Use Of Chemical And Isotopic Identifiers To Characterize Ground Water Contamination Near Two Uranium Mill Sites, Central Nm, Mitchell T. Schatz
Civil Engineering ETDs
Chemical and isotopic signatures were used to discriminate between anthropogenic ground water and naturally occurring constituents. The U-234/U-238 activity ratio (AR) was determined in 34 samples from several aquifers underlying two former uranium mills near Milan, NM. Disposal of uranium ore waste into unlined tailings resulted in ground water contamination in the Lower San Mateo Creek Basin area. Ground water contamination from uranium mills have impacted the local ground water for residents down-gradient from the mills.
Previous studies that used uranium isotopes identified activity ratios of mill-derived uranium were near the secular equilibrium of 1, and those from natural ground …

Cosmopolitan Democracy And The Detention Of Immigrant Families, Rebecca Sharpless
New Mexico Law Review
This Article employs the cosmopolitan political theory of Seyla Benhabib as a framework for understanding the U.S. government’s shifting decisions about family detention and immigration policy more generally. Although Benhabib is a leading political theorist, few have used her work to analyze particular immigration policies or laws. This Article begins to fill that gap. Benhabib has much to offer scholars and advocates who envision a world of expanded opportunities for immigrants seeking to enter and for those already here. She calls for increasingly porous, but not open, borders, providing a middle-ground between utopian open-border positions and the exclusionary bent of …

Ambivalent Subjects In Neoliberal Times: Non-Governmental Organizations And Binational Same Sex Couples In The United States, Jara M. Carrington

This dissertation is a critical examination of the increasingly intimate relationship between the neoliberal state, non-governmental organizations (NGOs), and their constituents through the lens of NGO-produced advocacy for “binational same sex couples” in the United States. I analyze how neoliberal political and economic ideologies are reconfiguring the role of NGOs, entities traditionally understood as outside state power, as well as the aspirations of their constituencies, within the United States. In particular, I interrogate how NGOs are an increasingly important site in the (re)production of normative gay and lesbian subjects, and illustrate how LGBTQ-identified individuals negotiate these conditions as they seek …

State Constitutional Law As A Basis For Federal Constitutional Interpretation: The Lessons Of The Second Amendment, D. Bruce Black, Kara L. Kapp
New Mexico Law Review
This Article advocates that courts should rely more heavily on an underappreciated method of constitutional interpretation: reference to parallel state constitutional text and jurisprudence. This article is novel insofar as it develops a normative argument for why courts should consult state constitutions in interpreting the meaning of the federal constitution. To illustrate the value of this method for jurists who ascribe to various judicial philosophies, the authors apply this method to the U.S. Supreme Court’s newly developed Second Amendment jurisprudence. While District of Columbia v. Heller provides some guidance in interpreting the Second Amendment under the Court’s new framework, many …

Voters and legislatures throughout the country are winding down the War on Drugs and legalizing marijuana for medical and retail use. While many regulatory decisions are made at state capitals nationwide, the marijuana landscape is largely shaped by local authorities exercising influence through land use planning. Over a decade after passing a voter-initiated medical marijuana program, Colorado voters approved a State Constitutional Amendment fully legalizing marijuana for adult use. The "Regulate Marijuana like Alcohol Act of 2012" made Colorado the first state to legalize the sale, taxation, and possession of marijuana through a commercial market. The demand for wireless connectivity has prompted regulatory authorities in the United States to investigate spectrum sharing of the DSRC band with U-NII operators. However, DSRC operation has public safety implications, and moreover, time-critical requirements due to the vehicular nature of its application. The field of cognitive radio has identified several sensing techniques for the identification of licensed operators in a given band. This thesis explores cyclostationary detection techniques for primary users. A method will be identified for the detection of the 802.11p OFDM modulation used for DSRC communications.
