LatCrit theory is a relatively recent genre of critical “outsider jurisprudence” – a category of contemporary scholarship including critical legal studies, feminist legal theory, critical race theory, critical race feminism, Asian American legal scholarship and queer theory. This paper overviews LatCrit’s foundational propositions, key contributions, and ongoing efforts to cultivate new generations of ethical advocates who can systemically analyze the sociolegal conditions that engender injustice and intervene strategically to help create enduring sociolegal, and cultural, change. The paper organizes this conversation highlighting Latcrit’s theory, community and praxis.

The Rise Of Force Majeure Amid Coronavirus Pandemic: Legitimacy And Implications For Energy Laws And Contracts, Cosmos Nike Nwedu
The Rise Of Force Majeure Amid Coronavirus Pandemic: Legitimacy And Implications For Energy Laws And Contracts, Cosmos Nike Nwedu
Natural Resources Journal
The global outbreak of coronavirus disease has become one of humanity’s current greatest challenges and may arguably surpass climate change in the short-term. The virus’s rapid dispersion through the transportation sector, its disruption to human health and global economies, has been remarkable. The energy sector has also been impacted, as it has seen episodic low prices of oil, particularly in April 2020. This scenario is due to less demand for oil amid various containment measures and related health policies of governments worldwide. The performance of existing oil and gas contracts, especially time-bound supply contracts, has been rendered impracticable in some …

Neural Network Based Occupancy Prediction Using Patterns Detected In Wifi Occupancy, Krishna Chaitanya Jagadeesh Simma, Thomas P. Caudell, Susan M. Bogus

The role of occupants in building energy management is well established. Occupant information from commercial buildings can function as a metric for the heating, ventilation, and air conditioning (HVAC) loads. Predicting these loads ahead in time could aid in setting up HVAC protocols to minimize wasteful energy demand and improve occupant comfort. To this extent, several frameworks were proposed that use occupancy data collected from commercial office buildings and graduate student offices to predict occupancy. However, the occupancy data collected in these frameworks are controlled and have limited complexity compared to larger commercial spaces such as airports, libraries, lecture halls, …
More Than Idle Talk: Examining The Effects Of Positive And Negative Team Gossip, Trevor Spoelma, Andrea Hetrick
More Than Idle Talk: Examining The Effects Of Positive And Negative Team Gossip, Trevor Spoelma, Andrea Hetrick
Faculty and Staff Publications
Gossip is a behavior that has been traditionally viewed as harmful in organizations. However, a more balanced perspective has emerged in recent years that suggests gossip can have important benefits. We propose that one way to uncover potential benefits of gossip in teams is to focus on the valence (positive or negative nature) of the gossip. Drawing on expectancy theory, we propose team gossip indirectly influences team performance through social loafing because it plays a key role in shaping beliefs about effort in team contexts; effects determined by team gossip valence. We hypothesize that positive team gossip decreases social loafing, …

This Article evaluates the strategy of claiming personhood for natural objects as a way to advance environmental goals in the United States. Using the Colorado River Ecosystem v. Colorado litigation as the focus, we explore the normative foundation of the claim—elements of nature are legal persons—and the work personhood is being asked to do by the plaintiff and other environmental activists. We identify three possibilities: procedural work, substantive work, and rhetorical work. Of those, we suggest the plaintiff’s strongest case is rhetorical. We say this not only because it will likely be difficult to convince a judge to extend standing …
Bad Apples Or A Rotten Tree: Ameliorating The Double Pandemic Of Covid-19 And Racial Economic Inequality, Nathalie Martin
Bad Apples Or A Rotten Tree: Ameliorating The Double Pandemic Of Covid-19 And Racial Economic Inequality, Nathalie Martin

