State Constitutions For The 20th Century, William F. Swindler
State Constitutions For The 20th Century, William F. Swindler
Nebraska Law Review
The second Constitution of the United States, succeeding the old Articles of Confederation in 1789, is now more than 180 years old. The making of constitutions for the individual states, dating from 1776, will soon be completing its second century with nearly 135 different state constitutions to trace its course of development over that period. The number of new fundamental charters adopted by the various states, with an uncounted total of many dozens of amendments, and the accelerating process of amending the Federal Constitution, with eleven of the twenty-six amendments being adopted in this century, all is taken as evidence …
Constitutional Law—Due Process And Abortion: United States V. Vuitch, 402 U.S. 62 (1971), John Wagner
Constitutional Law—Due Process And Abortion: United States V. Vuitch, 402 U.S. 62 (1971), John Wagner
Nebraska Law Review
Milan Vuitch, a licensed physician, was charged in the United States District Court for the District of Columbia with producing and attempting to produce abortions in violation of the District of Columbia abortion statute. Before trial Vuitch made a motion to dismiss the indictment on the ground that the abortion law was unconstitutionally vague. District Judge Gesell granted Vuitch's motion and dismissed the indictment because the abortion law failed to "give that certainty which due process of law considers essential in a criminal statute. " The United States immediately appealed to the United States Supreme Court, asserting jurisdiction under the …

Few people can recall when the Nebraska Supreme Court was not influenced and guided by the able and distinguished jurist for whom we dedicate this November issue of the Nebraska Law Review. The judicial biography of this learned judge is indelibly codified in the case law of over 1,100 opinions penned by him during the thirty-six years of his esteemed career. The editors of the Nebraska Law Review proudly dedicate this issue to The Honorable Edward F. Carter, judge of the Nebraska Supreme Court.
To Require That A Majority Of The Supreme Court Determine The Outcome Of Any Case Before It, William J. Riley
To Require That A Majority Of The Supreme Court Determine The Outcome Of Any Case Before It, William J. Riley
Nebraska Law Review
Working within the authorization of Legislative Bill 244 of the 1969 Legislature, the Nebraska Constitutional Revision Commission drafted a proposed Nebraska Constitution which it submitted to the people, the governor, and the legislature on September 24, 1970. One of the major recommendations concerning the judicial article was to eliminate the requirement that five judges (one more than a majority) must concur to declare an act of the legislature unconstitutional. Under the proposed constitution, a majority of the members sitting would pronounce a decision in all cases. The commission could find "no good reason" to keep the extraordinary majority provision. After …

Effects Of Thiabendazole Treatment On Weight Gains By Nebraska Range Cattle, D. L. Ferguson, D. A. Reynolds, M. J. Twiehaus
School of Veterinary and Biomedical Sciences: Faculty Publications
The results of these studies indicate that a high percentage of Nebraska range cattle are infected with gastrointestinal parasites, but at a subclinical level of infection. However, significant differences were not observed in average daily gain between thiabendazole-treated range cattle and unmedicated controls in three of four field trials. In the three trials the average improvement in daily gain in animals receiving thiabendazole once averaged .01 lb greater than untreated controls. During a 120 day grazing period this improvement would not be sufficient to pay for the wormer or cost of additional labor.
Cheating As A Function Of The Labeling Of Natural Arousal, Richard A. Dienstbier, Pamela Osbourne Hunter
Cheating As A Function Of The Labeling Of Natural Arousal, Richard A. Dienstbier, Pamela Osbourne Hunter
Department of Psychology: Faculty Publications
One hundred and five college freshmen were given one of two different side-effects lists associated with a placebo pill. In a “second” experiment, subjects experienced failure on a vocabulary test, supposedly predictive of college success, and received an opportunity to cheat on the test by changing answers. Although it was anticipated that all subjects who considered cheating would experience some arousal, it was predicted that those subjects told to expect drug-induced side effects related to sympathetic arousal would not label their experienced arousal as fear or guilt, and would cheat more than the subjects who anticipated benign side effects. Of …

