Diclosure Of Thirs-Party Funding Arrangements Aand The Existence Of Third-Party Funders In International Investment Arbitration, Abimanyu Kadarisman
Indonesian Journal of International Law
Third-party funding has been commonly used in International Investment Arbitration. Third-party funders increasingly usually finance the claimant who either (i) does not have sufficient funding to start legal proceedings, or (ii) adequately capitalized, but seek funding in order to minimize cash flow disruption and share risk during their arbitration proceedings. However, the notion of third-party funding gives rise to several issues; first, should funded parties be required to disclose their funding arrangements? Following the first research question, when does the funded party need to disclose the existence of a third-party funder? Then what legal measures can be taken to tackle …

When investigating Illegal, Unreported and Unregulated (IUU) fishing, related transnational crimes activities such as trafficking in persons, slavery and drugs are also uncovered. In spite of the robust efforts and prompt responses, some challenges persist in terms of the inadequacy of legal frameworks governing these problems. Thus, the adequacy of the legal domain is a significant factor in pursuing the Ministry’s mission. The legal framework plays a pivotal role in addressing IUU fishing and transnational organized fisheries crimes and in setting a mechanism to …

The Impact Of Political Decisions Within The Wto Dispute Settlement System: Political Negotiations Within Adjudication, Meaza Haddis Gebeyehu
Indonesian Journal of International Law
It is traditionally contended that politics and law are two separate domains of international relations among the main actors, states. As opposed to this thinking, international relations of the twenty-first century have been characterized by the continuing interaction of law and politics. As the main actors and participants in international law, states played and still play significant roles in this development. The growing sense of nationalism within states and the concomitant consequence of prioritizing their respective national interests led to the use, by these states, of international law as an instrument of justification. When international law is used this way, …

Studying these simple signs is the starting point in observing how a language variety exists and interacts with other languages. It is interesting to study how the instances of written texts found in public landscapes can be an indicator of what language variety is actually used by the inhabitants of Depok. Based on its history and its geography, a hypothesis states that many speakers of Betawi language and Sundanese reside in Depok. The study is aimed at demonstrating the written language varieties …

The Pearl Rush In Aru, 1916; A Case Study In Writing Commodity History In Southeast Asia, Adrian Vickers
Wacana, Journal of the Humanities of Indonesia
While the long history of “commerce” in Southeast Asia is well studied, less examination has been made of the histories of capitalism, particularly in terms of the encounters that took place around commodities. This article provides a translation and analysis of a description of Dobo on Aru in 1911. At the time it was a “Klondike”, on what Julia Martínez and I have termed “the pearl frontier”. The Aru islands were the site for an Australian-led pearl shell consortium that ran from the beginning of the twentieth century until the 1940s, which brought in a large number of Japanese divers …

The Protective Role Of Friendship: Crossgroup Friendship Mediates The Effect Of Ideological Quest For Significance On Commitment To A Radical Group, Mirra Noor Milla, Joevarian Hudiyana
Psychological Research on Urban Society
On the basis of the Quest for Significance theory, a person’s sense of meaning and personal significance may be obtained from ideological narratives. The more a radical ideology gives a person a sense of meaning, the less likely it is that he or she will engage in interpersonal relations and friendships with out-group members. In this study, we hypothesized that ideological quest for significance would predict commitment to a radical group and that this association would be mediated through cross-group friendship. This research was based on interviews with 241 prisoners at 59 Indonesian prisons, who were serving sentences for terrorism …

Highs And Lows In The Relationship Between Hamka And Muahammadiyah During The Period Of Guided Democracy, Akmal Akmal, Abdurakhman Abdurakhman
International Review of Humanities Studies
Following the dissolution of Masyumi in 1960, the political climate was rather unfriendly for the Islamic movement in Indonesia. Since 1959, Muhammadiyah had given up its special membership status in Masyumi, while some of its administrators pursued political careers elsewhere. Muhammadiyah maintained good relations with Soekarno, notably after Soekarno’s speech in Muhammadiyah’s 35th National Congress in 1962. Hamka, a devoted member of Muhammadiyah, was stuck in a rather unique position due to this progress of events. This study aims to describe the highs and lows of the relationships between Hamka and Muhammadiyah during the Guided Democracy era (1959-1966). Literature study …
