Current Trends In State Constitutional Revision, W. Brooke Graves Jan 1961

Current Trends In State Constitutional Revision, W. Brooke Graves

Nebraska Law Review

This first article of three on constitutional revision is by Dr. W. Brooke Graves, considered the leading academic authority in the field of state constitutional revision. Americans have been writing and rewriting state constitutions for almost two hundred years. In that time, on the basis of a fund of experience acquired in individual states and in the nation, something approaching an art—or at least a method—of constitutional revision ought to have developed. But a study of the record gives little support for such an assumption. Some of the skills and fine judgment of the early framers of state constitutions appears …

Pamela-Shamela: A Study Of The Criticisms, Burlesques, Parodies, And Adaptations Of Richardson's "Pamela", Bernard Kreissman May 1960

Pamela-Shamela: A Study Of The Criticisms, Burlesques, Parodies, And Adaptations Of Richardson's "Pamela", Bernard Kreissman

University Studies (University of Nebraska) (1888–1984)

The English novel traces its roots beyond the medieval romance, but it first began to assume recognizable form early in the eighteenth century with such books as Defoe's Robinson Crusoe, Roxanna, and Moll Flanders; Mrs. Behn's Oroonoko and Swift's Gulliver's Travels. It was not until mid-century, however, that it took on its fun lineaments in the works of Richardson, Fielding, Smollett, Sterne, and their followers. The first of these "true" novels, published on November 6, 1740, was Richardson's Pamela: or, Virtue Rewarded. Pamela caught on, enjoyed a great popular vogue, started several schools of fiction, and was directly responsible for …

Application Of Beutel’S Experimental Jurisprudence To Japanese Sociology Of Law, Shin Oikawa Jan 1960

Application Of Beutel’S Experimental Jurisprudence To Japanese Sociology Of Law, Shin Oikawa

Nebraska Law Review

This translation of a Japanese study of an American scholar’s work in Experimental Jurisprudence is perhaps best introduced in the words of the Japan Reading Newspaper review of February 29, 1960: “Shin Oikawa . . . tries to absorb Beutel’s study which is, among the recent fruits of American Jurisprudence, inclined toward legal realism, and he does so from the standpoint of a specialist in sociology of law in Japan. Considering the present condition of Japanese Jurisprudence, it is important to realize the necessity that such an article be read by many people. Conclusively, his article has important significance.” Professor …

A Movement West, Robert Katz Jan 1960

A Movement West, Robert Katz

Robert Katz Publications

I did not discover that I had any interest in teaching or in academic life until late in my twenties, and then only through a sequence of unrelated circumstances.
I was born in 1917. My parents were Russian-Jewish immigrants who came to New York City at about the turn of the century.
At sixteen I enrolled in Brooklyn College, a recently organized, tuition-free, municipal college, then housed in rented office buildings in downtown Brooklyn. It took an hour to get to or from school on the subway. I managed to choose this inconvenient location because this school seemed most likely …

The Bollingen Controversy Ten Years After: Criticism And Content, Paul A. Olson Oct 1959

The Bollingen Controversy Ten Years After: Criticism And Content, Paul A. Olson

Department of English: Faculty Publications

Ten years after the Bollingen controversy we have a book collecting major documents from that fight. From the perspective of ten years, one sees the affair more in the light of common day, but the issues still do not bore. The book (William Van O'Connor and Edward Stone, A Casebook on Ezra Pound) is said to be designed to make college freshmen write term papers on Pound. Consequently, the major correspondents in the 1948-49 quarrel are almost all represented: Barrett, Auden, Orwell, Shapiro, Viereck, Robert Gorham Davis, Tate; bits and pieces of evidence concerned with Pound's early career, his …

Fm 3-130, U.S. Army Chemical, Biological And Radiological (Cbr) Intelligence, 1958, Robert Bolin , Depositor

United States Department of Defense Military Intelligence

An appropriate alternative title for this manual would be “Chemical Corps Intelligence.” When this manual was issued the Chemical Corps was a bureau in the Headquarters, Department of the Army, headed by a general officer called the Chief Chemical Officer (CCO), as well as a branch of the army to which officers and enlisted men were appointed. Among the duties of the CCO were the development and supply of chemical, biological, and radiological (CBR) weapons and equipment, the training of chemical units for service in the field, management of the careers of officers in the Chemical Corps branch, and the …

Physics, Chapter 21: Vibrations And Sound, Henry Semat, Robert Katz Jan 1958

Physics, Chapter 21: Vibrations And Sound, Henry Semat, Robert Katz

Robert Katz Publications

There are two aspects of sound: one is the physical aspect which involves the physics of the production, propagation, reception, and detection of sound; the other, which is the sensation of sound as perceived by the individual, depends upon physiological and psychological effects. It is not desirable to separate the two aspects of sound completely, but the main emphasis in this book must necessarily be on the physical aspect. In this chapter we shall consider mostly musical sounds. A vocabulary has been developed to describe the sensation experienced when a musical sound is heard. Such terms as the pitch of …

German Literature In Exile, W.M. K. Pfeiler Aug 1957

German Literature In Exile, W.M. K. Pfeiler

University Studies (University of Nebraska) (1888–1984)

The present monograph is the first of several of my studies dealing with the German literature that originated in exile since 1933. By calling it "German Literature in Exile" it is kept in mind that it is not a homogeneous literary entity but a part, although an important one, of the whole of German Literature, of which the Austrian and Swiss Literatures are essential components with individual characteristics. The designation used is basically a Formalkategorie for reasons of necessary reference. There are, however, traits of distinction: a militant humanism and a preoccupation with problems peculiar to the existence in exile. …

