There has been a recent increase in the use of expert witness testimony relating to speeds of vehicles involved in collisions. This has resulted in a need for jurists and lawyers to become increasingly informed of the fundamental physical laws which form the basis of this testimony. The purpose in writing this paper is to discuss in a legal context the most commonly used physical laws in order to clarify an area which has become clouded by the use of incomplete data and erroneous hypotheses. The question whether an employee is precluded from bringing a workmen's compensation action in one state because he has previously received payments under another state's statute arises where an injury or an employment relationship has ties with two or more states. This is a common problem because of existing differences in the various state compensation acts, and it is intensified because of increasing multistate business activities. The problem most frequently presented to the courts is whether the forum state will award second payments under its act when it authorizes a greater amount of compensation than the first state. Workmen’S Compensation—Disfigurement Awards Under The Nebraska Statutes—Wengler V. Grosshans Lumber Co. (Neb. 1962), William D. Kuester

Nebraska has no statute specifically covering the problem of disfigurement awards. Forty other jurisdictions have statutes mentioning and providing for disfigurement, either generally or specifically, in many instances fixing maximums on awards that may be given. Some of these statutes are premised on the theory that disfigurement impairs the earning capacity of the injured workman and should, to that extent, be compensable, while others make the term "disfigurement" a "catch-all" for all injuries not specifically covered by the schedules. A Middle Miocene Rhinoceros Quarry In Morrill County, Nebraska (With Notes On Hip Disease In Diceratherium), Robert M. Stecher, C. Bertrand Schultz, Lloyd G. Tanner

Bulletin of the University of Nebraska State Museum (1924–2023)

Extensive deposits of fossil rhinoceros bones have been excavated from University of Nebraska State Museum collecting localities Mo-113, -114, -115, -116, and -118 some 8 1/2 to 9 1/2 miles north of Bridgeport, Morrill County, Nebraska. The fossils were associated with other faunal elements in the lower portion of the Marsland formation (middle Miocene) of the Hemingford group. The rhinoceros is considered to be Diceratherium niobrarensis Peterson, geologic variety. A pathologic right femur of D. niobrarensis provides evidence of hip disease in the medial Miocene rhinoceroses.

Ten species of Recent mammals that formerly occurred in Nebraska have been extirpated there by European man. Surprisingly few specimens of the species concerned are preserved in museum collections. Perusal of a representative segment of the historical literature pertaining to Nebraska has revealed records of occurrence of most of the extirpated species that provide a basis for estimating the former distribution of each in the State.

There is some concern that methods of sire evaluation which utilize contemporary stablemate averages can be biased by differential genetic merit of the mates of these sires. A little reflection, however, indicates that even if the cows to which some sires are mated are more highly selected than the mates of other sires, this differential merit will not affect seriously the ranking of sires according to the evaluation of their progeny. Until the present, data have not been readily available with which to study the seriousness of this problem. The present study does not deal with the question generally, but …

Sire Evaluation From Five-Month Daughter Records, L. Dale Van Vleck

The chief advantages of sire evaluation based on five-month daughter records are: 1. Genetic progress is inversely proportional to the turnover rate in testing bulls so that if this interval is shortened by 10%, the rate of genetic progress will be increased by 11%. The turnover period can be shortened with the use of 5-month records from about 50 months to 45 months—a decrease of 10% in time. 2. Genetic progress is also related to how many top bulls are saved and how many poor ones are culled out of all those sampled. In other words, the more bulls tested …

Bacteriol. 83:1341-1346. 1962.-No malic dehydrogenase activity was found to occur at 101 C at various hydrostatic pressures from 1 to 700 atm. However, activity was demonstrated with hydrostatic pressures above 700 atm, with optimal activity at 1,300 atm at the same temperature. Explanation of the data is based upon thermal denaturation of the enzyme, which involves a molecular volume increase of the enzyme. His technique is to disguise revenge as justice: by cloaking personal retribution in the garment of objective moral comment, he is able to pretend that he is concerned not so much with retaliation as with evil itself.