Black Lives Matter signs pepper our rural, middle class neighborhood. The lawn signs raise a fundamental question: if Black Lives Matter, what will it take to reverse the longstanding trend that has left many dead and so many others, perhaps all others, suffering? What will it take to create some semblance of equality and equity across racial lines in America?
Part I of this essay discusses race and Covid 19. It reviews and updates statistics on Covid deaths and race, and discusses some of the reasons for the racial disparities in Covid deaths. Part II briefly reviews the stratification of …
Racial Triangulation, Interest-Convergence, And The Double-Consciousness Of Asian Americans, Vinay Harpalani
Racial Triangulation, Interest-Convergence, And The Double-Consciousness Of Asian Americans, Vinay Harpalani
Faculty Scholarship
This Essay integrates Professor Claire Jean Kim’s racial triangulation framework, Professor Derrick Bell’s interest-convergence theory, and W.E.B. Du Bois’s notion of double-consciousness, all to examine the racial positioning of Asian Americans and the dilemmas we face as a result. To do so, this Essay considers the history of Asian immigration to the United States, the model minority and perpetual foreigner stereotypes, Asian Americans’ positioning in the affirmative action debate, COVID-19-related hate and bias incidents, and Andrew Yang’s 2020 Democratic presidential candidacy. The Essay examines how racial stereotypes of Asian Americans have emerged through historical cycles of valorization and ostracism, as …

Brain & Behavioral Health Research Day
Chronic pain is a serious and debilitating condition that affects one in five people around the world. In order to address this public health problem, we performed studies to elucidate the role of Cav3.3 T-type voltage-gated calcium channels in the FRICT-ION model of trigeminal (TG) neuropathic pain. Western blot and immunohistochemical analyses of TG revealed protein upregulation of Cav3.3 compared to controls. Intraperitoneal injection of a highly selective TAT-based Cav3.3 blocking peptide (TAT-C3P) in FRICT-ION mice elicited a significant reduction of allodynia that correlated with a reduction of TG Cav3.3. These data suggest that a blockade of Cav3.3 may be …

Brain & Behavioral Health Research Day
A multi-faceted training program to help volunteer support group leaders learn leadership and facilitation skills, and provide them with supportive resources.
Many people impacted by PD rely heavily on support groups and peers for support, socialization, tips and assistance. Most support groups are led by people with movement disorders or their care partners. They dedicate their time and energy over multiple years as volunteer leaders. Yet while they support so many others, they seldom receive the support they need. With limited understanding of how to start, grow and sustain a group, the leaders are often untrained and isolated. To address …

Accuracy Of Spanish Translation Of Alcohol Screening Questionnaires For Use In Brain And Behavioral Health Research, D E. Rodriguez, L Enriquez, L Stacy, R Rai, L N. Bakhireva, J Lowe
Brain & Behavioral Health Research Day
Purpose: Spanish speakers represented 13% of the U.S. population in 2015. Alcohol use in pregnancy, including Spanish-speakers, affects 1 in 10 U.S. women. The rising population of U.S. Spanish-speakers necessitates availability of Spanish-language tools to consistently measure alcohol consumption. This study compares existing Spanish translations of alcohol questionnaires to English questionnaire items and examines dialectal differences.
Methods & Data: Spanish-translations of common alcohol screening questionnaires, including AUDIT (1 translation, validated), CAGE (4 total, 2 validated), and TWEAK (1, unvalidated) were compiled from peer-reviewed articles, government-agencies and universities. Each item was back-translated to English separately (by two bi-lingual English/Spanish speakers with …

Brain & Behavioral Health Research Day
Schizophrenia (SCZ) and Bipolar disorder (BD) are heterogeneous psychiatric disorders that together affect more than 3.5% of the US population. Studies using animal, pharmacological models
and post-mortem data, have revealed abnormalities in the dopaminergic and glutamatergic pathways, however, the pathogenesis remains vague. Non-coding RNAs (ncRNAs) have been shown to play a role in regulating gene expression at the transcriptional and post-transcriptional level and having implications on brain development and psychiatric diseases. Circular RNAs are a category of ncRNAs, formed after back-splicing of exons/introns, covalently linked, enriched in the mammalian brain and derived from genes that are implicated in synaptic plasticity. …

Brain & Behavioral Health Research Day
Our prior work demonstrates that adult prenatal alcohol exposed (PAE) rats with minimal nerve injury develop allodynia (pathological light touch sensitivity) in concert with aberrant peripheral-spinal glial and immune activation. Nerve-injured PAE rats display heightened proinflammatory cytokine production (IL-1β, TNF-α, CCL2) typically produced following activation of innate immune receptors, TLR4 and Nod-like receptor family pyrin domain containing 3 (NLRP3) inflammasomes. This suggests that PAE-related adaptations prime peripheral macrophages and central nervous system (CNS) glia to over-respond to subtle challenges through exaggerated TLR4 and NLRP3 inflammasome reactivity. Interestingly, morphine, a standard opioid pain therapeutic, binds the μ-opioid receptor and also glial …

