“Racial mirroring” refers to efforts by one group to match the primary racial composition of another group. In contrast to racial balancing, which takes place when two groups are adjusted simultaneously to achieve a desired degree of racial equilibrium between them, racial mirroring occurs when the racial makeup of one group is adjusted so as to reflect the predominant racial identity of the second group. Employers and even federal courts engage in racial mirroring. For example, in order to generate trust among customers, employers have hired or promoted individuals of the same race as the employers’ primary customer base. Further, …

Better Call Saul: Is You Want Discoverable Communications: The Misrepresentation Of The Attorney-Client Privilege On Breaking Bad, Armen Adzhemyan, Susan M. Marcella

Initially, this article reviews the law regarding the attorney-client privilege in federal courts and in New Mexico, including a discussion of waiver. Next, this article explores Breaking Bad ’s depiction of the privilege, focusing on the perpetuation of two common myths: the myth of the dollar bill as a prerequisite to the formation of a privileged relationship and the myth that all communications with a lawyer are protected. This article concludes with a discussion of the risks of waiver portrayed on Breaking Bad. In particular, this article examines some of the issues raised by Saul’s joint representation of Walt and …

Advantages Of The One-Client Model In Insurance Defense, Jean Fleming Powers

This article explores the debate first by describing the one-client and two-client models that are at the heart of the disagreement, and second, by looking at the relationships and obligations that create conflicts and concerns. It explains how the one-client model is consistent with the obligations undertaken in the contract of insurance, better fosters the attorney’s professional obligations, better protects the insured as a consumer of insurance and of legal services, and ultimately better protects the interests of the insurer and the attorney. Effects Of Intimate Partner Violence On Maternal Reflective Functioning And Attachment Relationship In Hispanic/Latina Women And Their Preschool-Age Children: A Qualitative Study, Patricia Martinez Burr

Research indicates that thousands of women across the world suffer intimate partner violence (IPV) under the hands of their partner on a daily basis. Understanding the effects of intimate partner violence on their psychological functioning and maternal response to very young children is crucial to our understanding and provision of appropriate treatment. This qualitative study used a transcendental phenomenological approach designed to analyze the in-depth interview responses of ten Hispanic/Latina mothers of preschool-age children, who had been victims of IPV within the last year to examine these effects. On Local Fracking Bans: Policy And Preemption In New Mexico, Alex Ritchie

In the midst of the hydraulic fracturing revolution, elected officials in Mora County, New Mexico recently banned all oil and gas production within the county. But the officials went even further, stripping corporations of constitutional rights and declaring the constitutions of the United States and the state of New Mexico illegal if interpreted as inconsistent with the ordinance. Why would a small rural county like Mora with no oil and gas operations to speak of adopt such an extreme ordinance? This article applies economics, political choice, and localism theories to argue that Mora County’s decision may be at least partly …

Impossible Choices: Balancing Safety And Security In Domestic Violence Representation, Camille Carey, Robert A. Solomon

Domestic violence victims often face the impossible choice between physical safety and financial security. State intervention can offer some protection to victims, but enlisting the criminal justice system through reporting domestic violence or restraining order violations can have drastic financial consequences. Involving the state is likely to lead to sanctions for the abuser which would ultimately deprive the victim of child support, alimony, and other financial support, which may be the totality of the victim’s financial resources. To avoid this result, many victims refuse to enforce court orders intended to maximize their safety. This article examines the context in which …

We conclude in this Article that expanded practice-based, experiential education will provide foundational learning for the successful transition from law student to law practice, and that clinical education (in-house clinics, hybrid clinics, and externships) is crucial to the preparation of competent, ethical law graduates who are "ready to become professionals." We urge law schools to require each graduate complete a minimum of twenty-one experiential course credits over the three years of law school, including at least five credits in law clinics or externships. The Rio Grande, the Pecos, the Gila, the San Juan, the Canadian—New Mexico’s rivers are synonymous with the state’s culture and natural heritage. New Mexicans overwhelmingly care about the health of the state’s rivers and that includes flows to support fish and river dependent wildlife. Rivers, wetlands, and riparian areas comprise a very small part of our landscape—a mere 1 percent. This 1 percent plays an essential role in renewing the state’s water supply for its two million residents; for sustaining the state’s second largest industry—tourism; for producing food and fiber; and for sustaining New Mexico’s web of life. This Article will contribute to the ongoing dialogue about special education and the IDEA in two ways. First, it will describe patterns that have emerged from our work with individual children and families that shed light on how common IDEA implementation failures increase the risk of poor outcomes for students with social, emotional and behavioral challenges. Critiques of the law and proposals to amend it should be grounded in an understanding of exactly how and why it is falling short of meeting its promise to these children. This dissertation explores various effects of deuterium oxide (D2O also known as heavy water) in nature. Water is everywhere and interacts with just about everything. As such, it would be quite a daunting task to characterize every effect that water exhibits on everything in the universe. This research is a small piece of the puzzle, and provides some fundamental understanding of how water interacts with other molecules. This is done from two viewpoints: (1) the effects of heavy water on living cells and (2) the effects of heavy water on molecules. Varying concentrations of deuterium oxide were used as the …

Nearing Thirty Years: The Burger Court, Strickland V. Washington, And The Parameters Of The Right To Counsel, Joshua E. Kastenberg

In Strickland v. Washington, the Court issued a standard for determining when defense counsel's ineffective performance, through no direct fault of the prosecution, law enforcement, public, or judiciary, undermined the fairness of a trial such that a conviction or sentence had to be rendered as a violation of due process. The article's conclusion presents a model for applying the legal history underlying Strickland to ineffective assistance cases.

Since the 2008 financial crisis, unprecedented numbers of homes have been lost to foreclosure in the United States, all while public funds for free or reduced fee legal representation in some communities have all but disappeared. This means that most homeowners in foreclosure are unable to find lawyers to represent them. At the same time, clinical legal education, especially in subjects related to business and commercial law, is on the rise. This convergence offers a unique opportunity for law school clinics to give students valuable training in both litigation and financial law and also help fill the deep need for …