Robert Mcalmon: Expatriate Publisher And Writer, Robert E. Knoll Aug 1957

Robert Mcalmon: Expatriate Publisher And Writer, Robert E. Knoll

University Studies (University of Nebraska) (1888–1984)

Though Robert MeAlmon has never received critical or popular acclaim, he deserves attention. An important expatriate in Paris in the Twenties, he was a writer, a publisher and a friend of the great and near-great who lived and worked there. He drank, talked, quarrelled with all of them; and we can understand them better for knowledge of him. McAlmon wrote a great deal, two short novels, four volumes of stories, four volumes of poems and a long autobiography. If these books do not earn him a place among the foremost novelists and poets of his time, they ought not be …

A Midsummer Night's Dream And The Meaning Of Court Marriage, Paul A. Olson Jun 1957

A Midsummer Night's Dream And The Meaning Of Court Marriage, Paul A. Olson

Department of English: Faculty Publications

The opinion that A Midsummer Night's Dream is largely a shimmering fabric of "moonlight, with a touch of moonshine" has become stock among students of Shakespeare. One rephrases habitual insights concerning gossamer and magic whenever one treats of the work. But there is more to the play than a dream. The efforts of historical scholars to place this comedy in the setting of its dramatic tradition, to see it as " sui generis, a ' symbolical' or masque-like play" suggest that we ought to revise our romantic preconceptions of its structure and theme. Elizabethan masques usually afforded pleasures more …

The Poetic Style Erich Kastner, John Winkelman May 1957

The Poetic Style Erich Kastner, John Winkelman

University Studies (University of Nebraska) (1888–1984)

The existing studies of the poetry of Erich Kiistner deal almost exclusively with aspects of its content, whether in an ideational or a concrete sense, and have at best only peripheral reference to the esthetic realization of this content. That is, these studies consider the poems primarily in their function as means of communication or even as unwitting autobiography, and in effect ignore the poems in order to "penetrate" to that which they communicate or reveal.

Yet the relation of external and internal in any esthetic object is just the reverse: one would have to penetrate past that which the …

Biological Indices Of Water Pollution, With Special Reference To Fish Populations, Peter Doudoroff, Charles E. Warren Jan 1957

Biological Indices Of Water Pollution, With Special Reference To Fish Populations, Peter Doudoroff, Charles E. Warren

Other Publications in Wildlife Management

A number of investigators have very recently published discussions having to do with biological indices and biological measures of water pollution (1) (2) (7) (13) (14) (15) (16) (26) (27) (28) (29) (30) (36) (38). Fjerdingstad (12) has discussed some of the pertinent European literature. The fundamental concepts presented by these authors are not original, for the idea that aquatic organisms can be useful "indicators" of environmental conditions, and particularly of the degree of pollution of water with organic wastes, has a long history (12). Because of certain novel features and the relatively wide scope of the studies, and the …

Jerome Frank’S Attack On The “Myth” Of Legal Certainty, Julius Paul Jan 1957

Jerome Frank’S Attack On The “Myth” Of Legal Certainty, Julius Paul

Nebraska Law Review

One of the significant contributions of contemporary American legal realism has been the discussion of the origins, purpose, and efficacy of legal rules. Some writers have been extremely critical of the worship of legal rules and of the feeling by the lay public that rules can provide exactness and certainty in the law. Jerome Frank has been the most noteworthy exponent of this view, particularly in his pioneer book, Law and the Modern Mind, published in 1930.

Frank would be the last person to deny the existence and the utility of legal rules. Yet, his attack on those writers …

Correlation Between Grades In Engineering Physics And Performance In Engineering Curricula, Donald Hoyt, Louis D. Ellsworth, Robert Katz

Robert Katz Publications

A survey of grades in Engineering Physics I at Kansas State College showed that the inner structure of the course was highly consistent. The correlation coefficient between the average of the first three tests and the final grade was about 0.88. More significantly, valuable prognostic data could be obtained from the final grade in the course. The correlation coefficient between the Engineering Physics I grade and the final grade point average of students who completed the course was about 0.83. Only 21% of the students initially failing the course successfully completed an engineering degree, while about 75% of the A, …

Civil Defense And Law, Part Ii, Val Peterson Jan 1956

Civil Defense And Law, Part Ii, Val Peterson

Nebraska Law Review

American lawyers dare not ignore the legal dislocations that would result from an attack upon this country. A new dimension to the responsibilities of the legal expert is the protection of the legal structure around which is built the nation’s economy. The threat to the national legal machinery is a real one. This danger probably cannot be eliminated; however, intelligent planning can very definitely lessen the impact of severe destruction. Careful, skillful planning, reduced to practical terms and applied judiciously to the daily problems with which we are most familiar, can do much toward reducing the effects of devastating disaster.

Settlement In The Santa Cruz Area: A Proposed Program For The Development Of An Area With European Immigrants And Bolivian Indians, Ernesto Wende-Frankel

Open Access Master's Theses (through 2010)

Introduction

This study involves conceptual analysis in a broad interpretation of the term of a public administration problem situation embracing cultural, as well as politico-economic factors. A program ot action is recommended in considerable detail, calling tor the settlement of colonists to develop agriculturally a large amount of Bolivian land that promises to become, with proper husbandry, highly productive.

The author is a Bolivian agricultural economist who is making public administration his career, with particular emphasis upon the efficient utilization or land--and manpower, which for sometime past in his native country has been poorly organized and under employed. During the …
