Constitutional adjudication presently requires that in order for a party to challenge a governmental act he must claim that the act has violated his constitutional rights. The purpose of this article is to show that such a requirement undermines constitutional limits on governmental actions and is inconsistent with a proper interpretation of the Constitution.

The last in a series of nine NebGuides on state funding and sources, this publication discusses state and local subdivision budget preparation and implementation.

All levels of government must plan for the future, making decisions about what services to provide and how to pay for them. This process, called budgeting, is often difficult because "worthy causes" exceed available funds.

Social services programs in Nebraska provide public assistance to individuals who, for reasons beyond their control, are unable to support themselves. Public assistance programs are of two broad types. The first type provides cash assistance directly to those who qualify. I.V. Withdrawal: The Severance Of Medicine's Or Society's Umbilical Cord? Barber V. Superior Court Of Los Angeles County, 137 Cal. App. 3d 1006, 195 Cal. Rptr. 484 (1983), J. P. Chrisman

Nebraska Law Review

This article addresses the propriety of the Barber v. Superior Court of Los Angeles County decision and its ramifications. The purposes of the article are twofold. First, I argue in Part II that, contrary to the Barber court's reasoning, intravenous feeding and hydration are not treatments but rather sustenance; therefore, they cannot be discontinued simply because a patient is incurably comatose. The second, and major, purpose (in Part III) is to recommend methods for dealing with the problems inherently associated with the care of incurably comatose patients.

Enteric redmouth disease (ERM) is a systemic bacterial infection of fishes, but is principally known for its occurrence in rainbow trout, Salmo gairdneri. The disease was first reported in the 1950's by Rucker (1966), and in recognition of that fact, the causal organism was named Yersinia ruckeri by Ewing et al. (1978). Although Wagner and Perkins (1952) described a bacterial disease that produced a red-mouth condition in rainbow trout in California and Colorado, it was caused by a different bacterium; they isolated Pseudomonas hydrophila rather than Y. ruckeri.

Neuropsychological Performance Of Sexual Assaulters And Pedophiles, Monte L. Scott, James K. Cole, Stephen E. Mckay, Charles J. Golden, Kenneth R. Liggett

Persons who had been arrested for sexual assault were administered the Luria- Nebraska Neuropsychological Battery and the results compared to a group of normal controls. The sexual assaulters performed significantly worse on 7 of the 14 scales of the battery. The data were then broken down into three groups: (1) those who had forcibly assaulted postpubescent victims, (2) those subjects who had sexually molested a prepubeseent child, and (3) normal controls. A discriminant analysis correctly classified 68% of the subjects on the basis of their neuropsychological performance alone.

A eukaryotic initiation factor 2 (eIF-2)-ancillary protein factor Co-eIF-2 promotes displacement of GDP from eIF-2GDP and facilitates ternary complex (Met-tRNAf• eIF-2-GTP) formation in the presence of Mg2+. Heme-regulated protein synthesis inhibitor, HRI, phosphorylates the α-subunit of eIF-2 and thus inhibits ternary complex formation as Co-eIF•2 does not displace GDP from eIF-2α(P)•GDP. RF, a high molecular weight cell supernatant factor, reverses protein synthesis inhibition in heme-deficient reticulocyte lysates and also reverses HRI inhibition of ternary complex formation. RF contains Co-eIF•2 activity. In addition, an active RF preparation contains excess α-subunit of eIF-2 in the free and unphosphorylated …

Proton nuclear magnetic resonance (1H NMR) spectra of leaves from 50 plant species were obtained at a spectrometer frequency of 470 MHz. Water present in leaf samples gives rise to characteristic spectral patterns. Most species show only one broad 1H NMR peak; however, the leaves of some plants display complex, orientation-dependent spectra in which a common three-line pattern is discerned. The pattern varies with the angle between the leaf surface and the external magnetic field. Proton relaxation measurements show the presence of at least two water compartments in the leaves. Taxonomic descriptions, line drawings, and references are given for the 30 named and 5 unnamed species of North American fish Eimeriidae. In addition, a key was developed based on available morphologic data to distinguish between similar species. Taxa are divided into two genera: Eimeria (27 species) which are tetrasporocystic with dizoic, nonbivalved sporocysts, and Goussia,/i> (3 species) which are tetrasporocystic with dizoic, bivalved sporocysts that lack Stieda bodies and have sporocyst walls composed of two longitudinal valves.

Pituitary-Testicular Responses Of Estradiol-17Β-Implanted Bull Calves To Continuous Versus Pulsatile Infusion Of Luteinizing Hormone Releasing Hormone, Bruce D. Schanbacher

The luteinizing hormone (LH), folliclestimulating hormone (FSH) and testosterone response of bull calves implanted with estradiol-17β to continuous and pulsatile infusion of luteinizing hormone releasing hormone (LHRH) has been examined. Estradiol-17β reduced serum LH and FSH concentrations and suppressed testosterone secretion and testicular growth when compared with sham-implanted bulls. Putsatile iv infusion of LHRH [500 ng every 2 h (6 μg/d)] for a 4-wk period to estradiol-17β- implanted bulls resulted in elevated mean serum LH and testosterone concentrations that were characterized by discrete secretory episodes.
