Water Matters!

This article contains a list some of the key cases decided in the state and federal courts of New Mexico with very brief descriptions of the rulings. The finalized cases have been arranged by topic. This chapter is intended to be a quick and handy reference guide and not a thorough summary of the facts and law of each case. This year we have also included a list of water law statutes.

Water For New Mexico Rivers, Beth Bardwell, Adrian Oglesby Jan 2014

Water For New Mexico Rivers, Beth Bardwell, Adrian Oglesby

Water Matters!

The Rio Grande, the Pecos, the Gila, the San Juan, the Canadian—New Mexico’s rivers are synonymous with the state’s culture and natural heritage. New Mexicans overwhelmingly care about the health of the state’s rivers and that includes flows to support fish and river dependent wildlife. Rivers, wetlands, and riparian areas comprise a very small part of our landscape—a mere 1 percent. This 1 percent plays an essential role in renewing the state’s water supply for its two million residents; for sustaining the state’s second largest industry—tourism; for producing food and fiber; and for sustaining New Mexico’s web of life. Eighty …

Inter-Basin Water Transfers, Anne Minard Jan 2014

Inter-Basin Water Transfers, Anne Minard

Water Matters!

Inter-basin water transfers move water from one watershed to another. As droughts constrict the availability of water, and cities grow larger and thirstier, such transfers are increasingly being eyed as a solution. Although inter-basin transfers usually do not increase the overall availability of water in a state, they can move water to where it is needed most. Some of the main proponents of inter-basin transfers are pro-growth city and state governments as the re-allocation of water across watersheds allows for flexibility in planning for future growth.

Neutrosophic Principle Of Interconvertibility Matter-Energy Information, Florentin Smarandache, Stefan Vladutescu Jan 2014

Neutrosophic Principle Of Interconvertibility Matter-Energy Information, Florentin Smarandache, Stefan Vladutescu

Branch Mathematics and Statistics Faculty and Staff Publications

The research aims to reveal and prove the thesis of the neutral and convertibility relationship between constituent constructive elements of the universe: matter, energy and information. The approach perspective is a computationally-communicative neutrosophic one. We configure a coherent and cohesive ideation line. Matter, energy and information are fundamental elements of the world. Among them, there is an inextricable multiple, elastic and evolutionary connection. The elements are defined by the connections between them. Our hypothesis is that the relationship between matter, energy and information is a neutral one. This relationship is not required by the evidence. At this level, it does …

Law Of Included Multiple-Middle & Principle Of Dynamic Neutrosophic Opposition, Florentin Smarandache Jan 2014

Law Of Included Multiple-Middle & Principle Of Dynamic Neutrosophic Opposition, Florentin Smarandache

Branch Mathematics and Statistics Faculty and Staff Publications

In this book the author pledges for the generalization of the Lupasco-Nicolescu’s Law of Included Middle [A, nonA, and a third value T which resolves their contradiction at another level of reality] to the Law of Included Multiple-Middle [A, antiA, and neutA, which is split into a multitude of neutralities between A and antiA, such as neutA1, neutA2, etc.]. The value (i.e. neutrality or indeterminacy related to A) actually comprises the included middle value.

Further, similarly to the extension from dialectics to neutrosophy, the author extends the Principle of Dynamic Opposition [opposition between A and antiA] …

Estimation Of Suspended-Sediment Concentration Using Instream Turbidity As A Surrogate In The Middle Rio Grande, New Mexico, Jeb E. Brown Jan 2014

Estimation Of Suspended-Sediment Concentration Using Instream Turbidity As A Surrogate In The Middle Rio Grande, New Mexico, Jeb E. Brown

Water Resources Professional Project Reports

The collection of suspended-sediment concentration data is costly and time consuming, and poses risks to field personnel, yet many managers and scientists require these data. Turbidity is an optical property of the clarity of water which, if correlated to suspended-sediment concentration, can produce timely, high resolution data at significantly reduced cost. The correlation of suspended-sediment and turbidity has been proven in a number of streams, but the success is site specific and limited by changing variables such as sediment particle size, sediment color, and presence of organic and biological material, among other factors. This study determines the ability of turbidity …

