Law students Daniel Marquez and Patrick Redmond. under the supervision of University of New Mexico Law Librarians Barbara Lah and Alexandra Siek, researched the issue of reciprocity and bar membership. This is a short summary of the memorandum discussing the findings of that research. Collectively the memos discuss the following issues raised by reciprocity: l) the various forms of reciprocal licensing schemes: 2) the impact that reciprocal licensing has had on bar membership 3) a comparison of reciprocal licensing to admission pro hac vice; 4) legal issues such as constitutional concerns raised by the adoption or rejection of reciprocity; and …

Apart from the major cities along the Rio Grande corridor, much of New Mexico remains relatively rural. Recent studies estimate a 2013population of around 2,085,500 statewide. In the state fiscal year 2011,about 1,836,000 people, or 88 percent of New Mexico’s population obtain their water from community water systems. Approximately 284,000 people, or about14 percent of the population, receive their drinking water from community water systems serving fewer than 5,000 people. As of 2012, there are 1,148 public water systems that provide drinking water in New Mexico. Of these systems, 593are community water systems; of these, 546 serve fewer than 5,000 …

The water allocation issues are hotly contested in south-central New Mexico and the surrounding area. Today, the river and those who depend on it face more administrative challenges in the face of shrinking water supplies and increased population. These challenges have given rise to two ongoing lawsuits: the Lower Rio Grande Adjudication,New Mexico v. EBID, et al., 96-CV-888 (1996) (N.M. v. EBID) in the New Mexico Third Judicial District Court (adjudication court) and the New Mexico v. United States,et al., D.N.M. 11-CV-691 (2011) (N.M. v.U.S.) in United States District Court of New Mexico (U.S. District Court).

Las Voces De America: Reflecting On Mari Matsuda's Voice, Stories, And Analysis, Margaret E. Montoya

Professor Matsuda's exhortation to listen to people of color was certainly heard and seized by people of color. It spoke to me personally and inspired me as I was writing my first article, Mascaras, Trenzas y Grerias. Once the multiracial group of scholars that took the name "LatCrit" organized ourselves, we deliberately and intentionally centered our annual conferences around listening to the voices at the bottom, including the local activists in the cities in which we met. We listened to such voices as both method and substance.

Law school clinics' are an important part of legal education around the world, but there are still many places without clinics, including Taiwan. It is important for Taiwanese legal educators to consider whether and how clinical education might fit into the Taiwanese legal education system. When discussing clinical education, several concerns are commonly raised. are undergraduate students capable of doing and benefitting from clinical work? Is student practice legal? State Corporate Income Taxes (CIT) generally conform to the basic design and provisions of the federal tax, which results in corporate income being taxed twice, once at the corporate level as it is earned, and again at the individual shareholder level. Most state corporate income taxes also incorporate at least some of the federal provisions that narrow the corporate income tax base, such as bonus depreciation and the domestic production activities deduction. State corporate income taxes also have very high compliance costs relative to revenue, and are a highly volatile source of state revenue. In addition, state corporate income taxes …

As clinical teachers answer the exciting call to move beyond the traditional model of individual client representation, we should not leave behind the vital lessons that law students learn from individual clients. Individual representation is ideal for teaching law students lawyering skills and values in a human context. Representing individual clients gives students the opportunity to experience full ownership over representation, to experience the role of the attorney, and to feel the profound weight of professional responsibility. Correcting Myopia In Domestic Violence Advocacy: Moving Forward In Lawyering And Law School Clinics, Camille Carey

Lawyers and law school clinics have become myopic in their approach to civil domestic violence lawyering. This article argues that domestic violence lawyering should expand beyond its current focus on family law to move domestic violence law and practice forward. Drawing on theoretical frameworks from criminal law and feminist legal theory, this article proposes a lawyering model that expands individual representation across a wide spectrum of case types while also challenging systems that enable battering or do not support victims in their efforts to secure safety. This Article explores the various models of representation used by attorneys in special education cases and advocates for thoughtful identification of the client or clients through a contextualized, individualized decision made collaboratively by the lawyer and client(s), with considerations of a panoply of factors. Part I attempts to unpack these models. While clear advantages exist with each of the models, the Article presents case examples and questions that illustrate some of the challenges that may be presented by each model. An Ethnographic Exploration Of Parental Beliefs Of Migrant Farm Worker Parents, Alexis Marie Newton

The purpose of this study was to explore and describe the health beliefs of migrant farm worker parents in their own words. The concepts of health beliefs were explored using the qualitative research design of ethnography. A purposive sample consisted of twenty migrant farm worker parents ranging in age from 19 to 50 working in Weld County in north central Colorado. Data collection took place over a 2 month period during growing season. Data were generated using the following techniques: interviews, field notes, and journaling. Ethnographic analysis yielded themes and sub-themes from the data. The overarching theme is the migrant …

It Taxes A Village: The Problem With Routinely Taxing Barter Transactions, Sergio Pareja

Under current law, all true barter transactions, such as babysitting cooperatives, create taxable income. Although the IRS often fails to catch unreported transactions, lawyers and accountants have an ethical duty to advise clients to report these taxable transactions on their income tax returns. This article proposes that Congress change the law to generally exclude barter transactions from income when they do not rise to the level of being a trade or business of the taxpayer. This simple change to the law will allow communities to work together without worrying about tax disincentives for doing so.

Transactional matters tend to come to us more complicated as is, and there is not a transactional equivalent of the SSI hearing or a drop-in transactional clinic at a soup kitchen. This Article explores rules of professional responsibility, theory, and reasoning processes related to advising clients to seek mental health treatment. Furthermore, this Article looks at cultural and financial aspects of treatment, and concludes with recommendations on how a lawyer should counsel her client once she determines that mental health treatment is appropriate. Part I discusses humanitarian reasons that support a lawyer's decision to advise her client to seek mental health treatment.
