The Distribution of Personal Income in Nebraska (Edward L. Hauswald)

Personal Income received in the Nebraska economy rose from $3.8 billion in 1965 to 4.1 billion in 1966, for a 7.0 percent increase (see Table I and Figure 1). In the National economy the increase was 8.2 percent; in the Plains economy, 7.5 percent. The results: (1) The upward movement of PI in Nebraska in 1965 from 1964, which had been greater than that in the Nation but slightly under that in the Plains, was not sustained; hence, Nebraska's share of both the National and Plain's PI flow dropped after …

Carbohydrate And Lipid Metabolism During Germination Of Uredospores Of Puccinia Graminis Tritici, J. M. Daly, H. W. Knoche, M. V. Wiese

Department of Biochemistry: Faculty Publications

Uredospores of Puccinia gramintis (Pers.) tritici (Eriks. and Henn.) were uniformly labeled with 14C by permitting the host (Triticuml aestivum L.) to carry out photosynthesis in 14CO2 during the process of spore production by the obligate parasite. The use of 14C labeled spores provided advantages in a study of the utilization of endogenous substrates at frequent intervals with small amounts of spores under conditions conducive to germination.

Antitrust And Its Critics, Walter Adams Jan 1967

Antitrust And Its Critics, Walter Adams

Nebraska Law Review

Antitrust strategy policy proposals share one common characteristic: they reveal a profound misconception of the rationale of antitrust and the role of competition as a regulatory device in a free economy. To explore the nature of this misconception is the purpose of the following article.

I. "The Antitrust Laws Should Attack Monopoly, Not Conspiracy"

II. "Antitrust Should Attack Bad Monopolies, Not All Monopolies"

III. Antitrust Should Attack Conspiracies, Not Mergers and Concentration

IV. Antitrust Should Be Abandoned Altogether because Conspiracy and Monopoly Are Creatures of the State. In the Absence of Government Interference, Trade Restraints Would Not and Could Not …

Solicitation By An Interstate Carrier—Is It Doing Business?, William D. Sutter Jr. Jan 1967

Solicitation By An Interstate Carrier—Is It Doing Business?, William D. Sutter Jr.

Nebraska Law Review

Today, it is a generally well-recognized principle that if a foreign corporation is doing business within a state it is subject to the in personam jurisdiction of that state. The law has, however, had much difficulty in defining the term "doing business." In the case of International Shoe v. State of Washington, the Supreme Court abandoned the doing business test in favor of a test of "minimum contacts" and "fair play and substantial justice." This new test has done little to solve the dilemma, and consequently most states still adhere to the old "doing business" concepts. Nowhere is the …

Antitrust Standards For 1975, J. Fred Weston Jan 1967

Antitrust Standards For 1975, J. Fred Weston

Nebraska Law Review

The formulation of standards for antitrust policy has long been an important goal of researchers in the field of industrial organization. This paper seeks to pursue its objective of a consideration of the formulation of standards for antitrust policy with reference to their future implications by analysis of four areas. First, the main outlines of the characteristics of the economy of 1975 are set forth. Second, the objectives of antitrust policy are reconsidered, reformulated, and restated. Third, propositions about the structure and behavior of industries in the economy are considered. Fourth, the implications of the foregoing background materials are related …

Post Conviction Remedies, Dennis C. Karnopp Jan 1967

Post Conviction Remedies, Dennis C. Karnopp

Nebraska Law Review

Federal habeas corpus relief first became available to state prisoners in 1867, when the Judiciary Act, which originally applied only to federal prisoners, was amended. Historically, habeas corpus inquiry had been restricted to the question of whether the convicting tribunal had jurisdiction over the person of the defendant and the subject matter of the offense. However, the scope of the federal writ has been gradually expanded until it is now used to test the constitutional validity of a conviction. At the same time, the Supreme Court has placed several limitations upon the availability of federal habeas corpus to state prisoners. …

Criminal Law—Credit For Time Served Denied: State V. King, 180 Neb. 631, 144 N.W.2d 438 (1966), Jarret C. Oeltjen

Nebraska Law Review

Although one of the main theories comprising the rationale behind any type of punishment is deterrence, rulings and holdings such as that in the State v. King case put the idea of deterrence to a new and unjustifiable application—to deter convicts from consuming the state's time and money as well as clogging the courts. Such an application presents a dual inquiry: (1) Is additional punishment the proper instrument to be used as the means to achieve the desired end, and (2) does the state have any interest in the likely actual result, namely the preservation of erroneous judgments? Regardless of …

Traps For The Unwary—The Problems In Seeking Injunctive Or Monetary Relief From An Uncompensated Taking By The Federal Government, David R. Warner Jr. Jan 1967

Traps For The Unwary—The Problems In Seeking Injunctive Or Monetary Relief From An Uncompensated Taking By The Federal Government, David R. Warner Jr.

