Authorizes State, county or city to acquire land by gift, purchase or condemnation, for memorial grounds, streets, squares, parkways and reservations, limited to parcels within one hundred fifty feet of closest boundary of such improvement; when parcels lie partially within such limit only portions thereof within two hundred feet of such boundary may be acquired; after improvement completed land not necessary therefor may be conveyed, with reservations concerning future use so as to protect the improvements; Legislature to prescribe procedure

Changes provisions for electing Supreme Court Justices and filling vacancies therein; changes jurisdiction of Supreme Court, District Court of Appeal and Superior Court; empowers Legislature to create more such District Courts and divisions thereof, redivide State into Appellate Districts, establish appellate departments of Superior Court in county having municipal court, determine number and jurisdiction of municipal and inferior courts, and judges thereof, their qualifications and compensation, ratifies legislation fixing municipal court's exclusive jurisdiction at law.

Declares general welfare requires water resources be beneficially used, and waste or unreasonable use or unreasonable method of use prevented, and requires conservation for public welfare. Declares right in stream or water course limited to water reasonably required for beneficial use, riparian rights attaching to flow required therefor, and shall not extend to waste or unreasonable use or unreasonable method of use or of diversion. Appropriator or riparian owner lawfully entitled to water not to be deprived thereof. Declares section self-executing and permits legislation in furtherance.

Authorizes issuance and sale of $10,000,000 State bonds, proceeds to be expended by California Highway Commission to pay such portion of cost of acquisition of rights of way for railroad grade separations and acquisition, construction and improvement of railroad grade separations upon State highways within State highway system as may be apportioned to State by State Railroad Commission; defines railroad grade separation as any crossing, and approaches thereof, between state highway and tracks of commercial interurban or other railway by whatsoever power operated.

REAPPORTIONMENT COMMISSION. Initiative measure adding Section 6 1/2 to Article IV of Constitution. Creates reapportionment commission composed of Secretary of State, Attorney General and Surveyor General. If Legislature fails, at first session after each census, to adjust senatorial and assembly districts and reapportion representation as provided by Constitution, requires said commission to make such adjustment and reapportionment, and file same with Secretary of State, within three months after adjournment of such legislative session. Declares said commission shall make and file such reapportionment on basis of 1920 census within three months after this amendment takes effect.

Repeals Act of Legislature commonly known as Wright Act, approved by electors on referendum November 7, 1922, which Act provided for enforcement by State of California of the Eighteenth Amendment to United States Constitution, prohibited all acts or omissions prohibited by Volstead Act, adopted penal provisions of that Act, imposed duties on courts, prosecuting attorneys, sheriffs, grand juries, magistrates and peace officers in this State, extended their jurisdiction, and provided for the disposition of fines and forfeitures.

TAXING FIRE INSURANCE COMPANIES. Initiative measure adding section 14 1/2 to Article XIII of Constitution. Imposes upon companies not incorporated in California, or controlled by insurance company not incorporated therein, doing business of fire insurance upon property therein, an additional tax of two per cent of gross premiums from such business; receipts therefrom, distributed according to population among political subdivisions maintaining fire departments with equipment worth at least two thousand dollars, to be used for pensioning firemen and dependents and accident compensation insurance for part time and unpaid firemen; limits required service for such pension to twenty years.

Creates State Racing Commission, appointed by Governor, empowered to license and control the Pari-Mutual System of Wagering within the enclosure where horse races, called in such cases "licensed races," are held, and to control such "licensed races" and the award of purses or prizes there at; limits such race meetings to sixty days, and to one meeting in any one county, during any one calendar year; permits, without such limitations, licenses for not exceeding fourteen days, Sundays excepted, in any one calendar year, for races held by State Agricultural Societies, District Agricultural and County Fair Associations.

Taxes companies, owning or operating, as common carriers upon public highways between fixed termini or over a regular route, jitney busses, stages or motor vehicles tor transporting persons, four and one-quarter per cent, and those operating trucks tor transporting property five per cent, of their gross receipts; exempts property so used from all other taxes and licenses; appropriates halt of such taxes to state and halt to counties, exclusively for maintaining and repairing public highways; empowers legislature to change such percentages .

Authorizes irrigation districts, in order to obtain water and other necessary property, to acquire stock of corporations owning water rights, waterworks, franchises or concessions, subject to obligations imposed by law upon other stockholders therein; requires city or county treasurer, upon resolution of governing body of political subdivision, to transfer temporarily funds thereof, not exceeding eighty-five per cent of taxes accruing thereto, to meet obligations incurred for maintenance, replacing same from such taxes before using latter for other obligations.

Assembly Constitutional Amendment 36. Amends Section 18 of Article XI of Constitution. Declares that whenever two or more propositions for incurring any Indebtedness or liability are submitted at the same election to the electors of any county, city, town, township, or school district, the votes cast for and against each proposition shall be counted separately, and when two-thirds of the qualified electors, voting on any one of such propositions vote in favor thereof, such proposition shall be deemed adopted.

Creates judicial council, with chief justice as chairman and ten judges selected by him from various courts, to regulate court practice and procedure and exercise functions provided by law; eliminates judges pro tempore and provisions for judge acting when requested by Governor or Superior Judge; authorizes chairman to assign judge to act when calendar congested, judge unable to act, or vacancy exists, allowing assigned judge larger salary of assigned position; changes provisions for filling Superior Court vacancies.

Requires every distributor of gasoline, distillate and other motor vehicle fuels, to pay license tax of one cent per gallon, in addition to two-cent license tax now required by law; said additional tax to be applied toward paying one-third of refunds now required by law, and balance credited to State Highway Construction Fund and used for acquiring rights of way for, and construction of, highways under jurisdiction of California Highway Commission; declares act effective January 1, 1927, and subject to amendment or repeal by the Legislature after January 1, 1939.

Creates board appointed by Governor, to regulate and license horse racing and Pari-Mutuel betting within race track enclosure; limits racing period at each track; prohibits licensing racing at tracks constructed, without board's approval,. after November 1, 1926; limits licensee's return to nine per cent on capital invested; prescribes as license fees five hundred dollars each race day and licensee's net profits above return allowed ; appropriates fees to board's salaries and expenses, dividing balance equally between Veterans' 'Welfare Board and State Agricultural Board; authorizes licenses for limited period at county fairs or agricultural exhibits.
