Building Scaffolding Instead Of Barriers: Accessibility For Neurodivergent Law Students, Katherine Silver Kelly Jan 2025

Building Scaffolding Instead Of Barriers: Accessibility For Neurodivergent Law Students, Katherine Silver Kelly

Southern Illinois University Law Journal

When it comes to accommodations and accessibility to equitable learning environments for neurodivergent law students, law schools tend to think our only tool is a hammer and approach everything as if it is a nail. As lawyers, we are experts in problem solving, we are trained to ask questions, to explore the how and why. Yet we fail to do this when it comes to addressing the needs of neurodivergent students. We know how legal education works, we know what students will encounter, what it takes to be successful, and the challenges and struggles students face. This is not to …

Empirically Testing The “Unbiased Factfinder[S]”, Chris Cox Jan 2025

Empirically Testing The “Unbiased Factfinder[S]”, Chris Cox

Southern Illinois University Law Journal

This scholarly investigation examines the decision-making processes in sexual assault cases, juxtaposing the charging decisions of lay individuals with the factual sufficiency reviews conducted by appellate judges. The study's comprehensive analysis of 254 cases provides a unique perspective on criminal justice decision-making within the context of the military justice system—a singular jurisdiction that confers prosecutorial discretion upon lay individuals and permits extensive factual sufficiency reviews by appellate courts, akin to quasi-jury fact-finding articulated in written opinions.

The research findings challenge the paradigm of formal legalism, lending support to a legal realist perspective that posits both lay individuals and judges are …

Current Behavior Analytic Research On Assent And Assent Withdrawal Of Students With Disabilities, Zailey K. Greeno

Research Papers

The field of behavior analysis is ever-evolving, just as the seven dimensions of applied behavior analysis have instructed it to (Baer et al., 1968). Over time, certain procedures, such as electric shock, spanking, and restriction of movement (Leaf et al., 2021), have become unethical, which has resulted in modifications to the Ethics Code for Behavior Analysts (Behavior Analyst Certification Board, 2020), as well as everyday practice to ensure these unethical interventions are no longer utilized. Despite these advances, there are still areas that are lacking in the field. Therefore, the current paper will review the literature in behavior analysis that …

Predicting School Proficiency In Illinois: A Fixed Effects Analysis Of Demographics, Funding, And Mobility, Lauren Johnson

Research Papers

Using Illinois State Board of Education data from 2017-2024, this paper analyzes the effects of black and low income enrollment, spending per pupil, chronic absenteeism, mobility rates, principal turnover and teacher retention rates on student proficiency at the school level. The data includes demographic information, test scores, mobility rates, attendance rates, teacher retention rates, principal turnover, and state and federal spending per school per pupil. Using fixed effects ordinary least squares regressions, it is found that the enrollment percentages of black and low income students are negatively correlated with students’ proficiency. Mobility rates, principal turnover, and chronic absenteeism are also …

Burnout And Job Satisfaction Among Behavior Technicians In Applied Behavior Analysis: Implications For Practice And Workforce Sustainability, Faryna V. Navar Jan 2025

Burnout And Job Satisfaction Among Behavior Technicians In Applied Behavior Analysis: Implications For Practice And Workforce Sustainability, Faryna V. Navar

Research Papers

Burnout is a significant concern for behavior technicians in the field of applied behavior analysis (ABA), where high emotional demands and turnover rates pose challenges to workforce sustainability. This paper explores existing research on burnout in ABA and related fields, with a focus on strategies to mitigate its impact. Drawing on the principles of Acceptance and Commitment Therapy (ACT), the literature suggests that components such as values clarification and committed action may serve as effective tools to reduce burnout and improve job satisfaction among behavior technicians. This paper reviews various studies that examine the role of supervisor support, emotional resilience, …

Modifying The Miller Test To Supplement Board Of Education V. Pico: A Novel Approach For Resolving Censorship Cases In School Libraries, Michael Lee Jan 2025

Modifying The Miller Test To Supplement Board Of Education V. Pico: A Novel Approach For Resolving Censorship Cases In School Libraries, Michael Lee

Southern Illinois University Law Journal

In recent years, the increase in book censorship laws and attempts in school libraries across the United States has led to concerns about the propriety of such censorships. This has drawn much attention to the Supreme Court’s decision in Board of Education v. Pico, which established the standard for evaluating the constitutionality of removing books from school libraries. Yet, by analyzing, under the Pico standard, the constitutionality of Texas, Florida, and Illinois’s laws pertaining to book censorship, this Note demonstrates that the Pico standard is practically limited and difficult to apply. Therefore, a more applicable test for analyzing the …

Networked To Work?: An Analysis Of A Community College Workforce Development Program, Cynthia Finley, Kim E. Bullington, Mitchell Williams, David Ayers

Online Journal for Workforce Education and Development

Barriers to education and training can have a generational impact on socioeconomic status and economic development. Post-traditional students have been shown to experience a variety of barriers to education and family sustaining employment. Social capital has been shown to help alleviate some of the barriers for students resulting in stronger economic outcomes, such job retention, and higher wages.

