In 1932, the Rockefeller family commissioned Diego Rivera to paint an enormous mural as the centerpiece of the RCA Building lobby in Rockefeller Center in New York City. The colorful mural that Rivera painted, titled Man at the Crossroads, included images of social, political, industrial, and scientific visions of contemporary society. One night in February of 1934, the Rockefellers hired workers to chisel the mural off the wall without any warning or notice. The mural was broken into pieces before being carted away and dumped. The destruction of his mural shocked Rivera. More importantly, however, the destruction of Rivera’s mural …

An Assessment Of The Resort Tax: Collections And Usage In Montana Communities, Kara Grau
An Assessment Of The Resort Tax: Collections And Usage In Montana Communities, Kara Grau
Institute for Tourism and Recreation Research Publications
This report focuses on ten Montana communities that have been designated resort areas by the Montana Department of Commerce and voters in those communities have approved a local Resort Tax. The Resort Tax, according to state statute, cannot exceed three percent, and can be collected on luxury items and on goods and services sold at establishments that cater to travelers, such as hotels and restaurants. The intent of the Resort Tax is to provide revenue to aid the communities in maintenance or improvements to infrastructure as well as having the potential to fund other community improvements or programs. Resort tax …

National Wildlife Federation V. National Marine Fisheries Service, Jacob R. Schwaller
Public Land & Resources Law Review
The tide in the legal battle surrounding anadromous fish protections in the Columbia River watershed most recently swung in favor of the fish. In the latest iteration of National Wildlife Federation v. National Marine Fisheries Service, the Court found in a lengthy opinion that NOAA fisheries acted arbitrarily and capriciously when it issued its 2014 BiOp concluding that the FCRPS did not violate the ESA. The Court also ruled that the Corps violated NEPA by failing to prepare an environmental impact statement in connection with their records of decision implementing reasonable and prudent alternatives in the BiOp. This decision could …

These data were collected in the northern-most reaches of the Andes Mountains in the Piedras Blancas páramo, Sierra de La Culata National Park, Venezuela, during January-March 2014 (dry season). Sites were located in the high Andean páramo (superpáramo), between 4250m-4350m, with slopes of 15-25 degrees, and on northeast facing aspects. We sampled three sites in a 5 km area: Rio Azul (8.8866, -70.8685), Avenida (8.8847, -70.8666), and Gloria (8.8928, -70.8714). Life in this region is subject to harsh and dynamic tropical alpine conditions. This region is the driest in Venezuela’s high alpine, with an annual precipitation of 860 mm (Pico …

Volatile organic compounds (VOCs) emitted from residential wood and crop residue burning were measured in Colorado, U.S. When compared to the emissions from crop burning, residential wood burning exhibited markedly lower concentrations of acetonitrile, a commonly used biomass burning tracer. For both herbaceous and arboraceous fuels, the emissions of nitrogen-containing VOCs (NVOCs) strongly depend on the fuel nitrogen content; therefore, low NVOC emissions from residential wood burning result from the combustion of low-nitrogen fuel. Consequently, the emissions of compounds hazardous to human health, such as HNCO and HCN, and the formation of secondary pollutants, such as ozone generated by NOx, …

NMDA receptors mediate excitatory synaptic transmission and regulate synaptic plasticity in the central nervous system, but their dysregulation is also implicated in numerous brain disorders. Here, we describe GluN2A-selective negative allosteric modulators (NAMs) that inhibit NMDA receptors by stabilizing the apo state of the GluN1 ligand-binding domain (LBD), which is incapable of triggering channel gating. We describe structural determinants of NAM binding in crystal structures of the GluN1/2A LBD heterodimer, and analyses of NAM-bound LBD structures corresponding to active and inhibited receptor states reveal a molecular switch in the modulatory binding site that mediate the allosteric inhibition. NAM binding causes …

The Nepal Ambient Monitoring and Source Testing Experiment (NAMaSTE) campaign took place in and around the Kathmandu Valley and in the Indo-Gangetic Plain (IGP) of southern Nepal during April 2015. The source characterization phase targeted numerous important but undersampled (and often inefficient) combustion sources that are widespread in the developing world such as cooking with a variety of stoves and solid fuels, brick kilns, open burning of municipal solid waste (a.k.a. trash or garbage burning), crop residue burning, generators, irrigation pumps, and motorcycles. NAMaSTE produced the first, or rare, measurements of aerosol optical properties, aerosol mass, and detailed trace gas …

United States Army Corps Of Engineers V. Hawkes Co., Jonah Brown
United States Army Corps Of Engineers V. Hawkes Co., Jonah Brown
Public Land & Resources Law Review
When landowners seek to determine if a permit is required from the Army Corps of Engineers to discharge dredged or fill material into waters within their property boundaries, they may first obtain a jurisdictional determination specifying whether “waters of the United States” are present. In an 8-0 judgment, Army Corps of Engineers v. Hawkes was a victory for landowners, concluding that an approved jurisdictional determination is a final agency action reviewable under the Administrative Procedure Act.
