Corn is intensively grown along the Green and Pond Rivers in McLean, Hopkins, and Webster Counties, Kentucky, representing a major source of income to producers in those areas. However, producers in McLean County have experienced poorer corn production than expected for many years. This has been observed more on the Pond River bottoms and the Green River bottoms below the confluence of the Pond than upstream on the Green above the Pond. Some producers have speculated that their poor production may be associated with chemical pollution from the Pond River and/or nearby industrial sources. On this basis, an assumption was …

Last term, for the first time since its watershed decision in Philadelphia v. New Jersey, the Supreme Court considered the extent to which the Commerce Clause of the United States Constitution constrains a state's ability to regulate the disposal of hazardous and solid waste within its borders. In two cases, Chemical Waste Management, Inc. v. Hunt and Fort Gratiot Sanitary Landfill, Inc. v. Michigan Department of Natural Resources, the Supreme Court acted to limit substantially states’ ability to respond independently to the crisis of solid and hazardous waste disposal. Kentucky Alfalfa and Stored Forage Conference
Forages in Kentucky have been valued at over $700 million annually. This figure combines receipts from cash hay sales to indirect value from the portion of beef, dairy, sheep, and horse receipts that are attributable to pasture and stored forages. However, the key to the maintaining and even increasing the value of forages to Kentucky lies in Quality: A) Quality of seed B) Quality as it relates to sales, and C) Quality as it relates to the animal.

Detection Method For Liquids Using Near Infrared Spectra, Leonard J. Galante, Robert A. Lodder
Pharmaceutical Sciences Faculty Patents
A method for detecting the presence or absence of microorganisms in a liquid test sample is provided without need for withdrawing an aliquot or destroying the sample. The method comprises taking near-infrared spectra of the sample and comparing it visually or mathematically to the spectra of a standard, which may be the values of the spectra known to the operator or may be a standard sample that is provided and run side-by-side.

Oral Contraceptives And Reproductive Cancers: Weighing The Risks And Benefits, Ann L. Coker, Susan Harlap, Judith A. Fortney

The hypothetical incidence of reproductive cancers resulting from oral contraceptive use was estimated in several models comparing the cumulative lifetime incidence of cancer of the breast, cervix, ovary and endometrium expected in pill users with the incidence expected in nonusers. The potential number of cancer-free days that would be gained or lost by pill users was com- pared with similar estimates among nonusers. If five years or more of pill use were associated with a 20% increase in the risk of breast cancerbeing diagnosed before age 50, a 20% increase in cervical cancer risk and a 50% reduction in the …

This study was undertaken to address the removal and closure of defective petroleum underground storage tanks in Kentucky. Goals for the study included:
- To address standards for levels of contamination requiring corrective action consistent with accepted scientific and technical principles.
- To recommend a matrix or scoring system to be used for (a) ranking sites as to actual or potential harm to human health and the environment caused by release of petroleum from a petroleum storage tank, and (2) establishing standards and procedures for corrective action that shall adequately protect human health and the environment.

The present trend of animal and dairy product producers is toward total confinement facilities and larger animal herds. Generally the rewards to the producer for these practices are higher economic returns which result from higher feeding efficiencies and better quality products. However, total confinement is not without problems that were previously not present or were minimal in nature when animals were maintained in fields. Confinement facilities have a greater impact on environmental quality of both water and air. Presently, one of the major problems facing animal and dairy product producers is odor production. In recent years, the number of laws and regulations prescribing the rules for everyday life seem to be ever more complex and pervasive. Changing farming methods, expansion of the urban community and increasing public environmental concerns have increased the agricultural producer's need to think more seriously about his method of livestock waste disposal. Proper management and utilization of livestock waste can be a significant contribution to the economic well being of a livestock enterprise, since the wastes have considerable economic value if properly utilized. When returned to the soil as fertilize or soil conditioner, the value as a nutrient source has been will established. More recently, processed livestock wastes have been utilized as a high protein feed additives. Livestock waste should be considered a resource to be utilized rather than a disposal problem.

The Impact Of The Cipollone Case On Federal Preemption Law, Richard C. Ausness

The United States Supreme Court handed down an opinion in the Cipollone case on June 24, 1992. Justice Stevens, writing for the majority, concluded that the Federal Cigarette Labeling and Advertising Act preempted all tort claims against cigarette manufacturers based on failure to provide adequate warnings about the health risks of smoking. However, the Court also held that claims based on breach of express warranty, misrepresentation, and conspiracy were not preempted by the Act. Thus, although Cipollone represents a clear victory for tobacco companies, it also leaves the door open for future litigation. The first part of this Article will …

About 3.7 million people live in Kentucky, of which 1.9 million (52 percent) live in urban areas (roughly defined as any community with 2,500 or more people) and 1.8 million (48 percent) live in rural areas (University of Kentucky, 1993). Figure 1 summarizes sources of drinking water for Kentucky residents. About 70 percent of Kentuckians get their daily supply of water from surface-water sources - lakes and streams; about 25 percent get their water from ground-water wells; and about 5 percent get their water from other sources - springs, cisterns, ponds, or hauled water.

The purpose of this study was to assist the Department of Highways in conducting bridge-painting operations involving removal of existing lead-based paint. Pertinent state and Federal regulations affecting generation of hazardous wastes, limiting environmental pollution and protecting public and worker safety were obtained and reviewed.State highway agendas were surveyed relative to how they conducted maintenance bridge painting involving lead-based. paints and comply with applicable regulations. Information from the painting industry related to sale removal of lead-based paints was also reviewed.
