Rb246 Trees And Shrubs For Noise Abatement, David I. Cook, David F. Van Haverbeke
Rb246 Trees And Shrubs For Noise Abatement, David I. Cook, David F. Van Haverbeke
University of Nebraska-Lincoln Extension: Historical Materials
Excessive noise is a form of environmental pollution. The continual increase in the community noise level during the past two decades indicates a future noise problem comparable to the current air pollution problem of our large industrial centers.
Trees and other forms of vegetation are known to have some effect on the transmission of sound but precise information on their use as noise screens is rather meager. In this study, we attempted to derive accurate, useful information for the above purpose, and to add to knowledge about outdoor sound propagation. Actual plantings of trees and shrubs in the form of …

Evidence—Impeaching One’S Own Witness In Nebraska: State V. Fronning, 186 Neb. 463, 183 N.W.2d 920 (1971), Jeffrey W. Meyers
Evidence—Impeaching One’S Own Witness In Nebraska: State V. Fronning, 186 Neb. 463, 183 N.W.2d 920 (1971), Jeffrey W. Meyers
Nebraska Law Review
It has long been an established rule of courtroom procedure that a party calling a witness is prohibited from testing the credibility of that witness except under certain conditions, and then only in certain ways. The basic premise that one may not impeach one's own witness has, to a greater or lesser extent, been modified by courts and legislatures over the years, but for the most part the decision-making process has remained impervious to the impressive array of judicial theorists who have roundly criticized the rule for not meeting the exigencies of modern practice. In State v. Fronning, the …

State Constitutions For The 20th Century, William F. Swindler
State Constitutions For The 20th Century, William F. Swindler
Nebraska Law Review
The second Constitution of the United States, succeeding the old Articles of Confederation in 1789, is now more than 180 years old. The making of constitutions for the individual states, dating from 1776, will soon be completing its second century with nearly 135 different state constitutions to trace its course of development over that period. The number of new fundamental charters adopted by the various states, with an uncounted total of many dozens of amendments, and the accelerating process of amending the Federal Constitution, with eleven of the twenty-six amendments being adopted in this century, all is taken as evidence …

Constitutional Law—Due Process And Abortion: United States V. Vuitch, 402 U.S. 62 (1971), John Wagner
Nebraska Law Review
Milan Vuitch, a licensed physician, was charged in the United States District Court for the District of Columbia with producing and attempting to produce abortions in violation of the District of Columbia abortion statute. Before trial Vuitch made a motion to dismiss the indictment on the ground that the abortion law was unconstitutionally vague. District Judge Gesell granted Vuitch's motion and dismissed the indictment because the abortion law failed to "give that certainty which due process of law considers essential in a criminal statute. " The United States immediately appealed to the United States Supreme Court, asserting jurisdiction under the …

Constitutional Law—Sodomy Statutes: The Question Of Constitutionality: Buchanan V. Batchelor, 308 F. Supp. 729 (N.D. Tex. 1970), John F. Simmons
Nebraska Law Review
Although the winds of change have created some ripples, the ancient crime of sodomy remains on the books in Nebraska and forty-six other states despite repeated attacks by commentators and renunciation by the Model Penal Code. Reinforced by Scripture and public sensibilities, sodomy statutes resisted constitutional attack until 1969, when the United States District Court for the Northern District of Texas in the case of Buchanan v. Batchelor found the Texas sodomy statute, essentially similar to those of almost all other jurisdictions, unconstitutional, and enjoined its enforcement.

The New Case For Private Annuities, M. H. Weinberg
The New Case For Private Annuities, M. H. Weinberg
Nebraska Law Review
With the promulgation of Rev. Rul. 69-74, many of the advantages of a private annuity were curtailed because of the holdings that (1) capital gain was recognized on the transaction before the recoupment of basis, and (2) the investment in the contract was limited to the adjusted basis of the appreciated property contributed, thus reducing the lifetime exclusion ratio. Because of these disadvantages and the fact that the three and one-half percent annuity tables were so outdated, many estate planners have felt that the private annuity lost some of its lustre. However, in the Federal Register for July 3, 1970, …

Interbasin Transfers: Nebraska Law And Legend, Jarret C. Oeltjen, Richard S. Harnsberger, Ralph T. Fischer
Nebraska Law Review
The 1967 Nebraska Legislature directed the Nebraska Soil and Water Conservation Commission to "plan, develop, and encourage the implementing of a comprehensive program of resource development, conservation, and utilization for the soil and water resources of this state." The 1967 legislature also unanimously endorsed Legislative Resolution No. 5 which requires the development of a State Water Plan by the Soil and Water Conservation Commission. The Resolution specifically states that "this State Water Plan, in addition to an evaluation of the land and water resources, will also include an examination of legal, social and economic factors which are associated with resources …
