Federal Preemption: State Law Principles Of Strict Liability In A Nuclear Accident — A Preemption Problem In Light Of The Price-Anderson Act, John P. Napoli

Silkwood v. Kerr-McGee Corp., 485 F. Supp. 566 (W.D. Okla. 1979)
In the event of a major nuclear accident, Congress has imposed a form of strict liability on the nuclear industry through the Price- Anderson Act. The Act provides for a waiver of state and common law defenses in the event of an “extraordinary nuclear occurrence” by federally licensed nuclear facilities. Thus the Act proscribes federal strict liability upon the nuclear industry for injuries caused by an extraordinary incident.
If, however, the nuclear accident is less than an extraordinary nuclear occurrence, an accident often referred to as “subthreshold,” a question …

Judicial Review And The National Political Process: A Functional Reconsideration Of The Role Of The Supreme Court (By Jesse H. Choper), Richard B. Saphire

We have come to an important crossroad in constitutional law. Academic commentators are calling for a broad reexamination of traditional assumptions about the role that both the Constitution and Supreme Court can and should play in our society. Some critics of the Court complain that it takes too narrow a view of the Constitution, while others have argued that the court interprets it too broadly. Despite differences in perspective, most will no doubt agree with Professor Leff’s observation that “it is awfully hard to be a credible constitution thinker by treating the Constitution as irrelevant.” Perhaps it is time to …

Until modern times virtually every Jewish child imbibed the teachings, the narrative, and law of the Pentateuch with the assistance of Rashi's commentary, or, as the Yiddish expression has it, Humash mit Rashi. Rashi's Bible and Talmud commentaries are still unmatched for conciseness, clarity, and the sure touch of the born educator. Though of medieval French provenance, Rashi's expositions were adopted by Jews everywhere, Ashkenazic, Sephardic, and Oriental, for nearly a thousand years. Nor was his influence restricted to Jews. In La hoja roja (1959) Miguel Delibes has selected as his focus an aging man who might well represent the plight of the uncelebrated senior citizen of our times. What pervades the novel is Delibes' view of the process of aging as a search for calor, both in the literal meaning of physical warmth as well as a symbolic calor viewed in its human dimension as companionship, love, and understanding. The future of man for Anthony Burgess does not lie ahead. Rather it lies within. For man carries about with him -- in his very nature -- his past, present and future. This is clear from Burgess's futuristic novel, The Wanting Seed, and whatever he may suggest about the future in that novel is also implicit in his other works. Richard's wooing of Anne has strained the credibility of modern audiences and readers to an extent unparalleled by any other scene in Shakespeare. Much critical attention has focused on attempts to defend the realism of the scene. Denzell S. Smith, for example, shows how Richard "changes his pose to accord with the natural progression of Anne's emotions," from forceful prince, to "pleader," to "innocent," to "brazen lover" and so on as he anticipates Anne's reactions and meets them with a response that is psychologically (and dramatically) convincing. By the mid sixteenth century the fervent belief of such humanists as Juan Louis Vives and Sir Thomas More that women should be educated had, as More predicted in his letter to William Gonell (1518), "born fruit." Women's reason had been "cultivated, and (as a fielde) sowed with wholesome precepts. "Not only the concerns of the humanists but also the Protestant Reformation with its drive for universal literacy led to an increase in the number of educated women. Traditionally science and technology have been fields in which almost no women were employed. In recent years increasing numbers of women have been attempting to enter these fields. Affirmative action, equal opportunity and similar legislation have been enacted in an attempt to facilitate the entry of women. One of the purposes of this paper is to report briefly on a study designed to evaluate the success of women pursuing scientific careers. Since the results of this study are not encouraging, we are led to question why. The answer is likely a combination of many factors. One argument, which is invoked …
