Montana Standard Interviews Barbara Creel On The Violence Against Women Act And Double Standards, Barbara L. Creel

Barbara Creel, Southwest Indian Law Clinic Director Professor at the University of New Mexico, agreed with Babcock that the case was not about tribal sovereignty.
Yet she said the case reveals inequities in the criminal justice system of tribes created when Congress told them how to structure their governments under the Indian Reorganization Act but did not provide sufficient funding or additional legal protections to make those systems function as intended.
Additionally, in a brief she and colleagues filed to the court, Creel argues that the Violence Against Women Act creates a discriminatory double standard.

Although Congress intended to protect women in Indian Country from domestic abuse, they condoned the use of prior “uncounseled” tribal court convictions to charge and convict an Indian as a federal habitual domestic violence offender.
Justice Ruth Bader Ginsburg, who wrote Bryant, denigrates Indian people’s civil rights, citing the need to protect Native women from domestic violence. But Department of Justice statistics show most domestic violence perpetrators in Indian country are non-Indians, and the Bryant decision leaves intact their constitutional rights, including the right to appointed counsel.

The movement to reduce over-prosecution and mass incarceration has focused almost exclusively on non-violent offenders despite data showing that over half of all prisoners incarcerated within the United States are sentenced for crimes of violence. As a consequence of the focus on nonviolent offenses, the majority of current and future defendants will not benefit from initiatives offering alternatives to criminal prosecution and incarceration. A discussion of alternatives to the criminal justice system in cases of violent crime must begin by acknowledging that violent crime is not monolithic. Water is an essential and increasingly scarce resource in the west. Such scarcity has revealed the importance of considering the public interest in allocating water rights. Many states, including Arizona, apply the doctrine of prior appropriation to allocate water rights. Arizona, through the Arizona Department of Water Resources, is statutorily required to review all water allocations with the public interest and welfare in mind during its initial appropriation of water rights. However, in reality, the majority of Arizona surface water has already been initially appropriated--increasing the popularity of severance and transfer agreements to change the use of water. While a great deal of public attention addresses the Halliburton loophole of the Energy Policy Act of 2005 and Bureau of Land Management efforts to regulate hydraulic fracturing on public lands, less attention has been paid to the National Park Service “9B Regulations,” which provide a national regulatory framework governing the exercise of oil and gas rights in national parks. This article begins with a review of law pertaining to oil and gas drilling in national parks. This article examines the adverse effects of federal case law and legislation on tribal courts and tribal courts’ ability to incorporate tribal customary law. Tribal customary law is the law given to tribes by holy deities which governs tribal ways of life. It is important to maintain tribal customary law because it strengthens tribal communities’ identities and cultural foundations. Essays On Gender, Ethnicity, And Health In The United States And Turkey, Tunay Oguz

This dissertation is composed of three studies examining barriers to health and healthcare that affect individuals on the basis of their race, ethnicity, and gender. The first study examines access to care disparities between non-Hispanic whites and Hispanics. I find that observed characteristics explain all of the disparities in access to care between these two groups, a marked change from a decade ago when characteristics explained only 65 percent. However, disparities in access to care between women and men remain unexplained even when differences in their attitudes and beliefs regarding healthcare are controlled for, especially for Hispanic men and women. …

Philibert Louis Debucourt's (1755 - 1832) fête galante and domestic genre prints treated women, their social positions, and their experiences of love and relationships as a primary subject, and participated in the rapidly shifting political, economical, and social structure of the years surrounding the 1789 Revolution. These prints aided in the construction of appropriate and inappropriate female behavior of the ideal citoyenne through the representation of eighteenth-century beliefs regarding female sexuality and its class associations. This paper explores best practices in emergency management, using eight interviews and a focus group to examine how New Mexico Emergency Managers (EM) individually apply best practices. The interviews were conducted with local EMs from New Mexico. The focus group was conducted using a group of four EMs from central New Mexico. This paper is an exploratory qualitative study to identify which best practices are used within New Mexico. A key idea in the communities and crime literature is that residents need to take ownership and intervene as a strategy to solve community problems including crime. This process is part of a larger concept called community social organization, which refers to the ability of a neighborhood to achieve collective goals like public safety. It is important to understand what predicts intervention at the micro-level as individuals will likely not react the same to similar neighborhood characteristics.
