Old Blood, Bad Blood, And Youngblood: Due Process, Lost Evidence, And The Limits Of Bad Faith, Norman C. Bay

Under the law of lost evidence, absent a showing of bad faith, no due process violation occurs when the police lose potentially exculpatory evidence. This is so even though the evidence may be critical to the defense and even though post-conviction DNA testing has exonerated more than 200 individuals. Ironically, the case that developed that rule of law, Arizona v. Youngblood, is founded on the conviction of an innocent man. This Article critically examines Youngblood and provides a conceptual framework for examining the constitutional right of access to evidence. Evaluation Of Selected Ground Water Abatement Strategies For Two Produced Water Impact Sites, Katharyn M. Lee

Past practices of produced water management in southeastern New Mexico have caused impact to ground water at numerous locations. Impacted ground water shows elevated levels of dissolved solids, including chloride and in some cases petroleum hydrocarbons. Operators must abate ground water impacts to comply with New Mexico Oil Conservation Division Rules. This paper discusses the environmental costs associated with several ground water abatement strategies that might be employed to cause ground water quality to meet the New Mexico ground water standard for chloride (250 mg/L). Purpose: Hepatocyte growth factor (HGF), acting through its receptor, c-met, is a cytokine whose role in promoting cell migration has been extensively documented. HGF and c-met have been implicated in the progression of angiogenesis in many cancer models and in the mouse model of retinal neovascularization. However, HGF mediation of protease expression and of an endothelial cell migratory phenotype in the retina has not been explored. We determined if HGF and/or hypoxia effects cell migration and protease levels in retinal microvascular endothelial cells and in a mouse model of retinal neovascularization. Detection Of Polychlorinated Biphenyls In The Rio Grande Basin Above Cochiti Dam: Sources & Significance, Anthony D. Edwards

Polychlorinated biphenyls (PCBs) have been detected with increasing frequency in water and fish tissue samples in the Rio Grande Basin above Cochiti Dam (RGBACD), which correlates with the use of improved analytical methods for quantifying PCBs. Levels of PCBs identified in some fish have exceeded levels considered safe for human consumption, resulting in a Fish Consumption Advisory' for Abiquiu and Cochiti Reservoirs and the Rio Grande from Pojoaque Creek to Frijoles Canyon (Bandelier National Monument). In June of 2007, the New Mexico Environment Department (NMED) listed seven water bodies in the RGBACD as impaired due to elevated concentrations of PCBs …

Similar to many dams around the world, Cochiti Dam [since its construction in 1975 on the Middle Rio Grande (MRG), New Mexico] has contributed both benefits and negative impacts to those who make use of the MRG. Built primarily for flood control, the dam has resulted in significant geomorphic changes below the dam. This has caused the decline of some native organisms adapted to the river. Since 1994, the Rio Grande silvery minnow (RGSM) (Hybognathus amarus) has been federally listed as an endangered species. Mechanical fuel reduction projects are finding increasing use to reduce accumulation of biomass in dense forests, to reduce fire danger, and to improve forest health in wildland-urban interface areas. In many projects, biomass resulting from the thinning is chipped and applied as mulch to the treated area in an effort to promote reestablishment of herbaceous cover and as an efficient method of disposal. Changes in overstory composition coupled with the instantaneous introduction of a litter layer may dramatically alter the ecohydrology of these water-limited systems. Professionals within the fields of water resources and community and regional planning have engaged in dialogue about how to balance water consumption with development patterns in the western United States. Central to this discussion is a debate about future water management of the Gila River. There is a wide spectrum of opinions regarding the value of leaving water in the river for environmental reasons versus diverting it from the river for increased commercial development. Wastewater treatment wetlands, also referred to as constructed wetland systems (CWS), were installed in New Mexico and other states during the 1990s to provide low cost and low maintenance wastewater treatment options to small communities served by on-site treatment systems. An analysis completed in 1995 examined the design and performance of 18 subsurface flow constructed wetlands. At that time, most of the systems were relatively new and little information was obtained about their long term performance. This project examined the performance of 11 constructed wetlands built between 1990 and 1996, five of which were included in the 1995 study. The …
