H.B. 404: Ohio Amends Its Condominium Act, University Of Dayton May 1979

H.B. 404: Ohio Amends Its Condominium Act, University Of Dayton

University of Dayton Law Review

Post World War II America has witnessed the rapid expansion of its urban centers, as evidenced by the development of very large, widely spread-out cities. As a result of this pattern of development, land for single-family dwelling units has become relatively scarce, and, consequently, more expensive. Thus, a significant challenge to our society is the need to find feasible methods of housing large numbers of people at prices that they can afford. One response to this challenge emerged in the early 1960's when the concept of the condominium grew in popularity. This living arrangement is typically characterized by multiple dwelling …

H.B. 635: "Use On Use" Sales Tax Exemption Reenacted, Molly B. Kenny May 1979

H.B. 635: "Use On Use" Sales Tax Exemption Reenacted, Molly B. Kenny

University of Dayton Law Review

In May of 1978, the 112th General Assembly enacted House Bill 635, amending section 5739.02 of the Ohio Revised Code. The bill added subsection (B)(25), a "use on use" exemption from the sales tax.' The ultimate effect of this exemption is to relieve certain sales from the sales tax.

This exception is known as the "direct use" sales tax exception. Because the definition of retail sale excludes the direct use transaction, no sales tax is imposed. These two definitions appear in the definitional section of the sales tax chapter.

The general sales tax levying provision, section 5739.02, lists numerous exemptions …

H.B. 456: Property Owner's Civil Action For Minor's Theft, Ron Mount May 1979

H.B. 456: Property Owner's Civil Action For Minor's Theft, Ron Mount

University of Dayton Law Review

In October of 1965, the Ohio Legislature enacted section 3109.09 of the Ohio Revised Code which permitted a property owner to bring a civil action for the recovery of compensatory damages against the parents of a minor who willfully damaged the property of the owner, provided that the parents had custody and control of the minor. The amount of recovery was the actual damages sustained, but with a limit of $250 per child. The minor need not have been adjudged delinquent in order for the property owner to recover. All the property owner needed to prove was willful destruction by …

Osha Regulation: Workers Right To Refuse To Work In Situation Of Imminent Danger Held Invalid, Robert J. Cava

University of Dayton Law Review

Marshall v. Daniel Construction Co., 563 F.2d 707 (5th Cir. 1977), cert. denied, 99 S. Ct. 216 (1978).

On December 29, 1970, President Nixon signed the Occupational Safety and Health Act (OSHA) of 1970 into law. Although there was extensive congressional debate, accord was reached on the necessity for legislation in the wake of the death and disability toll on the nation's work force resulting from the introduction of increasingly sophisticated technology and chemicals into the workplace. Congress declared the policy of OSHA in section l(b): “to assure so far as possible every working man and woman in the Nation …

Human Rights As The Unwritten Constitution: The Problem Of Change And Stability In Constitutional Interpretation, David A.J. Richards May 1979

Human Rights As The Unwritten Constitution: The Problem Of Change And Stability In Constitutional Interpretation, David A.J. Richards

University of Dayton Law Review

We are, I believe, in the midst of a major jurisprudential paradigm shift from the legal realist-legal positivist paradigm of the legal official as a managerial technocrat ideally seeking the utilitarian goal of the greatest happiness of the greatest number, to a natural law paradigm of rights. This paradigm shift, most dramatically apparent in legal philosophy in the work of Ronald Dworkin, has not yet been fully and fairly articulated; therefore, we cannot be certain of the final form the paradigm will take or of the extent of its influence on thought about and the practice of law. I believe …

Accusation Of Crime And Job Retention: A Cooling Off Period For Arrested Employees, Daniel L. Skoler May 1979

Accusation Of Crime And Job Retention: A Cooling Off Period For Arrested Employees, Daniel L. Skoler

University of Dayton Law Review

Individuals who are arrested for crime and placed in jail have to cope with more than the justice system. If they are employed workers, they will be called to account for their absence from work and, as likely as not, may find their jobs in jeopardy. Indeed, a recent Department of Labor study suggests that loss of employment is one of the great hazards confronting the criminal accused who holds a job. Where employment is actually severed, the matter of return to the labor market is often aggravated beyond the disruption stemming from a normal layoff or termination. This is …

Focus, April 1979, University Of Dayton

Focus

Focus, published by the University of Dayton public relations office from October 1967 to mid-1982, was called “a window of the University of Dayton.” The number of issues per year varied over time from four to nine. It was mailed to faculty and staff; parents of current students; benefactors; and business and industry partners. Its content was duplicated in another publication, Alumnus, which contained additional pages of interest to alumni, including a robust listing of personal updates known as class notes — a popular section of every alumni publication since.

