A Moral Imperative: The Human Rights Implications Of Climate Change, Sara C. Aminzadeh

Even conservative forecasts of climate change predict dramatic effects to environments, economies, and people around the world. Though the causal link between climate change and human rights is not as readily apparent as with other environmental issues, climate change impacts public health, food security, infrastructures, and natural resources. For the Inuit living in the rapidly melting Arctic, and citizens of small island developing states facing sea level rise, climate change has become a matter of human rights. Public Interest Drift Revised: Tracing The Sources Of Social Change Commitment Among Black Harvard Law Students, Jenee Desmond-Harris
UC Law Journal of Race and Economic Justice
Although "public interest drift"-the phenomenon of law students' interest in public interest careers decreasing over the course of legal education-has been studied extensively, author Jene Desmond- Harris argues that rates among black law students deserve a specially tailored analysis because of the black community's longstanding faith in the law and lawyers as instruments of social change. Through a study of current black Harvard Law students, admitted students, and alumni, she investigates the interactions between the Harvard Law School experience and the development of black law students' attitudes about pursuing careers aimed at affecting social change. Waste Discharge Requirements: Beyond The Point Source, Hastings Law Journal

Recent amendments to the Porter-Cologne Water Quality Act withdraw the general waiver for agricultural discharge. Discharges from agricultural lands include irrigation return flow, flows from tile drains, and storm water runoff. Historically, most regional boards regulated these discharges, but recent legislation now requires regional boards to review and renew their waivers or replace them with waste discharge requirements. This Panel of experts discussed the impact of these modified waiver requirements as well as their appropriateness and efficacy in ameliorating waste discharge issues.

Civil Claims For Uncivilized Acts: Filing Suit Against The Government For American Indian Boarding School Abuses, Andrea A. Curcio

This country's history is replete with evidence that the United States government deliberately caused the deaths of millions of American Indians. What is less well-known is the government's attempt to destroy the American Indian peoples by forcing generations of American Indian children to attend off-reservation boarding schools. In this article, Professor Curcio describes the use of government-run boarding schools as a way to destroy American Indian childrens' connections to their peoples, and ultimately, as a way to destroy the American Indian peoples. She discusses the schools' harsh and deadly living conditions and the schools' destructive impact upon generations of American …

Many low-income communities and communities of color are unable to advocate for clean drinking water or oppose rate hikes for drinkable water. Failing infrastructure, industrial pollution, and increasing water scarcity in California disproportionately affect vulnerable, marginalized communities. This Panel focused on community organization and novel legal approaches (such as Title VI Civil Rights complaints) that could be used to advocate for clean drinking water.

Less As More: Rethinking Supernational Litigation Of Economic And Social Rights In The Americas, James L. Cavallaro, Emily J. Schaffer

Over the last few decades, scholars and activists have attacked the conceptual division of human rights into justiciable civil and political rights on the one hand, and largely non-justiciable economic, social and cultural rights on the other. Academics and practitioners have defended the extension of supranational judicial oversight to individual instances of economic and social rights abuse, on the premise that international litigation of these rights would promote their recognition in practice. This article questions the presumed benefits of supranational litigation in the promotion of economic and social rights. Focusing on the Inter- American system for human rights protection, we …

Transmission In Transition: Analyzing California's Proposed Electricity Transmission Regulatory Reforms, Brian Orion

California's experiment with electricity deregulation is the most recent example of the State's willingness to be an energy policy maverick. Rolling blackouts and expensive long-term contracts are some of the constant reminders of this failed experiment. But another dramatic legacy of deregulation, one which is littleknown beyond inside players in regulation and industry, relates to the planning and licensing of California's system of highpower transmission lines. Thousands of miles of copper and steel wires supply families and businesses with the electricity they need to light their homes, water their crops, and manufacture their silicon chips. International Environmental Justice: Rights And Remedies, Kenneth F. Mccallion

Although environmental rights are not explicitly enumerated in the Universal Declaration of Human Rights, it has become generally recognized that environmental rights are closely linked with the right to life, which is the most fundamental jus cogens norm, without which no other rights can be exercised. As the environmental crisis has accelerated in the nineteenth and twentieth centuries, constitutional drafters around the globe have explicitly enshrined in their constitutions some form of obligation to protect the environment or other environmental rights.
