Truth, Lies, And Copyright, Cathay Y. N. Smith

Faculty Law Review Articles

Fake news may be trending right now, but fake news is not the only source of fake facts that we consume. We encounter fake facts every day in the historical or biographical books we read, the movies we watch, the maps we study, the tele-phone directories and dictionaries we reference, and the religious or spiritual guides we consult. While it is well-established that copyright does not protect facts because facts are discovered rather than created, fake facts are created and can often be as original and creative as fiction.

This Article is the first to offer a comprehensive analysis of …

Assessing The Effects Of Culling As A Management Tool For Urban Mule Deer Populations, Hamilton Q. Platt Apr 2019

Assessing The Effects Of Culling As A Management Tool For Urban Mule Deer Populations, Hamilton Q. Platt

University of Montana Conference on Undergraduate Research (UMCUR)

Cities and towns are expanding across the western United States into historic areas of wildlife habitat. Many species such as white-tailed deer, mule deer, and even elk are adapting to effectively live alongside humans in urban areas. However, animals and humans living in close proximity often creates problems with public safety as animals can become aggressive to people or damage property. Our study looks at how the City of Helena, Montana is managing a population of overabundant urban mule deer (Odocoileus hemionus) using culling in order to reduce population density. We used distance sampling data to determine that the population …

Dna Integrity In Forensic Samples, Samantha L. Ramey Jan 2019

Dna Integrity In Forensic Samples, Samantha L. Ramey

Graduate Student Theses, Dissertations, & Professional Papers

When packaged genetic evidence samples are stored in close proximity, there is a higher chance for cross-contamination, which can lead to potential false results. The goal of this study was to test DNA storage methods and environments to determine the best way to avoid potential cross-contamination. Established protocols for storing different types of genetic evidence samples were evaluated: biological swabs and DNA cards. A known concentration of pig DNA was introduced to the evidence samples. Three different evidence drying times of the DNA-free swabs and cards were implemented before packaging: immediate packaging, an hour drying, and 24 hours drying. The …

Decisions Leading To Inequalities In The Juvenile Justice System: Using Data To Predict Delinquent Outcomes, Inform Decisions, And Reduce Disparities For Justice-Involved Youth, Patrick David Mckay

Graduate Student Theses, Dissertations, & Professional Papers

This dissertation focuses on how decisions are made in the juvenile justice system and what strategies can be used to make more informed decisions in the future, in three separate investigations. (1) To begin, eight years of initial detention decisions (N=26,128) were collected to determine what factors affect the arresting officers’ decision to detain youth at arrest. Findings reveal that the severity of current offense and prior offending history are the greatest predictors of initial detention. However, results demonstrate that race and the distance from a detention facility also influence these decisions. Non-white youth are more likely detained than their …

Measuring Recidivism Risk Outcomes: A Pilot Project In Collaboration With The Flathead Reservation Reentry Program, Desiree Lacy Fox Jan 2019

Measuring Recidivism Risk Outcomes: A Pilot Project In Collaboration With The Flathead Reservation Reentry Program, Desiree Lacy Fox

Graduate Student Theses, Dissertations, & Professional Papers

Background: Native Americans have suffered from vast losses of land, traditional ways and practices, language, and ability to pass on traditional knowledge; and those losses have led to current day health and wellness disparities, as well as small but tangibly different tribal populations. While Native Americans make up a disproportionate number of those involved in the criminal justice system, creating an overrepresentation of Native Americans incarcerated in jails and prisons relative to their overall population size, they still tend to be underrepresented in the creation of validated recidivism measures. Risk assessment tools, such as the Level of Service Index-Revised (LSI-R), …

Constructing Distance, Responsibility, And Memory Management Theories: An Anthropological Approach To Death Notification Interactions, Teresa Ann 'Lilly' White Jan 2019

Constructing Distance, Responsibility, And Memory Management Theories: An Anthropological Approach To Death Notification Interactions, Teresa Ann 'Lilly' White

Graduate Student Theses, Dissertations, & Professional Papers

Following a sudden or unexpected death, coroners often communicate the death to the next-of-kin. Death notifications may occur in hospitals, assisted living or dying facilities, homes, offices or workplaces, correctional facilities, schools, or other locations. A death notification has been perceived by outsiders and many researchers as a one-time, unilateral death-telling event. I argue, instead, death notifications are a series of social interactions and processes necessitating multiple actors and mechanisms. The death notification processes begin for the coroner when they are dispatched to a death scene, while the processes begin for the next-of-kin upon the death-telling event. The end is …

Finding Home After Fallout: The Future Of Fukushima's Forests, Katy N. Spence Jan 2018

Finding Home After Fallout: The Future Of Fukushima's Forests, Katy N. Spence

Graduate Student Theses, Dissertations, & Professional Papers

This long-form journalistic piece is about radioactive forests in Yamakiya, Fukushima Prefecture, Japan, and how locals are dealing with it. Residents of Yamakiya were forced to evacuate their village in April 2011 following an explosion at the Fukushima Daiichi nuclear plant.

One Yamakiyan, Hidekatsu Ouchi, stepped into the role of community leader and is the focus of this story. He hopes Yamakiya can use the radiation, rather than condemning it. Ouchi’s devotion to his community is connected to the Japanese concept of furusato, which refers to an individual’s obligation and nostalgia for family, community and place. The story asserts …

Risk And Resiliency Factors In Predicting Recidivism Among Native Americans On A Montana Reservation, Ciara Dawn Hansen Jan 2018

Risk And Resiliency Factors In Predicting Recidivism Among Native Americans On A Montana Reservation, Ciara Dawn Hansen

Graduate Student Theses, Dissertations, & Professional Papers

Background: According to a 2014 report, approximately 1 in 100 American adults are incarcerated, which represents a 500% increase over the past 40 years and accounts for the largest population of prisoners in the world. Despite research that suggests incarceration is not an effective deterrent for crime, incarceration continues to increase at a historically unprecedented rate. Mass incarceration disproportionately affects communities of color. In Montana, Native Americans are overrepresented at all levels of the correctional system. In addition, Native American ex-offenders are just over twice as likely as non-Native Americans to recidivate and be returned to a correctional institution, mostly …
