My goals in this essay are to place legal education’s COVID-19 crisis into this broader context and illuminate the unique opportunity that millennial law professors have to create the conditions for more robust community participation within and outside of our law schools. Part I summarizes the decline of civic engagement and social capital in preceding decades and its consequences for law, public discourse, and quality of life. Part II outlines how this deficit of social capital exacerbates the challenges facing law schools and professors in delivering legal education and constructing community during the coronavirus pandemic. Immigration is at the forefront of national, state, and local policy struggles in the United States, and Latinx/@ immigrants have experienced increased deportations, detention, and individual threats. A mobilities perspective allows analysis to extend our view of migration beyond frameworks confined to pre- and postmigration, examining trajectories of social inclusion and exclusion that are influenced by multiple factors in the receiving country. The Immigrant Well-being Project, a community-based participatory research project involving university faculty, students, staff, and representatives from 4 community-based organizations (CBOs), was initiated in New Mexico in 2017 to better understand and promote Latinx/@ immigrant mental health and …

Hierarchies persist in legal academia. Some of these, while in plain view, are not so obvious because they manifest in seemingly small, mundane choices. Synecdoche is a rhetorical device used to show how one detail in a story tells the story of the whole. This Article examines hierarchies of elitism and gender through a lens of synecdoche. The focus is on the choice of citation guide. Even something as seemingly benign and neutral as choosing a citation guide can reveal hierarchies of elitism and gender bias in legal education and the legal profession. The Virtue Of Vulnerability: Mindfulness And Well-Being In Law Schools And The Legal Profession, Nathalie Martin

This article examines the role of vulnerability in transforming individual relationships, particularly the attorney-client relationship. In this essay, Martin argues that broadening our expressions can improve our client relations and decrease the likelihood that when that inevitable mistake occurs, we will be sued for it. Also, based upon virtue ethics, that practicing vulnerability is also virtuous and thus worthwhile in and of itself.
This essay starts by describing the traits people look for in lawyers as well as evidence that clients often feel that their lawyers are less than human. Then examines how legal education contributes to this problem by …

Sexual Violence Among New Mexicans Living With Intellectual/Developmental Disabilities, Theresa Cruz, D E. Ross-Reed

Sexual violence among people living with intellectual and developmental disabilities (I/DD) is highly prevalent in New Mexico and in the United States. More than one in four New Mexican adults with I/DD report a history of forced sex or attempted forced sex, compared to fewer than 1 in 10 among people without I/DD. Power imbalances between caregivers and clients, lack of sexuality education for people with I/DD, isolation, gaps in caregiver training, frequent staff turnover, a culture of ableism and compliance, and underreporting of sexual violence all contribute to disparities in sexual violence victimization.

Without the necessary information to learn new rules and protocols many attorneys are understandably reluctant to practice in a new jurisdiction. As a result, tribal courts are underused or misused. This handbook is intended to help attorneys and advocates become more aware of the various individual tribal court systems and to learn their rules and protocol.

Bringing Counsel In From The Cold: Reconciling Ethical Rules With The Quagmire Of Insurance Defense Practice, Joseph Regalia, V. Andrew Cass

Litigators have a tough job: demanding clients, relentless deadlines, and constant pressure to get everything just right. But insurance defense attorneys deal with this and more. Being an insurance-defense attorney means serving two masters: the insurance company that pays the bills, and the insured who stands to lose if the case turns out badly. Not to mention that the sorts of complicated liability cases for which insurers provide coverage often spawn twisted webs of attorney expectations and obligations--particularly ethical ones. This essay sketches an arc from my childhood to being an Harvard Law School student to my academic work and professional commitments as a law professor and an alumna of Harvard Law School, working to increase access and success in the legal and medical professions for students and faculty of color. I compare aspects of legal and medical education using demographic data as well as some observations about how diverse faculty have transformed the two professions in their respective approaches to and rationales for diversifying the professions and examine the work being done by diverse faculty in law and health. …

Throughout the country, appellate bench, bar, and court staff have designed pro bono programs for state court appeals to help litigants of modest means who cannot afford quality appellate representation. The aim of this manual is to serve as a practical tool for appellate pro bono programs and for the expansion of and cross-pollination between existing programs. The manual provides a basic framework and then provides specific information on programs in 24 states.

