Tort Liability For Asbestos Removal Costs, Richard C. Ausness Jan 1994

Tort Liability For Asbestos Removal Costs, Richard C. Ausness

Law Faculty Scholarly Articles

During the past twenty years, Congress and the general public have become increasingly aware of the health hazards caused by exposure to toxic substances. Consequently, Congress has enacted statutes, such as CERCLA, requiring parties who are responsible for toxic waste to clean up the toxic waste sites and to reduce the level of toxic chemicals in the environment. Asbestos is one toxic substance that government has targeted in particular. The federal government and many states have enacted laws requiring asbestos-containing materials to be segregated or removed from schools and public buildings.

Even when government regulations do not mandate specific abatement …

Chemical And Statistical Analysis Of A Sampled Interval In The Camp Nelson Limestone (Upper Ordovician) Madison County, Central Kentucky, Garland R. Dever Jr., Warren H. Anderson, Henry E. Francis, O. Barton Davidson, Mark F. Thompson

Information Circular--KGS

The Camp Nelson Limestone of the High Bridge Group (Upper Ordovician) is mined at seven sites in central and north-central Kentucky for industrial, construction, and agricultural uses. As part of a regional investigation of its chemical characteristics, a 67-foot section in the upper Camp Nelson, which is being mined at Boonesborough, Madison County, was sampled for major-element analysis.

The upper Camp Nelson in the Boonesborough Mine consists of two zones (23 and 30 feet thick) of low-silica stone (4 percent or less total SiO2) separated by a 14-foot section of slightly argillaceous limestone with an average silica content …

Frequency Of Mug Negative Escherichia Coli In Kentucky Groundwater Samples, Mark S. Coyne, J. C. Shuler Jan 1994

Frequency Of Mug Negative Escherichia Coli In Kentucky Groundwater Samples, Mark S. Coyne, J. C. Shuler

Plant and Soil Sciences Faculty Publications

MUG negative Escherichia coli are a small fraction (2.5%) of the total E. coli in Kentucky groundwater samples. It is unlikely that they alone will cause a significant potential to underestimate fecal contamination using MUG as the primary criterion for that assessment. An unresolved question is how effectively MUG-based, defined-substrate tests address false negative water samples containing MUG positive E. coli.

Ground Water In The Kentucky River Basin, Daniel I. Carey, James C. Currens, James S. Dinger, James A. Kipp, David R. Wunsch, Philip G. Conrad Jan 1994

Ground Water In The Kentucky River Basin, Daniel I. Carey, James C. Currens, James S. Dinger, James A. Kipp, David R. Wunsch, Philip G. Conrad

Information Circular--KGS

Most private wells in the Kentucky River Basin are in unconfined or semi-confined bedrock aquifers. Within these aquifers, high-yield zones are irregularly distributed. The most productive wells are drilled into fractured bedrock and alluvium along the Kentucky River floodplain. The data indicate that ground water acts as a buffer to peak and low flows in Kentucky River Basin streams. At current withdrawal rates, ground-water usage does not seem to have an adverse impact on the Kentucky River. Privately owned ground-water sources supply approximately 135,000 people living in the basin-approximately 19 percent of the total population and 36 percent of the …

“Endgame”: Competency And The Execution Of Condemned Inmates—A Proposal To Satisfy The Eighth Amendment's Prohibition Against The Infliction Of Cruel And Unusual Punishment, Roberta M. Harding

Law Faculty Scholarly Articles

The first section of this Article provides a brief historical overview of the proscription against executing the incompetent and the proffered rationales. This section also examines key factors contributing to the increase in the number of mentally dysfunctional condemned inmates. Then the Article explores the traditional competency-to-execute model that remains in use. This analysis will include a discussion of specific issues, such as: the term used to describe the requisite mental affliction, how that term is defined in order to identify who may ultimately benefit from the rule in Ford v. Wainwright, what standard is appropriate to determine whether …

Individual And Institutional Responsibility: A Vision For Comparative Fault In Products Liability, Mary J. Davis Jan 1994

Individual And Institutional Responsibility: A Vision For Comparative Fault In Products Liability, Mary J. Davis

Law Faculty Scholarly Articles

Since the adoption of strict products liability over the last thirty years, two problems of scope have received the most attention: how to define product defectiveness to which the liability attaches, and how to limit the potentially limitless liability through defenses. Much like the industries of the nineteenth century, product liability defendants of the twentieth century turned to the plaintiff's conduct as a main line of defense. Blaming the victim has historically been a powerful tool for tort defendants to evade responsibility for their conduct. This Article proposes that the defenses based on victim fault that have evolved in our …

