In Lucas v. South Carolina Coastal Council, the United Supreme Court was forced once again to delve into the law of regulatory takings. This experience is seldom a pleasant one. Echoing the poet John Milton, an exasperated state court judge once described takings law as a “Serbonian Bog.” Unfortunately, the takings doctrine is only slightly more comprehensible after the Lucas decision than it was before. Nevertheless, progress in this area, however modest, deserves praise, and the Court is to be commended for clarifying one aspect of takings jurisprudence. This Article examines the role courts play under the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”) in cleaning up releases of hazardous substances. Congress intended the courts to have an important role in implementing the cleanup process-particularly in defining the scope of liability for CERCLA cleanups. But Congress also included a broadly-worded provision that forecloses federal judicial review of CERCLA cleanups unless the review action falls within several narrowly-defined exceptions.
Notwithstanding the terms of the provision foreclosing review, litigants have turned to the courts, asserting that immediate review should be available in cases beyond those exceptional proceedings. Those asserting …

The Jefferson Family Court's custody mediation service was developed as part of a larger program creating the first family court system in Kentucky. The mediation service's connection with the Family Court has influenced both practical and policy aspects of its development. Any description of the mediation project necessarily entails some description of the court system that created it.
This Article describes the structure of the Jefferson Family Court and the custody mediation process as it has developed in Jefferson County. A review of one community's approach to custody mediation may be useful not only as a blueprint for a system's …

Federal agencies now regulate the manufacture, design, and labeling of hundreds of consumer products. For example, the Consumer Product Safety Commission promulgates "consumer product safety standards" for a number of consumer products. Likewise, the National Traffic and Motor Vehicle Safety Act of 1966 authorizes the National Highway Transportation Safety Administration to develop safety standards for automobiles and other motor vehicles. Additionally, the Food and Drug Administration (FDA) exercises extensive control over prescription drugs, biologics, medical devices, and over-the-counter drugs. The FDA also regulates food labeling.6 Finally, Congress has established statutory labeling requirements for cigarettes, smokeless tobacco products, and alcoholic beverages. …

Responsibility for the consequences of our own actions and occasionally for the actions of others seems to have been largely forgotten as a foundation for governing conduct. This Article advocates re-emphasizing responsibility in one important area, that of manufacturer liability for product design. To that end, the author proposes the highest standard of conduct by which to judge product manufacturers' design decisions. The standard proposed in this Article is higher than merely reasonable, prudent conduct and is not the allegedly "strict" liability frequently imposed. Method And Apparatus For Detecting Microorganisms Within A Liquid Product In A Sealed Vial, Robert A. Lodder

An apparatus and method are provided for the noninvasive and nondestructive detection of microorganisms within a liquid product contained within a sealed vial. The apparatus includes a near-IR light source that produces both incident and reference beams having a wavelength between 800 and 2500 nm and, more preferably, 1100 and 1360 nm. The apparatus also includes an integrating sphere having incident and reference beam ports and a sample window opposite the incident beam port. A detector is mounted in the integrating sphere substantially adjacent the sample window. A substantially U-shaped mirror is provided to hold the vial. The U-shaped mirror …

Pharmaceutical compositions and methods of inhibiting the enzyme elastase and increasing the biological half-life and/or potency in terms of inhibitory activity of the enzyme elastase of peptide compounds is achieved by use of a polymer of the formula P--(L--R)q wherein P is a polymer containing at least one unit of the formula (An Bn) wherein An Bn is substantially nonbiodegradable, and has an average molecular weight of about 1,000 to 5,000 daltons, L is a covalent bond or a linker group and R is a peptide.

Biodegradable Microspheres As A Carrier For Macromolecules, Patrick P. Deluca, Frantisek Rypacek

A method for preparing biodegradable microspheres having a three-dimensional network in which biologically active macromolecular agents are physically entrapped therein. The microsphere is able to degrade and release the macromolecular agent at a controlled rate. The method involves emulsifying a vinyl derivative of a biodegradable hydrophilic polymer, a water-soluble monovinyl monomer and a biologically active macromolecule in water, and copolymerizing the biodegradable hydrophilic polymer and the water-soluble monovinyl monomer such that the biologically active macromolecule is entrapped therein.

Objective: To examine the literature for evidence that psychological factors predispose certain individuals to development of reflex sympathetic dystrophy (RSD).
Data Sources: English-language journal articles that described psychological data on patients diagnosed with RSD, identified through Medline search and bibliography reviews.
Study Selection: All studies reporting data on psychological factors in adult, adolescent, or child patients with RSD were included.
Data Extraction: We extracted data regarding psychological factors in patients with RSD and assessed validity of these studies through evaluation against seven basic research criteria.

Biomonitoring Study Of A Constructed Wetland Site Treating Acid Mine Drainage, Barbara A. Ramey, Howard G. Halverson, Linda A. Taylor

Acid mine drainage (AMD) from an underground coal mine in the Jones Branch watershed in McCreary County, KY, substantially reduced water quality in Jones Branch. Downstream from the mine seeps, the pH was routinely below 4.5 and concentrations of most heavy metals, especially iron, were elevated. A cattail wetland (1,022 m2) was constructed on Jones Branch in 1989 to obviate the effects of the AMD. Monthly chemical monitoring was performed on the water from above, from below, and from the 26 cells within the wetland. The characteristics of traffic accidents involving teenage (16 to 19 years of age) drivers are summarized in this report and compared to all accidents. This was accomplished through an analysis of statewide accident data for a three-year period (1989 through 1991). Counties having the highest overrepresentation of accidents involving teenage drivers were identified. The status of highway safety programs currently in place in school districts in Kentucky is presented. A survey was sent to 182 school districts in Kentucky with a 64 percent response rate obtained. A survey on current bridge painting practices was conducted. Questionnaires were sent to all 50 state highway agencies concerning their present bridge painting practices, changes in those practices that they anticipate due to environmental regulations, and new or experimental painting practices they are investigating. Forty-three responses were received. Those are collated and presented in the appendices along with comments of the responders.
A literature search was conducted on publications related to painting of steel structures (since 1987). Forty-nine documents were identified as being relevant to the topic. Those documents are listed in bibliographic form in the appendices.

Micro-Sprinkler And Fan Cooling For Dairy Cows: Practical Design Considerations, Larry W. Turner, Richard C. Warner, John P. Chastain

Research and on-farm demonstrations have shown that micro-sprinklers, spray jets and fan cooling systems can be effective in relieving heat stress in dairy cows under hot, humid conditions. Based on these results, many dairymen are considering installing sprinkler and fan cooling. Several Kentucky dairymen have already installed sprinkler cooling systems, but they could improve their performance by modifying them to take into account the principles involved and the components used in sprinkler and fan cooling.

A murine model system was established to study immune responses to the Pnu-Imune vaccine, which is made up of 23 different pneumococcal capsular polysaccharides. In this animal model, antibody-forming cell responses to 21 of 23 individual polysaccharides in the vaccine were detected. The Pnu-Imune vaccine elicited good antibody responses from the spleens and mesenteric lymph nodes (MLN) of young mice, whereas a variety of other peripheral lymph nodes were unresponsive. The immunoglobulin M plaque-forming cell (PFC) response in the spleen to the Pnu-Imune vaccine (given intraperitoneally or subcutaneously) decreased dramatically with increasing age.
