Voiding Surrogacy Contracts To Protect Children: A Blueprint For New Mexico, Jay R. Combs

This Paper analyzes the problems created by the enforcement of surrogacy contracts and proposes legislation by which the State of New Mexico can proactively protect its children and parents from the social and legal dangers of surrogacy contracts. First, this Paper will explore three of the most compelling policy reasons for voiding surrogacy contracts: (1) the societal consequences of allowing the redistribution of procreation through contract; (2) "maternal" arguments for the protection of the hired surrogate; and (3) current policies which are embedded in New Mexico Statutes. Second, this Paper will analyze other state statues which have voided surrogacy contracts. …

The existence of biologically, psychologically and socially transgendered persons challenges commonplace notions about "the sexes." The entry of transgendered persons and their concerns into the legal arena has forced the law on occasion to examine its usually implicit assumptions about sex and gender. This paper explores the following questions: is sex truly an "immutable characteristic" for all legal purposes? If not, at what point and under what circumstances does the law acknowledge a change from one sex to the other? This paper also examines the legal enforcement of gendered social norms. The Delegitimation Of Land Tenure In Tropical Peten, Guatemala, Charles Clark

Lack of legitimacy of land tenure institutions in the tropical Peten, Guatemala, contributes to the tenure insecurity that encourages rapid colonization, deforestation and forest conversion to agriculture. The author identifies historical periods of delegitimation of land tenure institutions and analyzes social, political and property rights trends which reduced thee effectiveness of property rights in the Peten. Three case studies present the complexities and chaos of land tenure institutions. Natural History Of The Southern Short-Tailed Shrew, Blarina Carolinensis, Hugh H. Genoways, Jerry R. Choate

Occasional Papers

The southern short-tailed shrew, Blarina carolinensis, inhabits a broad range of ecological situations in the southeastern United States and, in many areas, is among the two or three most abundant species of small mammals. Nevertheless, its natural history is poorly known and much of what researchers assumed was fairly well understood about this species actually resulted from work on another species (Blarina brevicauda) and may not be correct in all instances. This problem resulted when modem systematic methods revealed that the wideranging and well-studied species known at that time as Blarina brevicauda actually consisted of three species (B. brevicauda, B. …

Grandmothering, Menopause, And The Evolution Of Human Life Histories, K. Hawkes, J.F. O'Connell, N.G. Blurton Jones, H. Alvarez, Eric Charnov

Biology Faculty & Staff Publications

Long postmenopausal lifespans distinguish humans from all other primates. This pattern may have evolved with mother—child food sharing, a practice that allowed aging females to enhance their daughters fertility, thereby increasing selection against senescence. Combined with Charnov's dimensionless assembly rules for mammalian life histories, this hypothesis also accounts for our late maturity, small size at weaning, and high fertility. It has implications for past human habitat choice and social organization and for ideas about the importance of extended learning and paternal provisioning in human evolution.
