Effect Of Levels Of Meat And Bone Scraps On Growth Rate And Feed Efficiency Of Growing-Finishing Swine, E. R. Peo, Jr., D. B. Hudman
Department of Animal Science: Faculty Publications
Many investigations have shown that soybean meal when properly supplemented can replace meat and bone scraps as a major source of protein in swine rations (Lepley et al., 1950; Terrill et al., 1954; Rohlf, 1954; Meade and Hanson, 1957; Meade et al., 1958; Becker et al., 1960). The importance of this finding is emphasized by the work of Bloss et al. (1953), Terrill et al. (1954), Meade and Teter (1957) and Becker and Jensen (1961) who reported a significant depression in growth rate and feed efficiency of swine fed rations containing relatively high levels …

Parameters For Milk Yield And For Percents Of Ash, Dry Matter, Fat And Protein In Sows, W. G. Pond, L. Dale Van Vleck, D. A. Hartman
Department of Animal Science: Faculty Publications
Milk was collected separately by machine from four to six glands on nine Yorkshire and Berkshire sows 2 or 3 days after farrowing and at weekly intervals throughout 6 weeks of lactation. Milk yield was measured following intramuscular injection of oxytocin, and the percent of ash, dry matter, fat and protein in the milk from each gland was determined. The average milk yield per gland, following a 1-hour period during which the pigs had been removed from the sow reached a peak of 74.6 gm. 3 weeks after farrowing. The ash content was 0.79% 2 or 3 days after farrowing, …

The Fourth Amendment And Evidence Obtained By A Government Agent's Trespass, Charles H. Rogers
The Fourth Amendment And Evidence Obtained By A Government Agent's Trespass, Charles H. Rogers
Nebraska Law Review
The fourth amendment to the United States Constitution states that "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated." The United States Supreme Court has held that in order to protect this right, evidence obtained by an unreasonable search and seizure conducted by agents of any governmental body in the United States may be suppressed in any criminal proceeding by a defendant whose rights were invaded by the search. In each case the crucial issue becomes one of defining and determining what constitutes an unreasonable …
Physicians—Applying The Statute Of Limitations In Malpractice Cases—Spath V. Morrow (Neb. 1962), Richard D. Nelson
Physicians—Applying The Statute Of Limitations In Malpractice Cases—Spath V. Morrow (Neb. 1962), Richard D. Nelson
Nebraska Law Review
Many questions are left unanswered by the adoption of the discovery rule in Nebraska, but it is clear that the court intends to enlarge the opportunities for plaintiffs to obtain relief in malpractice cases. Whether the court intends to have the discovery rule supersede the end of treatment rule, or whether it intends to have them exist concurrently, will be clarified in later decisions. The concern shown by the court for the fair treatment of the injured patient makes it probable that the court will abandon any restriction of the discovery rule and apply it to all malpractice claims.

With the discovery of oil and gas rapidly increasing in Nebraska, attorneys are finding themselves deluged with inquiries about oil and gas leases, wellspacing requirements, implied and express covenants, and royalties. And because the oil and gas industry is still in its infancy in this state and our case law negligible, many members of the Bar feel ill equipped to cope with these inquiries. In response to the many requests made to help alleviate this problem, this issue of the Nebraska Law Review contains three articles which should provide an excellent starting point in the research of oil and gas …
Practice And Procedure In Administration Of The Nebraska Oil And Gas Conservation Act, Lowell C. Davis
Practice And Procedure In Administration Of The Nebraska Oil And Gas Conservation Act, Lowell C. Davis
Nebraska Law Review
The Nebraska Oil and Gas Conservation Act was enacted by the legislature and approved by the governor of Nebraska on April 27, 1959. The act became effective September 28, 1959. Rules were adopted by the commission, after public hearing, which became effective October 17, 1959. During the first two years of its administration the commission heard and issued orders upon eighty-five applications and in addition issued numerous administrative orders. A large majority of the cases heard involved applications for approval of unit operations and secondary recovery projects and exceptions from established wellspacing patterns. Observation has demonstrated that a very definite …
The Rule Against Perpetuities As It Relates To Powers Of Appointment, Lawrence Berger
The Rule Against Perpetuities As It Relates To Powers Of Appointment, Lawrence Berger
Nebraska Law Review
Over the past twenty-five years, much has been written about the raison d'etre of the Rule Against Perpetuities. During this period, the theories underlying and the justifications posited for the Rule have changed considerably, while some of the older notions concerning it have been partially discredited. The purpose of this article is to utilize some of these newly arrived at basics and apply them specifically to the problem of the Rule as it relates to powers of appointment. In the course of the discussion, a cursory review of the history of the Rule and its policy progenitors is undertaken for …