Comparison Of Electrofishing Fish Surveys And Angler Observation On Three Reaches Of The Upper Rio Grande, Barry Weinstock Jan 2014

Comparison Of Electrofishing Fish Surveys And Angler Observation On Three Reaches Of The Upper Rio Grande, Barry Weinstock

Water Resources Professional Project Reports

The purpose of fish population studies is to better understand the functional relations between life stages, abundances, and spatial distributions of fish populations in the upper Rio Grande and its tributaries. Taos Field Office, New Mexico, has managed an electrofishing fish population program since 2004 for seven reaches of the Rio Grande. Managers are interested in actual angler catches and satisfaction, and often use angler surveys to gather this data. This project compared two methods of gathering data about fish populations; electrofishing and angler questionnaires. Both have deficiencies in that they collect different types of data. The intent is to …

Past, Present, Future: The Evolution Of A Wetland Treatment System In Dutchman Canyon On Vermejo Park Ranch, Zoe Isaacson Jan 2014

Past, Present, Future: The Evolution Of A Wetland Treatment System In Dutchman Canyon On Vermejo Park Ranch, Zoe Isaacson

Water Resources Professional Project Reports

The purpose of this research was to track the evolution of a constructed wetland system through time while taking into consideration anthropogenic perturbations to the system. It was accomplished by reviewing 30 years-worth of literature associated with the project site, gleaning relevant information, and then synthesizing the information to form a complete evolutionary timeline. In August 2012 a wetland was constructed using water from the evaporation ponds. The Dutchman Canyon wetland, a continuous flow, free surface wetland, was thus formed. The wetland was intended to passively treat poor-quality mine seepage and impart an improved wetland habitat for a diversity fauna …

Inundation Patterns And Their Effect On The Physical And Hydraulic Properties Of Floodplain Soils In The Middle Rio Grande Floodplain, Sophie J. Stauffer Jan 2014

Inundation Patterns And Their Effect On The Physical And Hydraulic Properties Of Floodplain Soils In The Middle Rio Grande Floodplain, Sophie J. Stauffer

Water Resources Professional Project Reports

The surface of the floodplain serves as a vadose zone boundary where water infiltrates, evaporates, or returns to the river, and sediments accumulate or are eroded. The discharge of the Middle Rio Grande has been altered by the construction of Cochiti Dam and the implementation of levees. Hydraulic connectivity in the Middle Rio Grande floodplain is perhaps most apparent at a small local wetland and a low-lying trough with a high water table capable of causing seeping floods. The objective of this study was to determine if inundation patterns impact the hydraulic and physical properties of floodplain soils. A study …

Interpretation Of The Potentiometric Surface Along The Rio Grande At Selected Locations In Albuquerque, New Mexico, Jeffrey Worthington

Water Resources Professional Project Reports

The U.S. Geological Survey installed over 240 piezometers and 27 surface-water gages along the Rio Grande in Albuquerque, NM from 2003 to 2009, to monitor groundwater and surface-water levels and water temperatures. Spanning a 20 mile distance between the bridges at Alameda Blvd. and Interstate 25, there were 8 selected locations each consisting of paired east-west transects situated perpendicular to the river (Figure 1). Paired transects comprise two parallel cross-sections of the Rio Grande inner valley that were positioned approximately 500 ft. apart and extend to the riverside drains on both sides of the river. Each transect consisted of piezometers …

Nanta Hosh Chahta Immi? (What Are Choctaw Lifeways?): Cultural Preservation In The Casino Era, Sean Everette Gantt Dec 2013

Nanta Hosh Chahta Immi? (What Are Choctaw Lifeways?): Cultural Preservation In The Casino Era, Sean Everette Gantt

