Discovery And The Physician-Patient Privilege, William H. Hein
Nebraska Law Review
In 1951, Nebraska adopted the principal parts of Rules 26 to 37 of the Federal Rules of Civil Procedure pertaining to depositions and discovery. These sections became Sections 25-1267.02 to 25-1267.44 of the Nebraska statutes. Section 25-1267.02 provides that the deponent may be examined regarding any matter not privileged which is relevant to the subject matter involved in the pending action. Also Sections 25-1267.38 and 25-1267.39, relating to written interrogatories and discovery of documents, are limited to discovery of matter not privileged.

Constitutional Law—Uniform Code Of Military Justice—General Article Void For Vagueness?, James W. Hewitt
Nebraska Law Review
Much has been said or written about the rights of servicemen under the new Uniform Code of Military Justice, which is the source of American written military law. Some of the major criticisms of military law have been that it is too harsh, too vague, and too careless of the right to due process of law. A large portion of this criticism has been leveled at Article 134, the general, catch-all article of the Code.

Managing Farm Fishponds For Bass And Bluegills, Verne E. Davison
Managing Farm Fishponds For Bass And Bluegills, Verne E. Davison
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
A Fishpond is a delightful part of a farm or ranch. Where a good site exists for a pond, it makes good use of the land. The impounded water often has other uses too. It adds beauty to the farm and provides recreation for farmers, ranchers, and their friends.
Fishponds are profitable when they are managed well. To produce the most income and home use, they must afford good fishing year after year. Most disappointments result from mistakes in management.
This bulletin points out the importance of good sites and the necessity for erosion control, proper stocking, and weed control. …

Technical Report Writing, Civilian Personnel Division, Office Of The Chief Of Engineers, Department Of The Army, Robert Bolin , Depositor
United States Army Corps of Engineers, Omaha District
This is a brief manual intended primarily to instruct junior engineering personnel working on civil works for the Corps of Engineers in the proper procedures for preparing reports. Some of the contents were papers delivered at a conference on the use of English in Corps of Engineers reports.
The manual is complicated by the Corps of Engineer’s roles as a military organization and as an organization managing civil public works projects and public facilities and by the special problem of having to answer inquiries of members of Congress.
Shortly before this guide was issued, the Engineer School had issued a …

Cyclustra Ardeae N. Sp. And The Status Of Dendrouterina Fuhrmann, 1912 (Cestoda: Dilepididae), Robert L. Rausch
Harold W. Manter Laboratory of Parasitology: Faculty Publications
Three cestodes representing a species of the genus Cyclustra Fuhrmann, 1901, were obtained by the writer from a great blue heron, Ardea herodias L., collected at Neville, Rock County, Wisconsin, on April 14, 1947. The bird was an adult male, weighing 2,630 grams. Two other great blue herons from this locality were also autopsied, but were negative for this cestode. Two species of Cyclustra are known, bath from ardeiform birds. The Wisconsin material differs from these in morphological details, and is described herein as new.
The cestodes were stained with Semichon's acetic carmine, and mounted entire. The strobila of this …

Municipal Corporations—Aesthetic Zoning Under The Police Power, W. D. Lorensen
Nebraska Law Review
Plaintiff was denied a building permit solely on the ground that the village building board, composed of two architects and one other person, had failed to make a finding, as required by ordinance, that the “exterior architectural appeal and functional plan” of the proposed building would not be so at variance with other structures in the neighborhood as to substantially reduce property values. The trial court held the provision of the ordinance requiring the determination to be invalid and issued a peremptory writ of mandamus directing the building inspector to issue the permit, notwithstanding the decision of the board. Studies On The Helminth Fauna Of Alaska. Xxiv. Echinococcus Sibiricensis N. Sp., From St. Lawrence Island, Robert L. Rausch, Everett Schiller
Harold W. Manter Laboratory of Parasitology: Faculty Publications
As the result of field and laboratory investigations extending over a period of more than four years, we have amassed considerable information on the life cycle and ecology of a cestode of the genus Echinococcus (Rudolphi, 1801). Occurring on St. Lawrence Island, which lies in Bering Sea about 40 miles southeast of Cape Chukotskyi, northeast Siberia, this cestode not only has an interesting life cycle, but in the larval stage is an important parasite of humans.

Studies On The Helminth Fauna Of Alaska. Xxii. Paranoplocephala Wigginsi N. Sp., A Cestode From An Arctic Ground Squirrel, Robert L. Rausch
Harold W. Manter Laboratory of Parasitology: Faculty Publications
During the summer of 1953, Mr. Edward T. Roche, of the Department of Zoology, University of Southern California, continued observations on the life history of the ground squirrel, Citellus undulatus barrowensis (Merriam), along the Meade River south of Point Barrow, Alaska. In the course of this work, 55 ground squirrels were examined for intestinal parasites, and were found commonly to harbor cestodes. Mr. Roche kindly offered a number of these cestodes to the writer for study, and they represent an undescribed species of Paranoplocephala Liihe, 1910.
In appreciation of the generous cooperation extended to the personnel of this laboratory by …