Nebraska Law Review

The fifth amendment to the United States Constitution provides that "[P]rivate property [shall not] be taken for public use, without just compensation." On the not too frequent occasions when the federal government fails to adhere to this directive, there are two remedies available—a suit against federal officials to enjoin them from acting to the property owner's detriment, or a suit for damages (commonly referred to as inverse condemnation). The lawyer for the property owner who has found it necessary to seek one of these remedies will soon discover that the government has available a large battery of defenses and other …

An Academic Lawyer Plays Armchair Analyst: Some Speculations On The Relevance Of Psychoanalysis To The Law, Leonard V. Kaplan Jan 1967

An Academic Lawyer Plays Armchair Analyst: Some Speculations On The Relevance Of Psychoanalysis To The Law, Leonard V. Kaplan

Nebraska Law Review

The purpose of this paper is to briefly analyze two levels of potential and actual interrelationship between psychoanalytic insights and legal working. The first is psychoanalysis as a total philosophy of man, descriptive of man and all his institutions including legal ones; the second is psychoanalysis as a tool for the law where legal institutions seek for value reasons to intervene in a particular situation where the psychology of an individual(s) is at issue. The latter use of psychological theorems and methods covers the legal spectrum from cases of "undue influence" in wills to questions of "mens rea" in criminal, …

Probate Jurisdiction Problems, Kent E. Person Jan 1967

Probate Jurisdiction Problems, Kent E. Person

Nebraska Law Review

Probate law is currently undergoing considerable nationwide study and change. Many states have recently revised their probate law. The American Bar Association in conjunction with the National Conference of Commissioners on Uniform State Laws has considered drafting a Uniform Probate Code in order to resolve some of the current problems in administration of estates. One of the basic aims of the reform has been to remedy the waste and delay caused by inefficient probate procedure. The problem in Nebraska is a result of the county court, which is the probate court, lacking general and equitable jurisdiction. Because the county court …

Problems In Drafting And Administering Discretionary Trusts, Richard R. Endacott Jan 1967

Problems In Drafting And Administering Discretionary Trusts, Richard R. Endacott

Nebraska Law Review

A discretionary trust is one which gives the trustee the authority to exercise his own judgment in applying certain provisions contained in the trust instrument. Discretionary provisions are most prevalent in regard to the trustee's authority as to time, manner, amount, or circumstances of payment of income or principal to certain beneficiaries. The practical problems involved in drafting and administering such trusts too frequently are given insufficient consideration. Perhaps the most difficult problem connected with discretionary trusts is that of communicating the settlor's true intentions from settlor to draftsman to trustee. This article examines the meanings of the most common …

Ticks In Relation To Human Diseases Caused By Rickettsia Species, Harry Hoogstraal Jan 1967

Ticks In Relation To Human Diseases Caused By Rickettsia Species, Harry Hoogstraal

United States Navy: Publications

Rickettsiae (185) are obligate intracellular parasites that multiply by binary fission in the cells of both vertebrate and invertebrate hosts. They are pleomorphic coccobacillary bodies with complex cell walls containing muramic acid, and internal structures composed of ribonucleic and deoxyri bonucleic acids. Rickettsiae show independent metabolic activity with amino acids and intermediate carbohydrates as substrates, and are very susceptible to tetracyclines as well as to other antibiotics. They may be considered as fastidious bacteria whose major unique character is their obligate intracellu lar life, although there is at least one exception to this. In appearance, they range from coccoid forms …

Adsorption Of Free Fatty Acids On Cells Of Certain Microorganisms, R. B. Maxcy, C. W. Dill Jan 1967

Adsorption Of Free Fatty Acids On Cells Of Certain Microorganisms, R. B. Maxcy, C. W. Dill

Department of Food Science and Technology: Faculty Publications

Information on the inhibitory effect of free fatty acids was sought by growing lactic streptococci in the presence of labeled fatty acids and collecting the cells on membrane filters. The distribution of the radioactivity indicated adsorption by the bacteria. As the number of cells in the growth medium increased, accumulation of radioactivity with the cells on the filter increased. The cells accumulated less than one-tenth as much radioactivity from sodium butyrate as from lauric acid. Washing the cells on the filter with water decreased radioactivity. More complete elution of the radioactivity was obtained by filtering the mixture after it was …

The Rights Of A Public Employee In Nebraska, William E. Marsh Dec 1966

The Rights Of A Public Employee In Nebraska, William E. Marsh

Nebraska Law Review

In Local 507, IBEW v. Hastings, the Nebraska Supreme Court has followed the majority rule in declaring that governmental employees do not have collective bargaining rights in the same sense that their counterparts in private enterprise have. The legislative aftermath of this decision became one of the most contested issues of the 1967 unicameral session. The specific rights governmental employees and employee organizations possess after the Hastings decision and the new legislation, as well as the generally expanding role of government in our society, compel a reexamination of the status of the governmental employee.
