REGISTRATION OF VOTERS. Initiative. Changes laws regulating registration of voters. Requires new state-wide registration of voters commencing January 1, 1932; voter's registration to continue in force until cancelled at his request, or upon his death, removal, insanity, conviction of felony, or by judgment of cancellation; on January first of each subsequent odd-numbered year registration of any person not voting at last preceding August primary or November general election to be cancelled and notice thereof mailed such person at least ten days prior to close of registration for any subsequent election and such person must re-register before voting.
Taxation On Street Railways
Propositions
Adds Subdivision ab to Section 14, Article XIII, of Constitution. Subject to change by Legislature fixes percentage of tax on street railways, including interurban electric and gasoline propelled railways, at four and one-quarter per cent of their gross receipts from operation ascertained as provided in constitution; should courts hold classification herein unconstitutional or prejudicial to State's right to tax other railroads differently, declares this amendment void, and rate on said railways and other railroads shall be as prescribed in subdivision a of same Section or as adopted pursuant thereto.

Adds Section 22a to Article IV of Constitution. Empowers Legislature to provide for payment of retirement salaries to State employees, and prescribe requirements and conditions for retirement which shall include minimum period of services, minimum attained age and minimum contribution of funds by employees, but may prescribe lesser requirements for retirement because of disability; contribution rates, service periods and conditions, and amount of retirement salaries, fixed pursuant hereto shall be changed only by two-thirds vote of members elected to each house of Legislature.

Senate Constitutional Amendment 45. Amends Section 1 of Article XIII of Constitution. Declares toll bridge property, acquired by State or governmental agency thereof, continues subject to taxation by county, municipality or political subdivision, wherein same is located, during life of original franchise, and State shall pay amounts due under franchise to county or city and county granting same; but whenever State ceases to collect tolls upon such property, and it becomes free to public use, it shall be exempt from taxation and thereafter State shall make no payments under franchise provisions.

Senate Constitutional Amendment 30. Amends Section 23a of Article IV of Constitution. Authorizes each house of Legislature, by resolution, to employ help, prescribe duties and fix compensation thereof; total daily expense for officers, employees and attaches not to exceed, at any regular session, four hundred dollars for Senate and four hundred fifty dollars for Assembly, exclusive of salaries of Secretary of Senate and Chief Clerk of Assembly, and, at any special or extraordinary Session, one hundred fifty dollars for each house, exclusive of salaries of such Secretary and Chief Clerk.

Senate Constitutional Amendment 24. Amends Sections 1 and 7, and repeals Sections 2, 3, 9, 11, 12 and 14 of Article XII of Constitution. Empowers Legislature by general laws to provide for formation, organization and regulation of corporations, prescribe their powers, rights, duties and liabilities, and those of their' officers, stockholders and members, and provide for extension of term of existence of all corporations formed for limited period, but shall not extend franchise of any quasi-public corporation nor remit forfeiture thereof. Declares present laws concerning corporations and those hereafter passed pursuant hereto may be altered or repealed.

Senate Constitutional Amendment 8. Amends Section 8, Article XI, of Constitution. Requires proposed amendments to municipal charters be submitted to electors at special election called for that purpose or at any general or special election, and petitions for such submission be filed with legislative body of municipality at least sixty days before election; eliminates provisions requiring such submission be only during six months next preceding a regular session of Legislature or thereafter and before final adjournment thereof, and the filing of petitions for such submission at least sixty days before general election next preceding such session.

Amends Sections 1 and 3 thereof, and adds Sections 6, 7, 8, 9 and 10. Written agreement for interest rate unnecessary. Corporations can not recover treble amount of interest paid. Defines "construction loans" and provides for computing interest thereon. Excepts agreements giving borrower option to pay before maturity. If maturity is accelerated by default, interest paid in advance is not usurious. Corporations can not plead usury. Legislature regulates pawnbrokers and "industrial loan companies."

Initiative. Prohibits keeping open for business any store, barber shop, workshop, factory, or other place of business, or performing or employing labor, on Sunday; excepts necessary, charitable or recreational works, needful during day for good order, health or comfort of community, enumerating many thereof but declaring enumeration not all inclusive; excepts work by member of religious society which observes weekly for rest or worship a day other than Sunday, provided he keeps place of business closed and does not work that day. Declares contracts made on Sunday and acts limiting hours of labor of females not affected.

Initiative. Amends Constitution, Article IV, Section 25 ½ and adds thereto three sections. Creates Fish and Game Commission of five members appointed by Governor; empowers Commission to establish fish and game districts, determine what animals, birds and fish, are within its jurisdiction, regulate by ordinance approved by Governor, the taking, sale or possession thereof, and issue licenses therefor, fix seasons and limits within maximums prescribed by Legislature, establish refuges, public shooting grounds and fishing waters, conduct investigations of persons, and their books, within its jurisdiction; prescribes penalties; declares provisions effective January 15, 1931.

Senate Constitutional Amendment 17. Adds Section 18 to Article XIII of the Constitution. Requires each ocean marine insurer pay annual State tax measured by that proportion of its underwriting profit from business in United States which its gross premiums from business in California bear to its gross premiums from business in United States; exempting such insurer from-all other taxes and licenses except real property taxes and those imposed because of other class of insurance written by it. Requires Legislature define "ocean marine insurance" and "underwriting profit." fix tax rate and provide for assessment and collection.