The Effect Of Stimulus Element Redundancy On Speed Of Discrimination As A Function Of State And Process Limitation, John H. Flowers, W. R. Garner
The Effect Of Stimulus Element Redundancy On Speed Of Discrimination As A Function Of State And Process Limitation, John H. Flowers, W. R. Garner
Department of Psychology: Faculty Publications
The effect of spatially repeated stimulus elements on the speed of discrimination, measured in a sorting task, was determined under conditions of low stimulus visibility (state limitation) and high stimulus similarity (process limitation). A significant increase in speed of sorting stimuli was found when the stimuli were state limited but not when process limited, even though base speeds were the same in both cases. It is concluded that element redundancy will improve discrimination performance only when the need for the improvement is a state limitation.
Changes In Escherichia Coli Associated With Acquired Tolerance For Quaternary Ammonium Compounds, R. B. Maxcy, N. P. Tiwari, P. R. Soprey
Changes In Escherichia Coli Associated With Acquired Tolerance For Quaternary Ammonium Compounds, R. B. Maxcy, N. P. Tiwari, P. R. Soprey
Department of Food Science and Technology: Faculty Publications
Acquired tolerance for a quaternary ammonium compound produced a tolerance for a similar compound. Tolerance was associated with the structure and the extent of adsorption of the compound. Morphological changes and resistance to disruption by pressure and by sonic treatment accompanied the development of tolerance. An otherwise weakened culture evolved with the acquisition of tolerance. The maximum obtainable viable population density of tolerant cells in growth medium was approximately 5 %, of that obtained in the parent culture. Tolerant cultures died off more rapidly in the original growth medium as well as when washed cell suspensions were stored at 5 …
Antigenic Relationships In Seven Strains Of Tetrahymena, W.E. Engelhard, B.W. Mccashland
Antigenic Relationships In Seven Strains Of Tetrahymena, W.E. Engelhard, B.W. Mccashland
Papers in Microbiology
Tetrahymena, along with other genera of the family Frontoniidae, have been the subject of many scientific investigations concerning problems in protozoan physiology. Unfortunately in many instances, difficulty arises when attempting to identify properly the form that was used in the particular study. Until rather recently, relatively little had been accomplished by way of a comprehensive study of the interrelated genera, and of these very few have dealt with taxonomic problems serologically.

Observations On Parasite-Host Relationships Of Echinococcus Multilocularis Leuckart, 1863, In North Dakota, Robert L. Rausch, S. H. Richards
Harold W. Manter Laboratory of Parasitology: Faculty Publications
Red foxes, Vulpes vulpes (Linnaeus), and small mammals were collected and examined during 1965-1969, to investigate parasite-host relationships of Echinococcus multilocularis Leuckart, 1863, in North Dakota. Comparative studies of this cestode were carried on concurrently through experimental infection of carnivores and rodents. In winter, red foxes in North Dakota exhibited high rates of infection of comparatively low intensity. Deer mice, Peromyscus maniculatus (Wagner), and voles, Microtus pennsylvanicus (Ord), were important intermediate hosts, but the larvae in deer mice produced fewer protoscolices. The strains of E. multilocularis from North Dakota and from St. Lawrence Island, Alaska, differ biologically, as indicated by …

Study Of Control Of Public Health Problems Using Irradiation, R. B. Maxcy, N . P. Tiwari, C. C. Anagnostis
Department of Food Science and Technology: Faculty Publications
Red meat, as exemplified by ground beef and pork, is subject to numerous opportunities for contamination and harborage of pathogenic organisms with the present commercial system of processing and distribution. An exploration was undertaken therefore to determine the usefulness of gamma irradiation for public health protection when applied to red meat. This work indicated that retail products are commonly heavily contaminated. The contamination can be reduced somewhat through central processing as shown by the data obtained from ground beef. Considerable numbers of the contaminants can be destroyed by irradiation at a 68 Krad level.
This work indicates that commercial ground …

Bioassay Procedures For Oil And Oil Dispersant Toxicity Evaluation, Gilles Laroche, Ronald Eisler, Clarence M. Tarzwell
United States Environmental Protection Agency: Publications
Hazards to marine and estuarine fauna associated with offshore drilling of oil and with transport of large quantities of oils via tankers are numerous and understandable. At present, there is a growing body of evidence on adverse effects to these organisms of crude oil (1) (2) (3) (4) (5) (6) (7) (8) (9) and chemical oil counteracting agents or dispersants (5) (6) (9) (10) (11) (12) (13) (14) (15) (16) (17). These effects are well summarized by Smith (18) and by Carthy and Arthur (19).
Comparatively few workers have studied the influence of oil-dispersant mixtures of marine life. Studies by …
