ABSTRACT
Low-income adolescent males are subject to both health and educational inequities. Male adolescents are the least likely of all pediatric age and gender groups to access either primary care or behavioral health services. This same population is most likely to not complete high school or college. Health and educational outcomes are both affected by social determinants. School-based Health Centers (SBHCs) are known for providing access to primary care and behavioral health services for low-income and vulnerable populations. The Silent Problem: The Implicit Personhood Determination In State V. Montoya, Erin Phillips

Can a dead person still be considered a person under a criminal statute? This unspoken question is at the center of State v. Montoya, illustrating how a facially simple and uncontroversial case can actually be very misleading. On appeal in Montoya, the defendant argued that the conviction of robbery was unfounded, since the victim was already deceased at the time of theft. The Court of Appeals gave little attention to the argument about the victim’s personhood, instead analyzing the case through the lens of a rational link standard, essentially measuring the connection between a homicide and a subsequent robbery in …

Sexual Violence Among New Mexicans Living With Intellectual/Developmental Disabilities, Theresa Cruz, D E. Ross-Reed

Sexual violence among people living with intellectual and developmental disabilities (I/DD) is highly prevalent in New Mexico and in the United States. More than one in four New Mexican adults with I/DD report a history of forced sex or attempted forced sex, compared to fewer than 1 in 10 among people without I/DD. Power imbalances between caregivers and clients, lack of sexuality education for people with I/DD, isolation, gaps in caregiver training, frequent staff turnover, a culture of ableism and compliance, and underreporting of sexual violence all contribute to disparities in sexual violence victimization.

Without the necessary information to learn new rules and protocols many attorneys are understandably reluctant to practice in a new jurisdiction. As a result, tribal courts are underused or misused. This handbook is intended to help attorneys and advocates become more aware of the various individual tribal court systems and to learn their rules and protocol.

In this article, three professors of color speak out in response to the continuation of White police killings of Black people in the United States. We contend that there is a strong need for everyone, professors and educators in particular, to be proactive in confronting racism by tackling not avoiding, difficult questions and conversations. We propose that through the enactment of deep understandings and thick descriptions in our classrooms at all levels we may encourage a critical humanitarian response to the challenges of not knowing the diverse “Other.” We present real experiences from our teaching to illustrate the kinds of …

Every person in New Mexico has a statutory duty to report known or suspected child abuse or neglect to the proper authorities. Does this duty extend to attorneys who have their own set of ethical rules prohibiting disclosure of confidential client information? In State v. Strauch, the New Mexico Supreme Court held that the “every person” language of the Abuse and Neglect Act extends the mandatory duty to report to all persons, not just those professionals who work most frequently with children and are enumerated in the statute. This narrative study documents the experiences of seven Latina community educators through focus groups, interviews, and artifact data. Given the stigma of mental health (Bayer, 2005), a lack of culturally centered emotional curriculums (Boler, 1997; Boler & Zembylas, 2003) which are removed from structural oppression (Collins, 2002,1989; Crenshaw, 1991, 1993; hooks, 2014), educators, parents, and communities are in need of mental health promotion tools. According to the American Psychiatric Association (APA, 2015), approximately 70 million Americans annually are diagnosed with mental health issues that disable daily functioning. Investigating Error-Related Processing In Incarcerated Adolescents With Elevated Psychopathic Traits, James M. Maurer

Adult psychopathic offenders show an increased propensity towards violence, impulsivity, and recidivism. For a subsample of youth with elevated psychopathic traits, the disorder appears to remain stable throughout development. Such youth represent a particularly severe subgroup characterized by their extreme behavioral problems and comparable neurocognitive deficits as their adult counterparts, including perseveration deficits. Here, we investigated error-related processing using two distinct neuroimaging methodologies in response-locked event-related potentials (ERPs) and functional magnetic resonance imaging (fMRI) in two samples of incarcerated juvenile male offenders who performed a response inhibition Go/NoGo task. Current researchers in the adolescent health field are beginning to argue that the descriptive knowledge base of adolescent health lacks a strong conceptual base and may be inadequate to sufficiently inform a comprehensive assessment of adolescent health behaviors. This study aimed to build upon the conceptual base by integrating a descriptive epidemiologic study (2013 New Mexico Youth Risk Resilience Survey) with psychological theory and factor analytic methodologies to better understand the relationship between health behaviors and resilience factors. Despite the conventional wisdom that U.S. social policies represent the emergence of a monolithic, racialized system of poverty governance that is purely punitive, there is increasing evidence that many states are repealing disciplinary social policy measures. In fact, several states are increasingly adopting enabling policies that are aimed at increasing public benefits to restore social equity among low-income families. These developments challenge current depictions of the landscape of the U.S. welfare state and they suggest that social and early childhood health policy choices may not simply emanate from a unified conservative social movement and racialized social structures. In this study I investigated the psycho-educational component of the Healing in Resonance model of treatment as implemented at the Attachment Healing Center for working with children who have been identified as having disorganized attachment. Multi-case methodology was used with five families representing five parents and five children. Grounded theory was used to analyze the journals, interviews and focus group discourse of the participants. There were also some quantitative tools used to diagnose the children and to quantify their behavioral changes. The Lived Experiences Of Counseling Professionals Conducting Suicide Risk Assessments For Youth: A Phenomenological Approach, Christine Abassary

This study explored the lived experiences of counseling professionals conducting suicide risk assessments for youth kindergarten through 12th grade receiving a suicide risk assessment recommendation. A qualitative phenomenological approach was utilized to capture the perceptions of the participants in this study. Fifteen (15) in depth, semi-structured interviews and a focus group with seven (7) returning participants were the primary sources of data for this study. Five (5) themes emerged: Care, Supervisory Relationship, Challenges, Symptoms of Vicarious Trauma and Transcendent Growth Experiences. Implications for the counseling profession may encompass enhanced organizational development, supervision, training and clinical preparation for counseling professionals providing …

This Article addresses the issue of New Mexico’s treatment of immigration status in four parts. Part I explores the history of New Mexico. From its earliest days New Mexico demonstrated an acceptance of immigrants into society. Many New Mexico laws grant rights to residents of the state regardless of immigration status, and as a result, undocumented immigrants have become large contributors to the state’s economy. Part II discusses New Mexico’s approach to issues involving a party’s immigration status. Although New Mexico has not explicitly prohibited the introduction of a party’s immigration status, case law suggests New Mexico courts would deny …

Child care settings may have a role in shaping childrens dietary habits. Foods and beverages served in many child care centers do not meet the nutrition recommendations. A sample of 10 child care centers participated in the study. Data was collected through an online survey and centers provided a copy of their menus. Food groups were compared to the Child and Adult Care Food Program meal pattern recommendations and nutrient contents were compared to half and two thirds of the DRIs for children 2-5 years. Argument:
This Court should reject the application of the death sentence to Robert Fry and Tim Allen for statutory and constitutional reasons. First, H.B. 285, 49th Leg., 1st Sess. (N.M. 2009) repealed the statutory authority governing execution of the death sentence. Without statutory authority, the Corrections Department cannot act. In addition, in light of the repeal of the death sentence in New Mexico, the application of the death sentence to Mr. Fry and Mr. Allen would violate the Cruel and Unusual Punishment Clause and the Equal Protection Clause of the New Mexico Constitution. An alternative basis for precluding the use …