Anthropology ETDs

This dissertation investigates the long-term impacts of tribal economic development programs on the cultural preservation efforts of the Mississippi Band of Choctaw Indians (MBCI). Since the 1970s the Mississippi Choctaw have initiated many different economic enterprises ranging from manufacturing plants to resort development, owning and operating a diversified portfolio of manufacturing, service, retail, and tourism enterprises. This history of engaging with western business models offers a unique perspective for analyzing the long-term effects of these practices on a tribal community. My work with the MBCI engages a long debate over the use of capitalist business models in tribal economic development …

The Effects Of Precipitation Manipulation On Carbohydrate Dynamics And Mortality In A Piñon-Juniper Woodland, Lee Turin Dickman Dec 2013

The Effects Of Precipitation Manipulation On Carbohydrate Dynamics And Mortality In A Piñon-Juniper Woodland, Lee Turin Dickman

Biology ETDs

Drought-induced forest mortality is an increasing global problem with far-reaching consequences, yet mortality mechanisms remain poorly understood. Depletion of non-structural carbohydrate (NSC) stores has been implicated as a major factor in drought-induced mortality, but experimental field tests are rare. We conducted an ecosystem-scale precipitation manipulation experiment and evaluated leaf and twig NSC dynamics of two co-occurring conifers with different water regulation strategies; the relatively drought-averse piñon pine (Pinus edulis) and relatively drought-tolerant oneseed juniper (Juniperus monosperma). Experimental drought caused decreased leaf starch in dying trees of both species and increased allocation to glucose and fructose in juniper, consistent with osmoregulation …

Molecular Characterization Of The Freshwater Snail Physella Acuta, Journey R. Nolan Dec 2013

Molecular Characterization Of The Freshwater Snail Physella Acuta, Journey R. Nolan

Biology ETDs

Current insights into general animal biology, including immune function, are derived mostly from a few model organisms, a necessity imposed by effort required for in-depth studies. Modern next-generation sequencing (NGS) enables genomics-level investigations to test whether specific aspects of biology are general or unique across animal phylogeny. Meaningful comparisons require thorough identification of phylogenetically-relevant species. To provide a touchstone for Biomphalaria glabrata, a freshwater snail that is a major study model for invertebrate immunity, physid snails (Physidae; Hygrophila; Panpulmonata; Gastropoda; Mollusca) will be developed as a model for comparative immunogenomics. Chapter 1 introduces current research capabilities and details the rationale …

Systematics Within The Zopheridae Complex (Coleoptera: Tenebrionoidea), Nathan Patrick Lord Dec 2013

Systematics Within The Zopheridae Complex (Coleoptera: Tenebrionoidea), Nathan Patrick Lord

Biology ETDs

The Ironclad Beetles, Cylindrical Bark Beetles, and Monommatid Beetles are a cosmopolitan family with over 1,700 species worldwide. Now constituting members from three previous families (Zopheridae, Monommatidae, Colydiidae), Zopheridae represent a wide array of morphological diversity and variability. Larvae of most members are fungivores/detritovores, while some are suspected of boring into sound wood. Adults are predaceous or fungivores, and some zopherids have been linked to the spread of fungal disease. Morphologically, adults are hard to separate from other tenebrionoid families. Zopherids can be distinguished by 9-11 segmented antennae with a usually abrupt, 1-3 segmented club, antennal insertions concealed from above, …

Membrane-Protein Dynamics: New Perspectives In Fcepsilonri Signaling Through Single Particle Tracking, Patrick J. Cutler Dec 2013

Membrane-Protein Dynamics: New Perspectives In Fcepsilonri Signaling Through Single Particle Tracking, Patrick J. Cutler

Biomedical Sciences ETDs

Under physiological conditions IgE binds to its high affinity receptor, FcεRI. The aggregation of IgE-FcεRI by crosslinker initiates intracellular signaling resulting in the release of histamines and other cellular mediators that are the basis for allergic disease. In the field of IgE-FcεRI, receptor immobilization was thought to trigger signaling. Recent single particle tracking (SPT) experiments presented evidence supporting the hypothesis that small mobile aggregates are signaling competent. SPT is an important method for investigating spatio-temporal relationships at the subcellular level. New SPT tools are necessary to adequately investigate this hypothesis. The studies presented here both develop and apply tools for …