In recent years, the number of Central American children fleeing violence and seeking protection in the United States has surged, and these children’s cases have flooded the immigration courts. Children are treated virtually the same as adults in immigration court, and, because they are not provided government-appointed counsel, many must defend themselves from deportation pro se. In 2014, 80% of children—roughly 34,130—were unrepresented, and this lack of representation often has profound consequences: many of these children are eligible for protection from deportation, but, without access to attorneys, most will be deported anyway. Every person in New Mexico has a statutory duty to report known or suspected child abuse or neglect to the proper authorities. Does this duty extend to attorneys who have their own set of ethical rules prohibiting disclosure of confidential client information? In State v. Strauch, the New Mexico Supreme Court held that the “every person” language of the Abuse and Neglect Act extends the mandatory duty to report to all persons, not just those professionals who work most frequently with children and are enumerated in the statute. What are lawyers to do when their obligations to clients conflict with their obligations to the law? How are state ethics systems expected to manage conflicting obligations to state and federal law? This article explores the ethical conundrum of medical marijuana representation in New Mexico. The New Mexico advisory ethics opinion counseled lawyers to avoid “assisting” medical marijuana businesses, but did not clarify what type of conduct qualified as “assistance.” In addition, the New Mexico Supreme Court refused to adopt Rule 16-102(E), which would have carved an exception in the New Mexico Rules of Professional Conduct for assistance of medical …

The Relationship Between Online Students' Use Of Services And Their Feelings Of Mattering, Tracy L. Hart

The purpose of this single case study was to examine the relationship between online students’ use of support services and their feelings of mattering using a convergent parallel research design to collect quantitative and qualitative data. Students enrolled exclusively in online classes during the academic year 2015-2016 at the University of New Mexico (UNM) were invited to participate. The survey was based on the theoretical and conceptual frameworks for comprehensive services and mattering theory. Responses provided descriptive statistics and correlation analysis with stories that added to the description of students’ service experiences.

Local ordinances that restrict payday lending constitute an important strategy in the overall attack on this problematic form of lending. In this report, made possible by the generous support of Silicon Valley Community Foundation, we describe and analyze campaigns in three locales that differ markedly in the opportunities and challenges faced by ordinance advocates. The locales are Santa Clara and San Mateo counties in California (“Silicon Valley”); Dallas, Denton, and Tarrant counties in Texas; and Salt Lake County in Utah. This report finds both commonalities and important variations among these campaigns. While there is no single recipe for a successful …

This thesis examines the World Banks Latin America and the Caribbean Blue Water Green Cities (BWGC) urban water development initiative that began in 2009. This program attempts to create a comprehensive Integrated Water Resources Management (IWRM) approach for policymakers at both local and national levels, improving water management approaches and disseminating data on lessons learned. This thesis evaluates the success of the BWGC initiative by analyzing Buenos Aires and S\xe3o Paulo as case studies. Although Congress intended to protect women in Indian Country from domestic abuse, they condoned the use of prior “uncounseled” tribal court convictions to charge and convict an Indian as a federal habitual domestic violence offender.
Justice Ruth Bader Ginsburg, who wrote Bryant, denigrates Indian people’s civil rights, citing the need to protect Native women from domestic violence. But Department of Justice statistics show most domestic violence perpetrators in Indian country are non-Indians, and the Bryant decision leaves intact their constitutional rights, including the right to appointed counsel.

This dissertation argues a dominant transgender narrative manifested through a focus on transgender bodies and prioritizing access to medical procedures when personal stories began to be publicly shared. With limited public conversations about the influence of a dominant transgender narrative, public understandings about the community have become isolated to one facet of some peoples lived experiences. Focusing on the Transgender Resource Center of New Mexico, I examine the ways in which white privilege and presumptions about rural life as in certain respects antithetical to a transgender community have shaped the predominant representation of transgender in ways that often obscure the …

Although the recent legalization of same-sex marriage in the U.S. is heartening for lesbians and gays, the resulting discriminatory legislative backlash against the LGBT population shows that this community continues to be marginalized and at risk. Over two hundred anti-LGBT bills have been introduced in state legislatures since January 2016. North Carolina recently passed anti-LGBT legislation that eliminated and prohibits LGBT anti-discrimination protections, and bars transgender individuals from using gender congruent public bathrooms. One result of recent and historical discrimination is LGBT individual's newfound and pre-existing fears of encountering anti-LGBT bias when seeking legal services, even as recent developments have …