In August 1982, Focus and Alumnus merged into one publication, …

The Religious Theme In Twentieth Century Spanish Thought: Unamuno, Ortega, Zubiri, Herminio Martinez Mar 1979

The Religious Theme In Twentieth Century Spanish Thought: Unamuno, Ortega, Zubiri, Herminio Martinez

University of Dayton Review

Spain' s contribution to European culture can best be defined as "disproportionate," combining periods of great cultural achievements with centuries of intellectual stagnation. In the period extending from 1500 (La Celestina) to the middle of the seventeenth century (Velazquez, Quevedo, Calderón) Spain produced numerous works of excellence in literature, painting, architecture, theology, mysticism, asceticism, etc. However, by the second half of the seventeenth century Spanish intellectual life began a period characterized by a complete lack of creativity in nearly all aspects of culture. This period lasted until the beginning of the twentieth century, when Spain began a new and successful …

El Caballero Lobo As A Compendium Of Manuel Linares Rivas' Theories For Reforming Society, Elisa Fernadez De Cambria Mar 1979

El Caballero Lobo As A Compendium Of Manuel Linares Rivas' Theories For Reforming Society, Elisa Fernadez De Cambria

University of Dayton Review

The name Manuel Linares Rivas (1867 -1938) usually calls to mind the name of his best-known play, La garra, written in 1914, but this is by no means the extent of his dramatic output; actually, he wrote more than sixty plays, some novels and also adapted and translated a number of foreign musical comedies for presentation in Spain. His plays resemble those of his contemporary Jacinto Benavente in themes and style. He also shared with Benavente and with the other members of the Generation of '98 a desire to regenerate Spain. He was able to use two very viable means …

What Is The Most Significant German Novel Of World War Ii?", W. Lee Nahrgang Mar 1979

What Is The Most Significant German Novel Of World War Ii?", W. Lee Nahrgang

University of Dayton Review

Unlike the German novels of World War I, which have been analyzed rather thoroughly in a number of studies, including book-length critiques by J . Knight Bostock, Herbert Cysarz, William Karl Pfeiler, and Hermann Pongs, the many German novels of World War II have received relatively little critical attention; and the secondary literature which does exist reveals considerable difference of opinion concerning which work is most significant. Werner Welzig describes Gerd Gaiser's Die sterbende Jagd as "der packendste und zugleich zarteste Kriegsroman ... den die deutsche Literatur dieses Jahrhunderts bis he ute hervorgebracht hat." Franz Lennartz admires Gert Ledig's Die …

Religious And Secular Aspects Of Leopoldo Alas, Clarín, Franklin Proaño Mar 1979

Religious And Secular Aspects Of Leopoldo Alas, Clarín, Franklin Proaño

University of Dayton Review

Leopoldo Alas' historical period, 1852-1901, was in Spain an ideological and emotional chaos. European ideas infiltrating the peninsula were rejected by tradition. Spain, faithful follower of Thomistic scholasticism, openly fought against the philosophical principles postulated by the disciples of Hegel, Renan and Krause.

Unamuno's Novel: A "Religious" Search For Meaning In Life, Ricardo Diez Mar 1979

Unamuno's Novel: A "Religious" Search For Meaning In Life, Ricardo Diez

University of Dayton Review

Miguel de Unamuno (1864-1936) is best known in the contemporary world, perhaps, for his book Del sentimiento trágico de la vida en los hombres y en los pueblos (On the Tragic Sentiment of Life in Men and In Societies 1912). It is the distinguishing mark of major thinkers to create categories of thought and concepts which remain uniquely theirs. Sartre's engagé, Eliot's wasteland, Nietzsche's death of God or Kierkegaard's fear and trembling Del sentimiento trágico de la vida stands out.
