"The Battle Of The Experts": A New Approach To An Old Problem In Medical Testimony, Larry W. Myers

The testimony of medical experts is essential in establishing the extent of a plaintiff's injuries in personal injury litigation. When conflicting or contradictory medical testimony is presented, a phenomenon arises which often attains such noticeable proportions that it has been dramatically labeled "the battle of the experts." In several jurisdictions, judicial, legal, and medical groups have collaborated to create programs aimed at resolving or minimizing these courtroom conflicts. This study seeks to ascertain whether such a program would promote the administration of justice in Nebraska.

The Criminal Justice Act of 1964 goes a long way toward making the idea that a poor man should not be denied an opportunity to defend himself against a criminal charge because he lacks the means a reality in our federal court system. By its impact on the administration of criminal justice, it is quite possible that the act will become recognized and rank as one of the major legislative achievements in a decade spanning both the New Frontier and the Great Society and crowded with congressional actions. In the spring of 1964 the United States Supreme Court decided a group of cases which raise serious questions concerning the application of the privilege against self-incrimination in the states. Probating the estate of a person who has died in a traffic accident raises the question of whether to give other persons involved in the accident notice of the probate proceedings when it appears that the decedent may have been at fault. One practice is to file the estate for probate quickly, giving notice only by publication and hoping that the potential claimants fail to file by claim day, generally about six months later. Then not only are their claims forever barred but their counterclaims may be barred in a wrongful death suit brought by the executor. Nebraska and other …

The following is another short proof of the fact that for a commutative ring with unit R, any finitely based R-module is "dimensional" in the sense that all of its bases have the same number of elements.
THEOREM. Let R be a commutative ring with unit. If M is a unitary R-module with a basis of n elements, then all bases of M contain exactly n elements.

The relation between chemical, physical and biological indices was examined in 1,640 sandhill lakes during the years of 1954 to 1963. Sandhill lakes are formed by either (1) wind deflation basins and closed drainages or (2) exposed ground water table basins. Topography of the 20,000 square mile sandhill region is primarily stabilized dune sand interspersed with wet meadows and pine - cedar - oak river drainage systems. Two-thirds of the area is dune sandhills and one-third occupied by basins, valleys and lakes.
All of the lakes are comparatively shallow, the deepest lake being Blue Lake with 13.8 feet. The average …

The Variance Of Intraclass Correlation Involving Groups With One Observation, L.A. Swiger, W.R. Harvey, D.E. Everson, K.E. Gregory

An approximate formula is derived for the variance of intraclass correlation when unequal numbers of observations per group occur. The effect on the variance of t of adding groups with single observations is examined using the formula and results obtained by empirically generating data on a computer. The empirical results indicate that the approximate formula is satisfactory over the range of numbers used. Adding a group with fewer than the average number of observations per group tends to reduce Vt by increasing the degrees of freedom for groups by one, but tends to increase Vt by decreasing the average precision …

Life Cycle And Development Of Prosthorhynchus Formosus (Van Cleave, 1918) Travassos, 1926, An Acanthocephalan Parasite Of Birds, Gerald D. Schmidt, O. Wilford Olsen

The life cycle of Prosthorhynchus formosus (Van Cleave, 1918) Travassos, 1926 is presented. The terrestrial isopods Armadillidium vulgare, Porcellio laevis, and P. scaber served as experimental intermediate hosts, and chickens and turkeys as experimental definitive hosts. After ingestion of the eggs by the isopod, the acanthor emerges from its shells within 15 minutes to 2 hours, enters the gut wall of its host, and remains there 15 to 25 days. It then migrates to the hemocoel and develops through the acanthella stage to the infective cystacanth by the 60th to 65th day of infection.

The main question of this study concerns the relationship of creativity and achievement in science and related areas. More specifically, does the ingenious person, as determined by certain measures, excel in high school and college science, mathematics and science-related courses?Does the person with two- and three-dimensional visualization abilities, as determined by certain measures, likewise excel in these areas?Also, do the person with reasoning abilities similarly determined excel in these areas?

The study of a collection of cestodes assigned to the genus Diplogonoporus Lönnberg, 1892 disclosed but two species, D. balaenopterae Lönnberg, 1892, and D. tetrapterus (von Siebold, 1848) (provis.). These cestodes occur characteristically in marine mammals but occasionally are found in terrestrial hosts; D. balaenopterae is recorded for the first time from the domestic dog, and it is concluded that D. grandis (Blanchard, 1894), from man, is conspecific with D. balaenopterae. The latter species is recorded for the first time from the humpback whale, Megaptera novaeangliae (Borowski). The relatively small D. tetrapterus, a common parasite of the Steller …

On morphological and zoogeographical grounds, discussed in the present paper, it is concluded that the narrow-skulled vole in North America, previously designated Microtus (Stenocranius) miurus Osgood, is conspecific with the Eurasian M. (Stenocranius) gregalis Pallas. Fourteen subspecies in Eurasia and 5 in North America are now recognized, but it is probable that the number in Eurasia will be reduced through future investigation. The Eurasian subspecies of this vole comprise two major groups, of which one occupies the tundra zone and the other occurs across central Asia below latitude 60° N; their geographic ranges are largely separate …

Observation Of Autoionization Levels In He By Positive Ion Bombardment, M. Eugene Rudd

Certain highly excited energy levels in helium have been observed optically and by inelastic electron scattering, and have been calculated theoretically. Reported here is the observation of these levels by the measurement of the energy spectrum of electrons emitted after bombardment with protons and hydrogen molecular ions. Some of the states show up clearly by this method which are weak or absent in the other techniques. Berry has previously observed autoionization of helium by this method, but his measurements lacked the resolution necessary to identify the states.

Bacteriol. 88:293-296. 1964.-Divalent ions are essential for proliferation of phage Φμ-4. Small amounts of citrate interfere with efficient adsorption of phage to the host cells. Penetration of phage material into the cell is strictly dependent on divalent ions and is inhibited by low levels of citrate. Inhibition of infection can be partially reversed, in early latent period, by calcium ions. Synthesis of new phage particles is also dependent on divalent ions. Addition of citrate to infected cell suspensions significantly reduced the …

Because the potential of the sweetclover aphid for damaging sweetclover is well documented, yet damage occurs only occasionally under field conditions, it would appear that natural factors which depress midsummer populations are important in preventing greater damage and worthy of detailed study. Thus, this study was begun early in 1959 to investigate the natural factors which generally keep populations of this aphid below levels causing economic damage.
