To ensure that the Thirteenth Amendment has modern application in a manner consistent with these important constitutional considerations and these cases, the Amendment should no longer be interpreted to prohibit the “badges and incidents” of slavery, a non-textual category of harms that is virtually limitless in scope and is therefore virtually limitless as a source of congressional action. Instead, drawing from the Amendment’s textual prohibitions against “slavery” and “involuntary servitude,” direct or functional limitations on physical mobility should be the touchstone for the enforcement power moving forward. To justify this proposal, this Article summarizes the Supreme Court’s Thirteenth Amendment jurisprudence, …

The Differential Contribution Of Behavior And Biology To Breslow Thickness And Melanoma Survival In Males Compared To Females, Jenna Marie Lilyquist Jul 2015

The Differential Contribution Of Behavior And Biology To Breslow Thickness And Melanoma Survival In Males Compared To Females, Jenna Marie Lilyquist

Biomedical Sciences ETDs

There are many well-documented differences between males and females regarding melanoma including incidence rates, presentation, markers of progression, and survival. A common hypothesis to explain the female survival advantage is that males are less aware of their skin, resulting in thicker lesions at diagnosis, and ultimately poorer survival. However, there are also multiple hypotheses attributing the female survival advantage to biological differences between males and females, mostly regarding sex-steroid hormones. Sex has been identified as an independent prognostic marker in multiple studies, supporting the hypothesis that melanoma progression varies between men and women. Despite these findings, stratifying by sex in …

Defining And Assessing Problem Solving Across A Biochemistry Curriculum, Cheryl A. Sensibaugh Jul 2015

Defining And Assessing Problem Solving Across A Biochemistry Curriculum, Cheryl A. Sensibaugh

Biomedical Sciences ETDs

Undergraduate discipline-based education research has shown that scientific problem solving involves five domains, spanning the steps of the scientific method as well as metacognition: Hypothesize, Investigate, Evaluate, Integrate, and Reflect. Student performance in each domain is measured with the Individual Problem Solving Assessment (IPSA). Others developed the Critical thinking Assessment Test (CAT) to measure critical thinking, with the view that problem solving is a component of critical thinking. A third group took the perspective that student attitudes about learning science will influence performance, and developed the Colorado Learning Attitudes about Science Survey for Biology (CLASS-Bio) to detect student attitudes. This …

Association Between Left Ventricular Ejection Fraction (Lvef) In Patients With Regional Ischemia And Infarction On Myocardial Perfusion Images, Alireza B. Esfahane

Biomedical Sciences ETDs

OBJECTIVES: We used gated single-photon emission computed tomography Technetium (99mTc) tetrofosmin (SPECT Myoview), myocardial perfusion imaging (MPI) to (i) determine whether the location of myocardial infarction and Ischemia affect left ventricular function, and (ii) associated changes between post-stress (SEF) and rest ejection fraction (REF) with segmental perfusion abnormalities. METHODS: Five hundred ninety-eight patients underwent a rest- stress or stress—rest gated SPECT Myoview. A Quantitative Gated SPECT (QGS) software program was used to calculate the left ventricular ejection fraction at rest and stress. The left ventricle was divided into thirteen segments. The perfusion abnormalities on each segment were visually assessed. The …

Ecotone Conditions Along Pinon-Juniper And Ponderosa Pine Elevational Ranges, Jemez Mountains, Nm, Christopher Lawrence Sanderson Jul 2015

Ecotone Conditions Along Pinon-Juniper And Ponderosa Pine Elevational Ranges, Jemez Mountains, Nm, Christopher Lawrence Sanderson

Architecture and Planning ETDs

While climate variability is endemic to Southwest North America (SWNA), mounting evidence indicates the region is undergoing significant warming and becoming increasingly arid. Species are at or near their physiological limits at ecotone boundaries and are therefore particularly sensitive to climate change. Drought and warming associated tree mortality has been particularly acute in the semiarid forests and woodlands of the Jemez Mountains, New Mexico, USA, where ponderosa pine forests (Pinus ponderosa var. scopulorum) and piñon--juniper woodlands (Pinus edulis and Juniperus monosperma) have been subject to cambium-feeding pine beetle (Dendroctonus spp., Ips spp) attacks and increased wildfire activity and severity. Grazing …

Into The Tropics: A Quantitative Study Of Mammals In The Great American Biotic Interchange, Winifred S. B. Whiteman-Jennings