Enhanced Immunogenicity Of Protein-Dextran Conjugates: I. Rapid Stimulation Of Enhanced Antibody Responses To Poorly Immunogenic Molecules, Andrew Lees, Fred Finkelman, John K. Inman, Kim Witherspoon, Penny Johnson, Jasiri Kennedy, James J. Mond Jan 1994

Enhanced Immunogenicity Of Protein-Dextran Conjugates: I. Rapid Stimulation Of Enhanced Antibody Responses To Poorly Immunogenic Molecules, Andrew Lees, Fred Finkelman, John K. Inman, Kim Witherspoon, Penny Johnson, Jasiri Kennedy, James J. Mond

Microbiology, Immunology, and Molecular Genetics Faculty Publications

In view of our observation that anti-immunoglobulin antibody conjugated to high-molecular-weight dextran stimulates high levels of B-cell activation (Brunswick et al. J. Immunol . 1989, 143, 1239), we coupled T cell-dependent antigens to dextran. When mice were immunized, in the absence of adjuvant, with a BSA-dextran conjugate (BSA-dex), a persistent, high-titre anti-BSA IgG1 response was induced. Titres were dose-dependent and seen with as little as 10 I~g of conjugated protein. Anti-BSA titres were detected as early as day 7, usually peaked at about day 14 and persisted for at least 4 weeks. Anti-hapten antibodies were also elicited in mice that …

Survey Of The Impacts Of Environmental Regulations On State Highway Operations, Theodore Hopwood Ii, Christopher M. Oberst Oct 1993

Survey Of The Impacts Of Environmental Regulations On State Highway Operations, Theodore Hopwood Ii, Christopher M. Oberst

Kentucky Transportation Center Research Report

In recent years, the transportation industry in Kentucky as represented by Kentuckians for Better Transportation (KBT) and the Kentucky Transportation Cabinet (KyTC), have expressed concern over the growing impact of environmental regulations upon transportation activities in the state. The imposition of environmental regulations has resulted in higher costs for new construction and maintenance on roads, project delays, scheduling and financing difficulties, and the creation of additional transportation agency bureaucracy to address environmental regulation mandates. In Kentucky, the impacts of those regulations have not been thoroughly assessed nor have the attendant costs been measured. Coinciding with that lack of information is …

Chloroform Contamination In The Louisville Aquifer: An Investigation Of Its Occurrence And Propagation, Sergio E. Serrano Sep 1993

Chloroform Contamination In The Louisville Aquifer: An Investigation Of Its Occurrence And Propagation, Sergio E. Serrano

KWRRI Research Reports

This report presents the main results of an investigation on the nature and propagation of an accidental spill of chloroform in the Louisville aquifer, Kentucky. Much of the effort is concentrated on the development of mathematical models to either reconstruct the history of evolution of the plume, or forecast its propagation in the future. Chloroform is a dense halogenated solvent which exhibits a special migration pattern in porous media: Because of this and the relative absence of a conceptual theory on its hydrodynamics in porous media, meaningful predictive models will have to deal with many unresolved theoretical aspects of contaminant …

Evaluation Of The Lexington-Fayette County Safety Belt Ordinance, Kenneth R. Agent Sep 1993

Evaluation Of The Lexington-Fayette County Safety Belt Ordinance, Kenneth R. Agent

Kentucky Transportation Center Research Report

A mandatory safety belt ordinance was enacted in Fayette County with an effective date of July 1, 1990. One objective of this study was to conduct usage surveys after the ordinance had been in effect for approximately three years. This would allow comparisons to be made of safety belt usage before and immediately after the effective date of the ordinance to that found a substantial time period after enactment of the ordinance. A second objective of the study was to compere accident data before and after the ordinance became effective. The would allow an analysis of the effect the ordinance …

Reversal Of Age-Associated Decline In Immune Response To Pnu-Imune Vaccine By Supplementation With The Steroid Hormone Dehydroepiandrosterone, Manju Garg, Subbarao Bondada May 1993

Reversal Of Age-Associated Decline In Immune Response To Pnu-Imune Vaccine By Supplementation With The Steroid Hormone Dehydroepiandrosterone, Manju Garg, Subbarao Bondada

Microbiology, Immunology, and Molecular Genetics Faculty Publications

Recently, we reported that murine antibody responses to the 23-valent pneumococcal polysaccharide (Pnu-Imune) vaccine declined with age. Here we present data to support the concept that age-associated immune defects are not only due to intrinsic defects in immune cells but are also due to extrinsic factors emanating from the neuroendocrine system. We found that supplementation with dehydroepiandrosterone, a steroid hormone known to be reduced in the aged, corrects the immune deficiency of aged mice and significantly enhanced their splenic immune responses to the Pnu-Imune vaccine.
