The relationship of moral philosophy to the understanding and development of constitutional law has, until recently, been a relatively neglected issue. Although less evident in contemporary cases in the United States Supreme Court, scholarly attention to the congruence of moral inquiry with the articulation of constitutional values has become more frequent and intense in recent years. Clearly, the moral analysis of constitutional values is often demanding for the lawyer and judge. The institution of the grand jury is, for the most part, shrouded in mystery. Although the grand jury indictment is provided for in the Constitution to protect those who come in conflict with the law, very few citizens know much about its history, purposes, or practices. Much of this "mysteriousness" is due to the very nature of the institution — a group of citizens formed as an arm of the court, holding secret hearings where the accused does not automatically have the right to be present. At a recent conference with class members in an extended employment discrimination proceeding, Hairston v. McLean Trucking Co., one disgruntled class member, among sixty-seven and one of seventeen named plaintiffs asked me: "Lawyer, who do you represent in this proceeding?" Forty of the class members and sixteen of the named plaintiffs were at that time reasonably satisfied with a backpay settlement proposal. One class member and one plaintiff objected vehemently. I advised the group that the settlement was reasonable and that they should accept it. The objector's question, however, did seriously concern me.

In the coming year, many corporations, government agencies, and institutions such as universities and hospitals will be leasing much of the equipment they need to perform and support their functions. This leased equipment will include heavy transport vehicles, airplanes, industrial machinery, business equipment and, most frequently, sophisticated and expensive computer equipment. Religious orders, which by their nature are typically under the jurisdiction and control of a church, were present in the United States long before the enactment of the sixteenth amendment which authorized the present federal income tax. The Internal Revenue Code generally defines gross income for individuals and organizations alike as income from whatever source derived. Nevertheless, certain organizations which are tax-exempt are not required to pay tax on their income, unless the income is from a business unrelated to the exempt purposes of that organization. The spread of contagious diseases has been a major problem that has plagued society throughout history. In the recent past, smallpox and polio have struck down thousands of individuals, and today German Measles and other serious viruses continue to threaten the health of our population. Fortunately vaccines have been developed that help prevent these diseases from spreading through our population, and presently a large number of the communicable diseases can be combatted.

The Ohio Entirety Estate: Alternative Approaches To Anticipated Problems, Paul Gerard Hallinan

Section 5302.17 of the Ohio Revised Code provides for the creation of estates by the entirety in real property by use of a deed in form prescribed by statute. At the time of its enactment in 1972 this section was thought to have reversed the nonrecognition of common law survivorship estates that had prevailed in Ohio's courts for almost one and one-half centuries. Although the statute has not had the impact originally supposed, it is evident that this casual intrusion by the legislature in an area of settled law has raised questions not heretofore addressed by the Ohio judiciary.

The Ohio Consumer Sales Practices Act, passed in 1972, was designed to provide consumers with statewide protection against marketplace abuses. By declaring suppliers' deceptive or unconscionable practices in connection with consumer transactions to be illegal, the 1972 Act was designed to promote fair bargaining in the marketplace. The passage of five years has demonstrated the inadequacy of this law in achieving its intended legislative purpose. In testimony before the Senate Judiciary Committee on March 15, 1978, William J. Brown, Ohio Attorney General, expressed his alarm over the "deceptive-unconscionable"' clause description in the 1972 Act, as reflecting an inadequate enforcement standard …

Governmental power to compel persons to testify in court is firmly established in American law. Both the constitutions of the United States and Ohio, however, set forth a privilege against compulsory self-incrimination. Statutes which empower a court to compel testimony over a claim of privilege against self-incrimination in return for protection against criminal punishment are called immunity statutes. Such statutes seek a rational accommodation between the constitutional imperatives of the privilege against self-incrimination and the governmental need for testimony. The underlying rationale for such benefits is to promote the governmental interest in rewarding those who have served their country in the military, to aid in the rehabilitation and relocation of veterans whose life style has been disrupted by the military service, and to provide incentives for young men and women to join the armed forces. Under Ohio law, the probate court is required to appoint an agency or person to investigate the background of both the minor and the adoptive parent before a child can be adopted. The purpose of this investigation is to ascertain whether the proposed adoption is in the best interest of the minor. The investigation report is required to contain four types of information about the child: (1) the physical, mental, and developmental condition of the child; (2) the family background; (3) the reasons for the placement; and (4) the interested parties' attitudes toward the proposed adoption.