Biology ETDs

For almost 100 million years, North and South America were isolated from each other. This long period of geologic separation led to the evolution of strikingly different mammalian faunas: marsupials were prevalent in South America, while ecosystems in North America were composed of placental mammals. Roughly 3 Mya, a land bridge formed between the two continents leading to an accelerated exchange of mammalian fauna. The Great American Biotic Interchange (or GABI, as this has come to be called,) led to the successful colonization of many North American species, but few South American species. The highly asymmetrical nature of the faunal …

Reciprocal Negative Disclosures: An Application Of Expectancy Violations Theory, China Billotte Verhoff Jul 2015

Reciprocal Negative Disclosures: An Application Of Expectancy Violations Theory, China Billotte Verhoff

Communication ETDs

Social support can dramatically improve an individuals ability to confront and negotiate stressful life changes, and self-disclosure is one means through which individuals can create and maintain interpersonal relationships that can result in that much-needed social support (Cohen, Mermelstein, Kamarck, & Hoberman, 1985; Cohen & Wills, 1985; Cobb, 1976). However, during communication the relationship between the people interacting can influence what disclosures adhere to the communicators' expectations and what types of disclosures violate those expectations. Experiencing a communication expectation violation can impact (negatively or positively) individuals' perception of both their peer and the interaction itself (Burgoon, 1978). This study utilized …

Language Barriers Impact Prehospital Care, Ramsey Tate Jul 2015

Language Barriers Impact Prehospital Care, Ramsey Tate

Biomedical Sciences ETDs

Emergency medical services (EMS) rely on accurate and efficient communication. The impact of language discordance between EMS providers and their patients on EMS decision-making has not been well-studied, nor have the strategies that EMS providers use to overcome language barriers. This thesis presents a body of scholarly work investigating the prior research on language barriers in the prehospital setting, the application of mixed methods to prehospital research, and the results of an international, multi-site, mixed methods study of the impact of language barriers on prehospital care. EMS providers struggle with a lack of language assistance resources that are appropriate for …

Inhibition Of Virulence As Treatment Strategies For Staphylococcus Aureus Infection, Seth Michael Daly Jul 2015

Inhibition Of Virulence As Treatment Strategies For Staphylococcus Aureus Infection, Seth Michael Daly

Biomedical Sciences ETDs

Staphylococcus aureus is a global health threat due to its ability to cause significant morbidity and mortality and the exceptional capacity to acquire antibiotic resistance. One method to combat antibiotic resistance, proposed by the NIAID, is anti-virulence strategies focused on bacterial disarmament. S. aureus regulates over 200 virulence factors with the accessory gene regulator (agr) operon, which encodes a quorum sensing (QS) system, and many of the agr-regulated virulence factors are required for invasive infection. Therefore, we hypothesized that bacterial disarmament through the inhibition of agr quorum sensing will both complement immune function and mitigate the severity of S. aureus …

Characterization Of R-Ketorolac As A Single Enantiomer Selective Inhibitor Of Cdc42 And Rac1 In Ovarian Cancer, Shelby Ray Kenney Jr. Jul 2015

Characterization Of R-Ketorolac As A Single Enantiomer Selective Inhibitor Of Cdc42 And Rac1 In Ovarian Cancer, Shelby Ray Kenney Jr.

Biomedical Sciences ETDs

Ovarian cancer is the 5th leading cause of cancer death for women in the United States and is frequently diagnosed at an advanced stage with multiple metastases. Rho family GTPases contribute to metastasis through regulation of the actin cytoskeleton, cell motility, cell-cell and cell-extracellular matrix adhesion and these GTPases are altered in a number of human cancers. High throughput screening and in silico modeling identified the R-enantiomer, but not S-enantiomer, of the non-steroidal anti-inflammatory drug ketorolac as a novel inhibitor of Rac1 and Cdc42. Ketorolac is administered as a racemic mix of both enantiomers and is used clinically for surgical …

Jump In Before It's Too Late: Protecting And Increasing Streamflows In New Mexico, Sharon Wirth Jul 2015

Jump In Before It's Too Late: Protecting And Increasing Streamflows In New Mexico, Sharon Wirth

Natural Resources Journal

Freshwater ecosystems need adequate streamflow to supply clean water for humans and maintain healthy habitat for wildlife. Overappropriation, overuse, climate change, and drought plague New Mexico’s rivers, taxing many rivers beyond sustainability. Despite the myriad of problems caused by little or no water in our rivers, policies and procedures to protect and increase streamflows in New Mexico are limited. While most Western states have made demonstrable progress in alleviating various legal and technical barriers to protecting and increasing streamflows, New Mexico has made only limited, recent progress towards solutions for our drying rivers. This article takes a critical look at …

Water, Agriculture, And Drought In The West Under Changing Climate And Policy Regimes, George B. Frisvold Jul 2015