Survivors of brain injuries such as stroke and trauma often endure life-long disabilities, which span a spectrum of deficits and are associated with enormous individual and societal costs. There is an urgent need to develop effective interventions that can improve cognitive and motor outcomes, especially individualized approaches that target specific disruptions of brain physiology or circuits. The Center for Brain Recovery and Repair (CBRR) is a Center of Biomedical Research Excellence (NIH/NIGMS P20 GM109089; PI: Shuttleworth) established as an interdisciplinary community of clinical and preclinical investigators to address these issues. The Clinical Core is an ideally-situated brain injury research hub, …

Brain & Behavioral Health Research Day
Prenatal alcohol exposure (PAE) results in deficiencies of the central nervous system (CNS) and an overactive proinflammatory neuroimmune response. This response is mediated by cytokines secreted from infiltrating peripheral immune cells like T cells that secrete interferon-g (IFNg). Interleukin-10 is a potent anti-inflammatory cytokine that inhibits the production of a variety of proinflammatory cytokines. While IFN is secreted from and further activates T cells, it is also secreted from activated macrophage in response to tissue injury and inflammation and further enhances inflammatory processes. Neuropathic pain results from damage to peripheral nerves and can be experienced as an increased sensitivity to …

A Standardized Protocol For The Comprehensive Assessment Of Dental Hygiene Work, Shawn C Roll, Mark E Hardison, Jane L Forrest, Nikki L Colclazier, Joyce Y Sumi, Nancy A Baker
Pediatrics Research and Scholarship
BACKGROUND: Work-related musculoskeletal disorders are prevalent in dental hygienists. Although engineering controls and ergonomic training is available, it is unclear why this intransigent problem continues. One possible barrier is that a comprehensive, standardized protocol for evaluating dental hygiene work does not exist.
OBJECTIVE: This study aimed to generate a valid and reliable observational protocol for the assessment of dental hygiene work.
METHODS: An iterative process was used to establish and refine an ecologically valid video acquisition and observation protocol to assess key activities, tasks, and performance components of dental hygiene work.
RESULTS: Good inter-rater reliability was achieved across all variables …

BACKGROUND: Evidence-informed practices (EIPs) are imperative to increase school safety for lesbian, gay, bisexual, transgender, and queer or questioning (LGBTQ) students and their peers. Recently, the Expert Recommendations for Implementing Change (ERIC), a taxonomy of discrete implementation strategies used in health care settings, was adapted for schools. The School Implementation Strategies, Translating the ERIC Resources (SISTER) resulted in 75 discrete implementation strategies. In this article, we examine which SISTER strategies were used to implement six EIPs to reduce suicidality among LGBTQ high school students. We applied the dynamic adaptation process (DAP), a phased, data-driven implementation planning process, that accounts for …

Santa Clara Pueblo V. Martinez In The Evolution Of Federal Law, Richard B. Collins
Tribal Law Journal
Few Indian law decisions have evoked as much scholarly attention as Santa Clara Pueblo.1 Shepard's pulls up over 1000 law review references, and Google reports almost 3,000,000 hits.2 It is a major case in all Indian law treatises and casebooks and is important in several other books.3 Most analyze the decision as an event and focus on its principal holding, denying a federal cause of action for civil enforcement of the Indian Civil Rights Act.4 Policy discussions parse tribal sovereignty and discrimination against women.

Tribal Law Journal 20th Anniversary Symposium Keynote Address. I am working to weave our Native voice into a system that is not traditionally our own to make sure these legal fictions do not persist into another detrimental federal policy era. This symposium is highly valuable because it shows our community how important it is to incorporate indigenous traditional values into our legal system—but this is also important to highlight in our political systems and my effort to encourage more Native Americans to run for office and will continue. Native American people need to redefine all aspects of our governance systems …