Klm V. Tuller: A New Approach To Admissibility Of Prior Statements Of A Witness, David Dow
Klm V. Tuller: A New Approach To Admissibility Of Prior Statements Of A Witness, David Dow
Nebraska Law Review
Within the past few years, a number of important cases have been decided by federal courts involving difficult points of evidence law, suggesting a trend toward liberality in admission of evidence. On the face of the opinions many of these decisions are influenced by the clear direction of the Federal Rules of Procedure, both civil and criminal. Some are also obviously influenced by the discussion and study engendered by the Model Code of Evidence and the Uniform Rules of Evidence. These decisions show a strong desire to reexamine the old rules of exclusion. Courts today are consistently faced with the …

Usury—Applying State Usury Penalty To A National Bank When It Is The Assignee Of A Conditional Sales Contract—Robertson V. Burnett, Hills V. Burnett (Neb. 1961), Fredric H. Kauffman
Nebraska Law Review
Companion cases, decided in June 1961 by the Nebraska Supreme Court, were essentially similar with respect to their factual situations. In each, a buyer and a seller contracted for the sale of a house trailer, the transaction consisting of the signing of a promissory note by the buyer in accordance with a conditional sales contract, and a subsequent assignment of the note, by the seller, to a national bank located in Michigan. The certificate of title, which was in the name of the buyer, noted a lien by the national bank, and was at all times in the possession of …

Administrative Law Reform: Proposals And Prospects, Peter Woll
Nebraska Law Review
The purpose of this article is to analyze current administrative practice in the adjudicative area in relation to various proposals that have been made for procedural reform. It is necessary, first, to review briefly the nature of administrative law. Second, early attempts made both by the American Bar Association and the judiciary to control administrative procedure are noted. Third, present proposals for reform, which come from a variety of sources, are analyzed. Finally, some assessment of the requirements of administrative adjudication from the standpoint of effective and fair government regulation is necessary to indicate possible directions in which the legal …

The Liouville Theorem For A Quasi-Linear Elliptic Partial Differential Equation, Elwood Bohn, Lloyd K. Jackson
The Liouville Theorem For A Quasi-Linear Elliptic Partial Differential Equation, Elwood Bohn, Lloyd K. Jackson
Department of Mathematics: Faculty Publications
The classical Liouville Theorem of analytic function theory can be stated in either of two equivalent forms: The Liouville Theorem states: If f(w) is analytic and bounded throughout the finite w-plane, then f(w) is constant. If z(x, y) is a real valued function of the real variables x and y which is a solution of zxx + zyy = 0 and is bounded either above or below throughout the finite plane, then z(x, y) is a constant. Here we are concerned with the question of whether or not the second formulation of the above theorem is valid for …

Floods In Nebraska On Small Drainage Areas Magnitude And Frequency, Emil W. Beckman, Norman E. Hutchison
Floods In Nebraska On Small Drainage Areas Magnitude And Frequency, Emil W. Beckman, Norman E. Hutchison
United States Geological Survey: Publications
Flood hazard information is needed for small streams as well as for large ones. This report explains methods of defining the magnitude and frequency of floods in Nebraska on uncontrolled and unregulated streams which have about 300 square miles or less of drainage area contributing to surface runoff. Composite frequency curves defined for two flood regions express a ratio of floods with recurrence intervals ranging from 1.1 to 25 years to the mean annual flood. Curves for 10 hydrologic areas were defined to show the relation of the mean annual flood to the contributing drainage area. A flood-frequency curve can …

Nebraska's Extension Program In State And Local Public Finance, Everett E. Peterson
Nebraska's Extension Program In State And Local Public Finance, Everett E. Peterson
Department of Agricultural Economics: Faculty Publications
The problems and policy choices in state and local government finance were the main topics discussed in the major public affairs extension program of the University of Nebraska in 1961-62. The program was entitled: "Let's Talk About Nebraska Taxes." This educational activity for the citizens of the state was planned, prepared, and presented by the extension staff in agricultural economics under the leadership of the public affairs specialist. The general purpose of the program was to meet the need and desire for objective information on this important public issue as expressed by farm and nonfarm people throughout the state.