Water, Agriculture, And Drought In The West Under Changing Climate And Policy Regimes, George B. Frisvold

Natural Resources Journal

Agriculture is the largest water user in the West, and it will play a central role in balancing water supplies with competing water demands in light of climate change. Water resources that are already over allocated face competing demands from growing urban populations, unresolved tribal water claims, and for maintenance of riparian habitats. While many believe we can meet these demands by reallocating water from agriculture, climate change complicates this calculus. Warmer temperatures and longer droughts will reduce regional water supplies and increase agricultural water demands, making transfers more costly. Hydrological-economic modeling studies suggest agricultural water use will decline, leaving …

Ungoverned Masculinities: Gendered Discourses Of Neoliberalism In The Sopranos And Breaking Bad, Christopher Barnes Jul 2015

Ungoverned Masculinities: Gendered Discourses Of Neoliberalism In The Sopranos And Breaking Bad, Christopher Barnes

Communication ETDs

This thesis examines the discursive intersections of neoliberalism and masculinity on The Sopranos and Breaking Bad through a critical discourse analysis in order to illuminate larger sociocultural issues concerning contemporary masculinity. The Sopranos and Breaking Bad are praised in contemporary discourse as 'artistic achievements,' and the following project interrogates particular moments in both texts that construct gendered discourses of neoliberalism, relying on the theoretical foundations of hegemonic masculinity. Through my analysis, I establish key moments when discourses about masculinity intersected with and connected to discourses about neoliberalism. Additionally, this project analyzes moral dimensions of neoliberalism within sociocultural discourse centering on …

Connecting Schools And Communities: A Spatial Approach To Social Capital And Student Performance In The Albuquerque Public School District, Steven T. Bishop Jul 2015

Connecting Schools And Communities: A Spatial Approach To Social Capital And Student Performance In The Albuquerque Public School District, Steven T. Bishop

Architecture and Planning ETDs

Locating services and accesses to opportunities is a growing trend in community schools. Having on-site health services, employment programs, after-school programs, and other social services for students, parents, and members in a community surrounding a school, strengthens the relationships between schools and the communities they serve. These relationships foster increased stocks of social capital in a community and with parents, and the link between parental and community social capital and student performance is strong. In order to make the most of limited resources, schools and school districts implementing community school models must identify which services and accesses to opportunities help …

Schistosomes Of Nepal, Ramesh Devkota Jul 2015

Schistosomes Of Nepal, Ramesh Devkota

Biology ETDs

Globally, digenetic trematodes called schistosomes (Family Schistosomatidae) have enormous public and veterinary health significance because they cause debilitating and chronic infections collectively called schistosomiasis. Schistosomes have a life cycle featuring a bird or mammal definitive host in which adult worms are found, and freshwater snail intermediate hosts in which larval stages are found and free-swimming cercariae are produced which infect the definitive host. Although schistosomes are known to be common in tropical and subtropical Asia, their presence in Nepal, a small south Asian country situated between India and China, was almost completely unknown at the beginning of this study. Consequently, …

Conservation Genetics At The Interface Of Theory And Application, Tyler Jess Pilger Jul 2015

Conservation Genetics At The Interface Of Theory And Application, Tyler Jess Pilger

Biology ETDs

Understanding the ecological mechanisms responsible for patterns of spatial genetic structure and diversity is a central issue to evolutionary ecology and biodiversity conservation. The Anthropocene has seen a mass extinction only previously observed through geological records, and freshwater fishes of North America have not been spared owing to large-scale modification of freshwater habitats and introduction of nonnative species. Concomitant with reduced numbers of species is a rapid reduction in genetic diversity within species; this diversity that is required for species to adapt to rapidly changing environments of human dominated landscapes. However, understanding why species exhibit different patterns of spatial genetic …

A Question Of Excluding Immigration Status In Civil Court: Why Torres Got It Right, Nicholas T. Davis, F. Michael Hart Jul 2015

A Question Of Excluding Immigration Status In Civil Court: Why Torres Got It Right, Nicholas T. Davis, F. Michael Hart

New Mexico Law Review

This Article addresses the issue of New Mexico’s treatment of immigration status in four parts. Part I explores the history of New Mexico. From its earliest days New Mexico demonstrated an acceptance of immigrants into society. Many New Mexico laws grant rights to residents of the state regardless of immigration status, and as a result, undocumented immigrants have become large contributors to the state’s economy. Part II discusses New Mexico’s approach to issues involving a party’s immigration status. Although New Mexico has not explicitly prohibited the introduction of a party’s immigration status, case law suggests New Mexico courts would deny …
