“Music metadata” is virtually any of type of content electronically embedded in a digital audio file and may include information that identifies various rightsholders of a copyrightable sound recording, such as producer(s) and performer(s). A standardized system for music metadata does not exist, and instead music industry stakeholders devote significant resources to maintain redundant and incongruent databases. As a result, licensees expend significant effort in tracking copyright holders and licensors risk inadequate protection and potential loss of royalties. This Comment evaluates the recently enacted laws in California and Colorado which require universities in those states to allow student-athletes to receive compensation for their name, image, or likeness. When California first introduced this legislation, there was intense pushback from many in the intercollegiate community. However, less than a year after the bill was enacted, the NCAA’s Board of Governors has committed to changing their bylaws in compliance with the law. This Comment will examine the many ways that courts struggle to balance the right of publicity and the First Amendment. The main issue is that docudramas are an intermediary production between movies and documentaries, and producers are claiming the protections that exist for those two mediums also protect their works. There has been only one Supreme Court case on the right of publicity. Since this ruling, however, lower courts have found that precedent to be too narrow and have decided cases individually. This has enabled courts to try docudrama right of publicity cases with a multitude of tests.

“How should student-athletes get paid?” This is the next big question in the intercollegiate sport industry. While the National Collegiate Athletic Association (NCAA) fights relentlessly to protect the amateurism of intercollegiate athletics, public pressure continues to mount for establishing a method of paying student-athletes beyond scholarships and educational expenses. There are two compensation methods frequently discussed by the media, fans and practitioners in the industry: 1) compensating student-athletes through the university, or 2) compensating student-athletes through their name, image and likeness (NIL).

Problematizing The Critical Dimensions Of Whiteness With Educational Leaders, Lerita Yvette Cavness

This action research examines whether and how whiteness is “weaponized” by a P-12 educational leader, the impact whiteness has on their identities, and whether engagement with Critical Whiteness Studies (CWS) will increase pro-equity behaviors. The research employs a layered mixed-methods approach, and a deductive analysis triangulation plan framed by the Critical Dimensions of Whiteness Model (CDWM). This N-of-1 case study included a four-phase intervention workshop series and one post interview. The findings identify how one educational leader engaged in the selfweaponization of whiteness. Many gamers prefer to play tabletop roleplaying games, or TTRPGs, in order to a) join a community, and b) tell a story collaboratively with friends and acquaintances. This thesis discusses selfhood-making, safe spaces, and allegory in imaginary worlds from the perspective of Erving Goff man’s frame analysis. It relies on a theoretical framework of imagined communities, the magic circle, and subcreation. This research culminated in the understanding that people play TTRPGs for a variety of reasons - collaborative storytelling and exercising critical thinking skills, but respondents overwhelmingly reported that they enjoyed the ability to socialize with friends and strangers, and …

This study examined the extent to which a gamified professional development platform can foster skill development, knowledge application, and engagement among members of the Pacific Association of Collegiate Registrars and Admissions Officers (PACRAO). Grounded in the principles of humanism (Rogers, 1969) and andragogy (Knowles, 1990), and operationalized through gamification (Kapp, 2012), this study evaluated whether game-based mechanics aligned with adult learners’ professional development needs within a geographically dispersed regional association. Given the end of affirmative action as we know it, a decline in numeric representation of students of color in higher education seems inevitable—resulting in devastating losses for legal education, the legal profession, and American leadership. Law enforcement investigations are increasingly driven by hidden algorithmic tools, without disclosure of those tools to the people being prosecuted or the public at large. Facial Recognition Technology, for example, has been used by police to identify suspects in investigations since 2001. Despite the widespread and growing use of Facial Recognition Technology in police investigations, its scientific validity has never been tested in court, and its secret use has prevented it from being challenged on constitutional grounds. Recently, in League of Women Voters of Kansas v. Schwab (League II), the Kansas supreme court addressed the constitutionality of a Kansas statute that purported to combat election fraud. In League II, the court invalidated a provision criminalizing conduct that leads others falsely to believe the actor is an election official, rejected some challenges to a signature verification requirement but remanded for further consideration of others, and upheld a provision limiting the number of ballots that a single person could submit on behalf of others during an election. For thousands of years, trials were held in brick-and-mortar courthouses. Then COVID-19 ravaged the world, forcing many businesses and institutions—including courts—to move their operations online. For the first time, many people experienced the benefits of online trials that are held via videoconference software such as Zoom. But Zoom fatigue is real. This Essay proposes a novel approach to the most urgent food safety problem currently facing U.S. consumers: fresh produce contaminated with virulent microbial pathogens. Despite extensive regulation, growers have been unable to rid their fields of toxic bacteria, and processors have been unsuccessful in sanitizing tainted produce before it reaches store shelves. As a result, tainted produce sickens millions of consumers every year. An emerging consensus is calling for new efforts to address one source of the problem.
