Modifying The Kentucky Rules Of Evidence—A Separation Of Powers Issue, Robert G. Lawson
Law Faculty Scholarly Articles
How do you modify laws that simultaneously exist as statutes and rules of court? For reasons that are described elsewhere and need not be repeated here, the Kentucky Rules of Evidence (K.R.E.) came into existence through concurrent enactment by the General Assembly and Kentucky Supreme Court and thus are endowed with all the attributes of both statutes and rules of court. So, how do you change them when the inevitable need to do so arises, a question made both interesting and difficult by the fact that there is no institutional mechanism for concurrent lawmaking by the General Assembly and supreme …

Evaluation Of Moisture Barriers For Fire Fighting Turnout Gear Assessment Of Product Failure And Test Method Development Predicting Failure Modes, Chastity Danielle Newsome
Theses and Dissertations--Retailing and Tourism Management
The purpose of this study was to investigate the failures seen in the moisture barrier of fire fighting turnout gear. Moisture barriers taken from garments in field were evaluated to establish a baseline for comparison. Moisture barriers were exposed as part of a three-piece ensemble and as a single layer moisture barrier to instrumental light exposure in a Carbon Arc Fade-ometer and natural sunlight exposure according to AATCC and ASTM test methods. After exposure, moisture barriers were visually examined using stereo and compound microscopes. A performance measurement was conducted on the exposed moisture barriers using a modified NFPA Hydrostatic Water …

Pharmacology and Nutritional Sciences Faculty Patents
Spin trapping compositions in general have now been discovered to be effective in treating a variety of disorders, including disorders such as those arising from ischemia, infection, inflammation, exposure to radiation or cytotoxic compounds, not just of the central and peripheral nervous systems but of peripheral organ disease having a wide variety of etiologies. In the preferred embodiment, the compositions for treating tissue damage from ischemia contain PBN, or active derivatives thereof, in a suitable pharmaceutical carrier for intravenous, oral, topical, or nasal/pulmonary administration. Other preferred spin-trapping agents include 5,5-dimethyl pyrroline N-oxide, (DMPO), α-(4-pyridyl-1-oxide)-N-tert-butylnitrone, (POBN), and (TEMPO) spin-trapping derivatives thereof. …

BACKGROUND: Epstein-Barr virus (EBV)-associated B-cell lymphomas occur more frequently in immunodeficient states such as organ transplantation and HIV infection. We have previously reported that B cell immortalization with EBV was promoted by cyclosporin A (CyA) and that curcumin (Cur), a natural phenol with known antioxidant and antitumor properties, blocked EBV-induced B cell immortalization. In the following experiments we show that Cur inhibits the proliferation of EBV-transformed lymphoblastoid cell lines (LCL) via enhanced apoptosis.
METHODS: LCL were generated by infecting freshly isolated human B cells with EBV (B95-8) for 12 h and coculturing with predetermined optimal concentrations of CyA (500 ng/ml) …

The effect of aeration on the production of xylanase by Trichoderma longibrachiatum on wheat bran in a solid-state fermentation (SSF) system has not been investigated. This study was conducted to investigate the interactive effects of aeration, initial moisture content of the substrate, and depth of the substrate on xylanase activity produced in a tray fermenter. The experiment was conducted as a split plot experiment with factorial treatments and three replications of each treatment combination. The whole plot treatment was aeration rate (0, 2.9, 5.7 L/min/kg bran). Initial moisture content (45, 55, 65% w.b.) and depth of substrate (1.0 and 2.5 …

Runoff of herbicides can promote adverse impacts in receiving waters. The objective of this study was to assess the effects of rainfall delay, herbicide application rate, rainfall intensity, and pre-application rainfall on runoff of TRIMEC (a combination of 2,4-D, dicamba, and mecoprop), a herbicide that is commonly used in central Kentucky. The levels of rainfall delay were 0, 2, and 4 d following application; and the levels of herbicide application rate were 0, 0.5, 1 and 2 times the recommended rate. Simulated rainfall was applied at intensities of 64, 102, and 140 mm h-1; and the depths of …

Economic Impact Of Heavy Loads On The Highway Infrastructure, Brad W. Rister, R. Clark Graves, David L. Allen
Economic Impact Of Heavy Loads On The Highway Infrastructure, Brad W. Rister, R. Clark Graves, David L. Allen
Kentucky Transportation Center Research Report
During the 1986 General Assembly the Extended-Weight Coal Haul Road System was created by the Kentucky State Legislature. This system was defined to include those highways where more than 50,000 tons of coal had been hauled during the previous year. Trucks hauling coal on the extended-weight system were authorized to exceed the normal weights limits through the payment of an annual decal fee.
In efforts to identify the benefactors of the extended coal haul system legislation, this study has been conducted to identify the overall economic impact of hauling heavier total gross weights by coal truck on the highway infrastructure …
