The State of Nebraska, like most states, has commissioned a remarkably large number of individuals as notaries public. However, few, if any, of them are exclusively notaries; in fact, most are employed by some form of business enterprise. It would appear that the relationship created by the private employment of individuals who are, in one sense, public officials, has escaped both attention and careful analysis. This article discusses three groups of problems inherent in such a relationship. Of primary concern is the general nature and scope of the notary's duty. It appears that Heasty v. United States has eliminated the previous uncertain estate tax consequences of severing jointly owned property. In Heasty the Tenth Circuit has aligned itself with the Seventh and Ninth Circuits and firmly reinforced the refusal of the courts to adopt an estate tax construction of "interest" as taxed by either section 2035 or section 2036 in severed joint ownership situations. Thus, in the absence of an amendment to the federal estate tax statutes, it appears that estate planners may continue with confidence to advise severance of jointly held property.

The Court's decision in Flast v. Cohen is not as broad as it appears upon first reading. The rule of Frothingham v. Mellon is as viable today as it was on June 9, 1968. The Court has merely grafted on to Frothingham a constitutionally possible and needed exception. The basis was provided by the overwhelming importance which our society places on the neutrality of the Government in religious matters. The need arose because of Congress' failure to grant standing to challenge congressional appropriations which, in part, are given to non-secular institutions, and thus may violate the mandate of neutrality between …

Observations On The Reproductive Behavior Of The Black Bullhead (Ictalurus Melas), Charles R. Wallace

Two pairs of black bullheads, Ictalurus melas (Rafinesque), were observed spawning out of season in two 90-gal laboratory aquaria after the females had received injections of finely ground acetone-dried carp pituitaries. These fish had been collected in August 1966 and were maintained in the laboratory through the winter in a 75-gal aquarium at an approximate room temperature of 20°–25° C.

From July 6 to 11, 1966, vertebrates were collected on Volcan de Fuego, Jalisco, for the Museum of Natural History,the University of Kansas, by Hugh H. Genoways and Percy L. Clifton. On July 10, a shrew of the genus Cryptotis was obtained on a steep slope across the valley to the north of the active cone of the volcano. The specimen was caught in a steel trap placed in the tunnel of a pocket gopher; because the opening had not been covered after the trap was set, it could not be determined whether the shrew was using the tunnel as …

Fessisentis Necturorum Sp. N. (Acanthocephala: Fessisentidae), A Parasite Of The Gulf Coast Waterdog, Necturus Beyeri, Brent B. Nickol

Specimens of a previously undescribed species of the genus Fessisentis were taken from the Gulf Coast waterdog, Necturus beyeri beyeri, in southeastern Louisiana. This is the third species of the genus to be described and the first published record of Fessisentis from an amphibian. The new species as a shorter body, smaller proboscis hooks, and a proportionately larger proboscis than F. fessus. The species from Necturus has more longitudinal rows of proboscis hooks each with fewer hooks, relatively smaller male genitalia, and proportionately longer lemnisci than F. vancleavei.

Fluorescence is of diagnostic value for differentiating among species of aerobic pseudomonads (R. Y. Stanier, N. J. Palleroni, and M. Doudoroff, J. Gen. Microbiol. 43:159, 1966). Armand Salacrou is generally recognized to be one of the outstanding French playwrights whose literary careers began between the two World Wars. Salacrou has written about thirty plays. Many of them have been produced at the leading theatrical centers in Europe, and some have earned success and fame for the author on African and Asian stages. Unlike the other distinguished dramatists of his generation such as Giraudoux, Anouilh, Sartre, and Cocteau, Salacrou's name has remained almost unknown to the theater audiences in this country. Excepting the generalized accounts of Over and Churchill (1945), no attempt has been made previously to summarize the distribution of bats in South Dakota. In 1960, 1961, and again in 1965, field parties from the Museum of Natural History of The University of Kansas collected mammals in that state. Bats obtained by these parties, together with those on deposit in other institutions and the few specimens earlier reported from South Dakota by other workers (see cited literature), form the basis of the present report. Indirect evidence is presented to support the conclusion that the army cutworm, Chorizagrotis auxiliaris (Grote), migrates from the Great Plains to the Rocky Mountains during the spring and the same individuals return to the Plains in the fall. Spring activity occurs progressively later from east to west, the delay being greater than that caused by emergence but commensurate with flight potential of the moth. Flight is predominately from east to west and a constant turnover of moths occurs at all locations on the Plains. Seasonal occurrence in the mountains coincides with the period of inactivity on the Plains, during which …

High-Field Magnetoresistance Of Ordered Beta Brass , David J. Sellmyer, J. Ahn, J.-P. Jan

The magnetoresistance of several single-crystal specimens of ordered β-brass has been investigated in fields up to 150 kG. The purity of the samples is sufficiently high (ρ295/ρ4.2≃400) that the high-field condition is satisfied. The results indicate that ordered β-brass is an uncompensated metal and that its Fermi surface is multiply connected. Strong open orbits were observed when the field was in {110} or {100} planes, and this behavior is compatible with the Fermi-surface model predicted by augmented-plane-wave and Green's-function energy-band calculations. Evidence for the existence of higher-order open orbits and two-dimensional regions of open orbits is …

An adult female swift fox (Vulpes velox) was killed by an automobile 1 mile E Ringgold, McPherson Co., Nebraska, on 25 March 1966. Standard external measurements (mm) of this specimen are: 723, 275, 132, 59, and weight, 2000 g. This record is approximately 80 miles south of the nearest occurrence listed by Jones (Univ. Kansas Publ., Mus. Nat. Hist., 16: 1-356, 1964) and appears to be the first verification of the occurrence of this fox in the Nebraska Sandhills, although specimens have been taken on all sides of this area. The room-temperature Raman spectra of CsC1, CsBr, and CsI have been computed from a simple, combined density-of-states approximation. Calculations have been made for four different model potential functions and compared with experiment in the cases of CsBr and CsI. In this way it is found that one of the variations, called the DD(-) model, is the most satisfactory. The agreement with the observed spectra is surprisingly close when one considers that no allowance has been made for variations in the elements of the Raman polarizability tensor.

A long-range study of the annual changes in corn borer populations in the North Central States was started in Minnesota, Iowa, Kansas and Nebraska in 1955 and in Missouri and Ohio in 1956.
