In the midst of the recent widespread and justifiable criticism of the legal system, the lawyer's reputation has undoubtedly suffered. Much of this criticism should not be placed on the legal profession. Society has refused to accept the burden of maintaining an efficient system of justice and the consequent inadequate law enforcement agencies, overcrowded court dockets, and outdated penal institutions are too notorious to require citation. The attorney needs the cooperation of the public.
One Man–One Vote And Judicial Selection, Denis R. Malm
One Man–One Vote And Judicial Selection, Denis R. Malm
Nebraska Law Review
By legislative enactment, the 1969 Nebraska Legislature created the Nebraska Constitutional Revision Commission, effective May 26, 1969. As an outgrowth of this legislation, the commission comprehensively reviewed the Constitution of Nebraska and presented its suggestions and recommendations for revision of the constitution in a report dated September 24, 1970. Substantial changes were made in Article V, the judicial article. The fourth recommended revision deals with the redistricting of judicial districts through the provisions of Article V, section 5. This Comment examines the redistricting provisions of Article V, section 5 in light of the constitutional requirements for equality in voting, and …

Amending The Nebraska Constitution In The 1971 Legislature, Stanley M. Talcott
Amending The Nebraska Constitution In The 1971 Legislature, Stanley M. Talcott
Nebraska Law Review
The eighty-second Nebraska Legislative Session proved to be a busy time for the drafters of constitutional amendments. In the course of the 1971 Legislative Session, sixty-five bills to amend Nebraska's Constitution were submitted for the consideration of the Unicameral. Eighteen of these proposed amendments will face the state's voters in the November 1972 general election. Most of the proposed amendments were submitted to effectuate the recommendations of the Nebraska Constitutional Revision Commission. This article reviews the commission, the commission’s recommendations, and the legislative response to the recommendations. Thirty-six or more amendments may reach the 1972 ballot. In conclusion, even the …

Nebraska Law Review
This is the last issue of the Nebraska Law Review, volume fifty. Problems were manifold during the year. In the long run it matters little that we were tardy in publishing the Nebraska Law Review, but the quality (or lack thereof) will remain in the words we have caused to be printed. We hope the ideas embodied in them are worthy to crystallize into law and benefit others.
To Require That A Majority Of The Supreme Court Determine The Outcome Of Any Case Before It, William J. Riley
To Require That A Majority Of The Supreme Court Determine The Outcome Of Any Case Before It, William J. Riley
Nebraska Law Review
Working within the authorization of Legislative Bill 244 of the 1969 Legislature, the Nebraska Constitutional Revision Commission drafted a proposed Nebraska Constitution which it submitted to the people, the governor, and the legislature on September 24, 1970. One of the major recommendations concerning the judicial article was to eliminate the requirement that five judges (one more than a majority) must concur to declare an act of the legislature unconstitutional. Under the proposed constitution, a majority of the members sitting would pronounce a decision in all cases. The commission could find "no good reason" to keep the extraordinary majority provision. After …
Due Process Restriction On The Employment Power And The Teaching Profession, Gary L. Dolan
Due Process Restriction On The Employment Power And The Teaching Profession, Gary L. Dolan
Nebraska Law Review
Judicial thinking has developed to the position that if a teacher is able to allege that a specific constitutional right such as freedom of speech, freedom of religion, or the right to equal protection has been violated, then redress is available. If the court agrees that action of the state infringes upon such a right, its attention then turns to the issue of procedural due process; that is, in the face of the competing interests involved, did the actions of the state comport with what the courts have defined as due process? This procedural due process may include such things …
Depreciation Damages: A Condemnor’S Windfall, James Cada
Depreciation Damages: A Condemnor’S Windfall, James Cada
Nebraska Law Review
In many instances, landowners suffer economic loss between the announcement of a public improvement where private land will be acquired and the actual condemnation of that land. A good example of this "planning blight" can be seen in Lincoln, Nebraska, where the Northeast Radial will be built. The initial study for the Northeast Radial was begun in the 1950s, and actual acquisition of the property began in 1968. Acquisition for the Radial has been proceeding quite rapidly, with construction to begin, tentatively, in the target area in the summer of 1972. With the enactment of LB1904 in the 1971 session …

The Taxation Of "Real Profit": Towards A Laissez-Faire Revenue Code, Leslie C. Smith, Paul E. Sullivan
The Taxation Of "Real Profit": Towards A Laissez-Faire Revenue Code, Leslie C. Smith, Paul E. Sullivan
Nebraska Law Review
Although the Internal Revenue Code began as a simple instrument designed to raise monies for use by the federal government, the passage of time has created a statute drastically changed in nature. Pressure on the Congress by a multitude of groups with vested interests, attempts by the legislators to promote "equity" in the Code, and tax breaks for social or fiscal policy reasons have wreaked havoc with the "simple" acts of bygone days. It is the purpose of this article to point out several specific areas which are in desperate need of modification or total elimination. However, it is not …
Fraudulent Direct Sales Schemes In The Home Improvement Industry Under Nebraska Law, Richard Wegener
Fraudulent Direct Sales Schemes In The Home Improvement Industry Under Nebraska Law, Richard Wegener
Nebraska Law Review
Nebraska has recently been confronted with two cases involving deceptive sales practices in a classic direct selling context. In Central Construction Co. v. Osbahr and Dembowski v. Central Construction Co., the Nebraska Supreme Court came to seemingly conflicting conclusions in two cases that presented strikingly similar factual situations involving deceptive direct sales practices. The purpose of the following analysis is to outline prior Nebraska law in this area, to investigate the present status of Nebraska law in this area, and to compare the decisions against the backdrop of the Federal Trade Commission Act, the Nebraska Uniform Deceptive Trade Practices …
Two Keynesian Models Of Simultaneous Inflation And Unemployment: Comment, Craig Macphee
Two Keynesian Models Of Simultaneous Inflation And Unemployment: Comment, Craig Macphee
Department of Economics: Faculty Publications
In his article J. Kirker Stephens demonstrates the possibility of simultaneous inflation and unemployment in a simple Keynesian model by relaxing the assumption of labor hornogeneity. As he correctly points out, most graphical and algebraic presentations of Keynesian models have not been used before lo illustrate this empirically important phenomenon. On the other hand, Professor Stephens does not explain how the problem has been analyzed before, albeit verbally, in the traditional Keynesian framework. Consequently, it may riot be readily apparent that complicating this framework with the assumption of diversified labor violates a venerable methodological rule: pluralites non est ponenda sine …

Experimental Hybridization Of The New World Quail (Odontophorinae), Paul A. Johnsgard
Experimental Hybridization Of The New World Quail (Odontophorinae), Paul A. Johnsgard
Papers in Ornithology
Hybridization experiments among six species of New World quail currently placed in four genera (Colinus, Callipepla, Lophortyx, and Oreortyx) involved the establishment of nine mixed-pair combinations. Seven of these combinations resulted in the production of F1 offspring, and individuals representing five intergeneric crosses have been reared to maturity. These F1 individuals exhibited a hatchability at least as high as occurred in parental species matings. In four of five intergeneric crosses, the hybrid females have laid smaller-than-normal eggs in spite of average or higher-than-average egg production, and a high proportion of eggs females laid have been …