Community Detection In Complex Networks, Yaojia Zhu Dec 2013

Community Detection In Complex Networks, Yaojia Zhu

Computer Science ETDs

The stochastic block model is a powerful tool for inferring community structure from network topology. However, the simple block model considers community structure as the only underlying attribute for forming the relational interactions among the nodes, this makes it prefer a Poisson degree distribution within each community, while most real-world networks have a heavy-tailed degree distribution. This is essentially because the simple assumption under the traditional block model is not consistent with some real-world circumstances where factors other than the community memberships such as overall popularity also heavily affect the pattern of the relational interactions. The degree-corrected block model can …

This research focuses on the role …

Consequences Of Prenatal Ethanol Exposure And Maternal Stress On Offspring, Miranda C. Staples Dec 2013

Consequences Of Prenatal Ethanol Exposure And Maternal Stress On Offspring, Miranda C. Staples

Biomedical Sciences ETDs

Extensive evidence in humans suggests that exposure to insults during gestation, such as ethanol or maternal stress, can negatively impact the developing fetus in manners which can last into adulthood. These deleterious effects can include various behavioral challenges including cognitive impairments and increases in anxiety. These findings have been replicated in animal models of prenatal ethanol exposure and prenatal stress exposure, but little work has been conducted on measuring the interactive effects of the two prenatal insults in combination. Currently, there is no animal model of combined prenatal ethanol and prenatal stress exposures which has been utilized to systematically evaluate …

Abstract Models Of Molecular Walkers, Oleg Semenov Dec 2013

Abstract Models Of Molecular Walkers, Oleg Semenov

Computer Science ETDs

Recent advances in single-molecule chemistry have led to designs for artificial multi-pedal walkers that follow tracks of chemicals. The walkers, called molecular spiders, consist of a rigid chemically inert body and several flexible enzymatic legs. The legs can reversibly bind to chemical substrates on a surface, and through their enzymatic action convert them to products. We study abstract models of molecular spiders to evaluate how efficiently they can perform two tasks: molecular transport of cargo over tracks and search for targets on finite surfaces. For the single-spider model our simulations show a transient behavior wherein certain spiders move superdiffusively over …

Model Selection For Stochastic Block Models, Xiaoran Yan Dec 2013

Model Selection For Stochastic Block Models, Xiaoran Yan

Computer Science ETDs

As a flexible representation for complex systems, networks (graphs) model entities and their interactions as nodes and edges. In many real-world networks, nodes divide naturally into functional communities, where nodes in the same group connect to the rest of the network in similar ways. Discovering such communities is an important part of modeling networks, as community structure offers clues to the processes which generated the graph. The stochastic block model is a popular network model based on community structures. It splits nodes into blocks, within which all nodes are stochastically equivalent in terms of how they connect to the rest …

Sowing Seeds For The Future To Honor Tigua History And Tradition: Diabetes Prevention And Management At Ysleta Del Sur Pueblo, Sean Patrick Bruna-Lewis Dec 2013

Sowing Seeds For The Future To Honor Tigua History And Tradition: Diabetes Prevention And Management At Ysleta Del Sur Pueblo, Sean Patrick Bruna-Lewis

Anthropology ETDs

This dissertation examines type 2 diabetes management and prevention at Ysleta del Sur Pueblo, a federally recognized American Indian tribe in El Paso, Texas. Type 2 diabetes is a serious and growing concern at the Pueblo, and while the incidence is not as high as it is in other tribes in the United States, it is still much higher than the national average. Despite excellent biomedical research that shows how individuals can prevent diabetes, and countless translated diabetes prevention programs targeted to individuals and families to prevent the disease, the incidence of diabetes continues to rise. This dissertation argues that …
