How Police Brutality Harms Mothers: Linking Police Violence To The Reproductive Justice Movement, Arneta Rogers

The recent and highly publicized killing of Michael Brown, an unarmed 18-year-old African American and the subsequent grand jury decision not to indict Darren Wilson, the Ferguson, Missouri police officer who killed him, evoked mass social protest, and highly emotional and politically charged social commentary on the racialized effects of police brutality. While the crisis of systemic police violence has historically centered on the harm inflicted on victims of police brutality and, more generally, on the communities where they are from, an agitated group of feminist scholars and reproductive justice advocates have offered a more nuanced appraisal of the harm …

Sensibilities For Social Justice Lawyers, Ascanio Piomelli
UC Law Journal of Race and Economic Justice
This essay describes six sensibilities that are crucial for 21st Century social justice lawyers. It urges social justice lawyers to know thoroughly the literature on lawyering and social change movements, to be clear about their fundamental aims, to connect their efforts with others, to observe from multiple perspectives, to combat cultural encapsulation, and to put in the time necessary to ensure the survival, advancement, and flourishing of clients and communities.

The persistence of the problems that attend the American color line makes clear the need for greater experimentation and innovation in the area of race. For years now, we have looked primarily to courts for solutions. But current jurisprudence offers very little that is useful in dealing with the modern realities of durable racial inequality and segregation. As cases such as Parents Involved in Community Schools v. Seattle School District No. 1 and Ricci v. Women, Decision Making And Sustainability: Exploring The Experience Of The Badi Foundation In Rural China, Lori Noguchi, Shahla Ali

This Report follows the experience of the Badi Foundation, a nonprofit organization operating in rural China, in its efforts to release women's potential to effect change in their communities. Numerous international conferences and treaties have recognized that female decision making is essential to achieve global environmental change and sustainable development. Recent scholarship recognizes that women are oftoverlooked sources for knowledge, skills, and leadership. Project-based efforts to empower and encourage women to participate in problem solving and other decision making in their communities have produced positive results. Through the Badi Foundation's Environmental Action Program (EAP), rural women gain the skills they …

In its 2007 decision United Haulers Association, Inc. v. Oneida-Herkimer Solid Waste Management Authority, the Supreme Court for the first time held the "dormant" Commerce Clause doctrine ("DCCD") allows for a distinction between appropriate laws establishing local government monopolies providing public services such as waste disposal, and inappropriate laws favoring the self-interest of in-state private businesses over out-of-state competition. In addition, the Court emphasized that courts should apply the DCCD more leniently in the area of waste disposal because it is a traditional local government function. In its 2008 decision Department of Revenue of Kentucky v. Davis, the Court reaffirmed …

Losing Faith: The Supreme Court And The Abandonment Of The Adjudicatory Process, Erwin Chemerinsky

Increasingly the courthouse doors across the United States are being closed to litigants in both criminal and civil cases. This trend reflects an increasing loss of faith in, and abandonment of, the adjudicatory process. Painting with broad strokes, and looking at the criminal justice system, the civil justice system, and the War on Terror, it seems that we are no longer a society living up to the constitutional axioms upon which our country is based. By giving up these notions of process, we are giving up something very fundamental to our constitutional birthright. The late Justice William Douglas said we …