Empowers Legislature to include in any department of executive branch of state government any office, board or commission established by Constitution and appointed by Governor, and to provide representation therefor in Governor's Council, through the director of the department. Declares section not applicable to officers and boards filled, by constitutional provision, through elections by the people, and Legislature not empowered thereby to impair any jurisdiction conferred by Constitution upon such office, board or commission, except as Legislature is now or may hereafter be so authorized.

Requires department of finance biennially report to Legislature net loss in revenue sustained during preceding biennium by each county or city and county by withdrawal from local taxation of property taxed for state purposes, basing loss to city and county on loss for county purposes apart from municipal purposes: Legislature, upon approval of budget bill, to determine amount and manner of reimbursement therefor from unappropriated money in State treasury, provided said money is not thereby reduced below ten million dollars.

Senate Constitutional Amendment 18. Adds Section 1c to Article XIII of Constitution. Requires Legislature provide for tax on motor vehicles in lieu of personal property taxes thereon, prescribe basis and method of fixing amount thereof, and collection by state department registering such vehicles: requires at least 95 per cent of fund derived therefrom be paid each year to respective counties from which such vehicles were registered, each county's share to be distributed between county and political subdivisions therein, as prescribed by law. Declares section shall not affect motor vehicle registration fees.

Assembly Constitutional Amendment 27. Amends Section 9, Article VI, of Constitution. Prohibits Legislature from granting leave of absence to any judicial officer; declares any such officer who absents himself from State for more than sixty consecutive days forfeits his office, but Governor may, on terms fixed by him, extend said period. Authorizes Legislature, by two-thirds vote of each house, to increase or diminish number of Superior Court judges in any county or city and county, but any reduction shall not affect elected judge.

Provides for election within ten months after adoption hereof, on date fixed by Governor, of one hundred and twenty delegates, one from each senatorial and assembly district, to meet in convention at state capitol within three months after such election and frame new state constitution; empowers convention to employ clerks and experts; requires Legislature provide for expenses thereof arid compensation of delegates; requires Constitution be submitted for adoption or rejection by majority of electors at election held therefor; provides for such election and proclamation of result.

Requires forty days residence in precinct, instead of thirty days, as a qualification to vote; declares person removing within forty days of election from precinct wherein registered to another precinct in same county shall for that election be deemed elector of former precinct and may vote therein; authorizes Legislature to provide, by general law, for casting of votes by duly registered voters who expect to be absent from their respective precincts or unable to vote therein, by reason of physical disability, on election day.

Requires biennial legislation distributing not exceeding half of state taxes on premiums of fire insurance companies among firemen's pension, relief, health, life and accident insurance funds of counties, municipalities and political subdivisions, in proportion that each fund bears to aggregate thereof at distribution time; permitting distribution of portion thereof to any said subdivision having no such fund and maintaining paid or volunteer fire department. Authorizes legislation permitting local authorities to apply distributions hereunder toward procuring such insurance and paying firemen's pensions.

Declares compensation of officers herein mentioned shall be in full for official services and they shall not receive for themselves fees or perquisites for performing any official duty. Exempts from taxation all property as of July 1, 1929, held in trust for said institution and all personal property received in exchange therefor, authorizing Legislature to modify, suspend and revive such exemption.

Senate Constitutional Amendment 33. Adds Section 7 to Article XVI of Constitution. Approves and validates California State Park Bonds Act passed by the Legislature in 1927 and approved by the Governor; authorizes and directs the issuance and sale of $6,000,000 State bonds, and the use of the proceeds thereof, all as provided in said act, to provide a fund to be used for the acquisition of lands and other properties in California for state park purposes; declares section self-executing but permits legislation in furtherance thereof.

Assembly Constitutional Amendment 1. Adds Section 16 to Article XIII. Substitutes for state bank share and corporation franchise tax on banks and other financial, mercantile, manufacturing and business corporations equaling four per cent their net income, allowing them, except banks, personal property tax offset up to nine-tenths state tax. Authorizes legislative change in method of taxing banks and such corporation without constitutional amendment. Taxes intangibles three mills per dollar on their actual value for benefit of local subdivisions. Permits Legislature to change such offset or any rate by two-thirds vote, limiting rate on intangibles to four mills.

Initiative. Repeals initiative act approved by electors November 4, 1924. That act authorizes boxing and wrestling contests for prizes or purses, or where admission fee is charged, limiting such boxing contests to twelve rounds; created athletic commission empowered to license such contests and participants therein; prescribes conditions under which licenses shall be issued and contests held; and . declares amateur boxing contests, conducted under Section 412 of Penal Code (which limits such contests to four rounds and prohibits prize fights), are subject to that act, and under commission's jurisdiction, when admission fee is charged.

Assembly Constitutional Amendment 21." Amends Section 14, Article I of Constitution. Confers upon the State the same power now possessed by municipal corporations and counties to appropriate a right of way without full compensation therefor being first made in money or ascertained and paid into court for the owner, but requires that in any action to acquire such right of way security shall be given for immediate payment to the owner of just compensation for the property so taken as soon as the amount thereof can be ascertained according to law.

Increases the amount of the registration fee to be paid for electric motor vehicles and vehicles (including trailers and semi-trailers) equipped wholly with pneumatic tires, and designed, used or maintained primarily for transporting passengers for hire or for transporting property; graduates such fees on a weight basis; doubles those fees for vehicles, other than electric, not so equipped.