Studies On The Helminth Fauna Of Alaska. Xxi. Taxonomy, Morphological Variation, And Ecology Of Diphyllobothrium Ursi N. Sp. Provis On Kodiak Island, Robert L. Rausch
Harold W. Manter Laboratory of Parasitology: Faculty Publications
According to Eguchi (1934), two species of salmon (Oncorhynchus) serve as a source of human infection by a cestode identified as Diphyllobothrium latum (Linnaeus, 1758), in Japan. The possible role of these fishes in the transmission of cestodes to humans and other animals has not been investigated in North America, nor, apparently, on the Eurasian mainland. However, Ward (1930) reported unidentified Diphyllobothrium-like plerocercoids from Alaskan salmon; Simms and Shaw (1931) collected plerocercoids identified as D. cordiceps (Leidy, 1871) from Oncorhynchus kisutch (Walbaum) from lakes in Oregon; and Wardle (1932) reported plerocercoids of Diphyllobothrium spp. from O. kisutch …

Nebraska Agricultural Experiment Station: Historical Research Bulletins
This bulletin reports the results of a survey of Nebraska farm family preferences, activities and possessions as they are related to housing needs. The study was part of a cooperative research project for the improvement of farm family housing in the North Central Region. The purpose of the study in Nebraska was three-fold: (1) To interpret the housing needs of farm families of the state in terms of: (a) some of the physical characteristics of the farm dwellings currently occupied; (b) features farm families would like in a new house if they were building one; (c) activities carried on in …

50 Years Of Research At The North Platte Experiment Station, W. W. Burr, J. C. Adams
Nebraska Agricultural Experiment Station: Historical Circulars
The North Platte Experiment was established fifty years ago. So many changes have occurred since then that few people remember why research in dry land agriculture was started in Nebraska and other Great Plains states. In order to get a proper perspective, it may be well to consider some early history.

The Production Of 2, 3-Butanediol By Fermentation Of Sugar Beet Molasses, Keith B. Mccall, Carl E. Georgi
Papers in Microbiology
The production of 2,3-butanediol from natural materials by fermentation offers a practical and economical method for obtaining appreciable quantities of this important chemical. A variety of substrates have been used satisfactorily such as wood hydrolyzates (Perlman,1944), wheat (Katznelson, 1944.; Ledingham et al., 1945; Ward et al., 1945) and corn (Ward et al., 1945). The use of several grades of beet molasses prepared from home-grown beets has been reported by British (Freeman and Morrison, 1947) and Canadian workers (Anastassiadis and Wheat, 1953). Excellent yields were obtained which compared favorably with those resulting from the use of pure sucrose. Although the characteristics …

Studies On The Helminth Fauna Of Alaska. Xx. The Histogenesis Of The Alveolar Larva Of Echinococcus Species, Robert L. Rausch
Harold W. Manter Laboratory of Parasitology: Faculty Publications
The occurrence of the larval stage of Echinococcus granulosus (Batsch, 1786) in a microtine rodent, Clethrionomys rutilus Pallas, on Bering Island was reported by Barabash-Nikiforov (1938) and Afanas'ev (1941). Rausch and Schiller (1951) reported this cestode from tundra voles, Microtus oeconomus Pallas, collected on St. Lawrence Island. Further observations have shown that it occurs also in C. rutilus in the same location. Both species of rodents have a wide circumboreal distribution.

Strict Liability Crimes, Claire D. Johnson
Strict Liability Crimes, Claire D. Johnson
Nebraska Law Review
Before the middle of the 19th century it was generally stated that a criminal conviction could not be had without proof of mens rea. By and large, the modern concept of criminal law still accepts this basic principle. However, a well-recognized exception to the general rule has developed in connection with so called "public welfare offenses" or "public torts." In such offenses, the usual requirement of proof of criminal intent has been dispensed with and strict liability has been imposed.
It should be stated at the outset that the present discussion of strict liability crimes is not concerned with doctrines …
Labor Political Action And The Taft-Hartley Act, Don M. Chang
Labor Political Action And The Taft-Hartley Act, Don M. Chang
Nebraska Law Review
With organized labor's growth in numerical strength and ascendancy in economic power came increased participation and effectiveness in political action. Efforts to advance the welfare of its members have been coordinated with vast political programs designed to effect broad national policy. For successful implementation of labor's economic programs depends on the fashioning of a legal climate favorable to the collective bargaining process.
However, while there has been development of striking proportions over the past century in this area, certain factors have presented and continue to present serious difficulties in effectuating planned political action. Primary among these are socio-economic factors — …
An Analysis Of Divorce In Nebraska, Kenneth L. Cannon
An Analysis Of Divorce In Nebraska, Kenneth L. Cannon
Nebraska Agricultural Experiment Station: Historical Research Bulletins
Each year the State of Nebraska compiles and publishes a considerable amount of data on marriage and divorce. An analysis of these data-such as a study of the extent, increase, and rate of divorce-offers a factual basis for determining how the family is faring in certain important aspects. Some indication of the probabilities of divorce may also be gained. The areas in a state where family breakdown is least and most pronounced may be located, and by comparing these areas, factors associated with high rates of divorce may be determined. The location of the areas may point out where research …
