasibility of implementing an NP facilitated formal transition program for adolescents with Spina Bifida. There is an increased awareness of the need for health care transition for youth with special health care needs (YSHCN) due to the 2009-2010 Maternal Child Health Branch National Survey findings that only 40% of YSHCN receive adequate support for transition that meets the core outcome measures. Recent studies have investigated transition in youth with chronic disease specific conditions such as diabetes, cystic fibrosis, and congenital heart defects, and provide valuable insight into possible strategies for …
Major League Baseball's Latin American Connection: Salaries, Scouting, And Globalization, Ezequiel Kitsu Lihosit
Major League Baseball's Latin American Connection: Salaries, Scouting, And Globalization, Ezequiel Kitsu Lihosit
Theses
This research examines the history of foreign, Latin American Major League baseball players. It looks at the history of the players, their countries and the expansion of recruitment and training in Latin America. Other factors such as race and labor relations contributed greatly to shifts in player recruitment by MLB. Baseball is an international game and today more than 25% of all major leaguers are foreign-born Latin Americans. This project lays out how this occurred and how the academy training system has evolved and become the industry standard for teams. Through both the history of the earliest Latin American players …
Factors Affecting Climate Change Mitigation Policy Implementation, Kelly M. Anderson
Factors Affecting Climate Change Mitigation Policy Implementation, Kelly M. Anderson
Undergraduate Honors Theses
Why do some states have policies that aggressively reduce carbon emissions, while others ignore the threat of climate change? In a world where increasingly extreme weather patterns threaten food production and species extinction, and where rising sea levels and frequent storms damage coastal infrastructure, it is now essential for states to mitigate these effects.
My paper analyzes the role of media attention on climate change and environmental association membership rates on the most recent climate change mitigation policies of South Africa, the United States, and Germany. It argues that media and environmental associations influence a population’s desire to reduce carbon …
Educational Donations And Inequality In The San Diego Unified School District, Jesse O'Sullivan
Educational Donations And Inequality In The San Diego Unified School District, Jesse O'Sullivan
Undergraduate Honors Theses
Local educational foundations (LEFs) are nonprofit organizations affiliated with a school or a district that raise money on their behalf. Broadly speaking, these nonprofits are seen as philanthropic organizations that benefit the public. My research seeks to complicate this perception by contextualizing donations to schools in an unequal school system, and examine how donations from these foundations interact with this inequality. This research seeks to investigate whether LEFs benefit the schools in least need of assistance, that is, those with high test scores and white, middle or upper class students, thereby perpetuating the already existing inequalities. LEFs may also mask …
Islamophilia: Challenging Prejudice And Promoting Mutual Understanding, Lallia Allali
Islamophilia: Challenging Prejudice And Promoting Mutual Understanding, Lallia Allali
Theses
Muslims across the United States are experiencing an unprecedented increase in discrimination and violence due to a growing fear and hatred towards Islam and Muslims. Many educators have labeled this anti-Islamic phenomenon as “Islamophobia”. Several studies have addressed the existence of “Islamophobia” and discussed its impact on the Muslim community and society at-large. However, few studies focus on helping Muslims transcend their mindset and believe in their ability to challenge prejudice and promote mutual understanding. This two- phase research attempted to fill that gap by first looking at the impact of contact relations and education in reducing Islamophobia …