The purpose of this case study was to determine if the Network2Work model at Piedmont Virginia Community College (PVCC) can affect outcomes for students from low socio-economic backgrounds by comparing Network2Work outcomes to non-Network2Work noncredit industry training outcomes. The research compared outcome …

“It’S Not Just Finding Them A Job”, (Re) Imagining Meaningful Employment And Economic Inclusion Among Forced Migrants: Narratives From Service Providers, Hanna Haran, Yesenia Alvarez Padilla, Jaclyn Kirsch, Arati Maleku

Online Journal for Workforce Education and Development

Refugees and other forced migrants encounter numerous obstacles in securing employment that match their skills and qualifications. Building upon existing migration literature that explores integration into the United States labor market, this study investigates economic inclusion and the challenges and opportunities newcomers face in obtaining meaningful employment and utilizing their past education and work experience. We collected data through one-on-one interviews with service providers and community leaders (N = 11) engaged in refugee and forced migrant employment support, with over half (54.4%) identifying as migrants themselves. Data was analyzed using grounded theory techniques. The analysis yielded five overarching themes: (1) …

Comprehensive Guide For Cte Teachers: Implementing Functional Behavioral Assessments And Individualized Behavior Support Plans For Students With Intellectual And Developmental Disabilities, Hannah Martinez-Davenport, Debra Heban, Dawn Sandt

Online Journal for Workforce Education and Development

The training and requirements for initial licensure of Career and Technical Education (CTE) teachers exhibit considerable variation across states, potentially resulting in a limited familiarity with high-impact special education practices among CTE educators. Two critical practices within this domain are the conduct of Functional Behavior Assessments (FBAs) and the design of Individualized Behavior Support Plans (IBSPs). The FBA process entails a thorough, team-based approach to data collection and analysis aimed at identifying the underlying causes of behaviors that impede a student with a disability from achieving academic, social, emotional, and vocational objectives. Based on the insights derived from the FBA, …

Is Modern Constitutional Law Making Us Unhealthy?, Michael Conklin Dec 2024

Is Modern Constitutional Law Making Us Unhealthy?, Michael Conklin

Southern Illinois University Law Journal

This is a review of Wendy E. Parmet’s new book, Constitutional Contagion: COVID, the Courts, and Public Health. The book adequately exposes the reader to criticism of modern jurisprudence involving COVID-19. However, this review focuses on three areas of critique: comparing red states versus blue states for COVID-19 response outcomes, the inability of science to make public policy pronouncements, and the alleged connection between a healthy democracy and healthy citizens. Additionally, the ends-justify-the-means theme throughout the book is critiqued as an invalid form of constitutional interpretation.

A Right To Be Heard: A Proposal For Independent Victim’S Counsel For Sexual Assault Survivors, Madelyn Hayward Dec 2024

A Right To Be Heard: A Proposal For Independent Victim’S Counsel For Sexual Assault Survivors, Madelyn Hayward

Southern Illinois University Law Journal

In the last two decades, there have been several helpful and progressive reforms dedicated to changing the landscape of sexual violence. Yet, survivors of sexual assault lack a voice in the criminal justice process. The support offered by victim advocates and coordinators allows victims to be seen but not heard by the court. This Note contends that the progressive step the criminal justice system must take is an independent victim’s counsel program similar to the United States military. This Note proposes model legislation establishing an Independent Victim’s Counsel program in federal and state criminal justice systems. It is time for …

Teaching Ettingerian Matrixial Theory, R. Michael Fisher Dec 2024

Teaching Ettingerian Matrixial Theory, R. Michael Fisher

Artizein: Arts and Teaching Journal

Utilizing an adapted scoping review of the literature on Bracha L. Ettinger and Education (2008-2024), the author reveals the specific ways that Ettingerian Matrixial Theory (EMT) and its pedagogies are taught and can be taught in the future. EMT is argued to be a new branch of Critical Theory. The current literature shows there is mostly engagement with EMT in academic settings. As well, the literature reviewed shows EMT is used readily in arts and with artists as teachers and teachings for adults. However, the author unveils diverse other possibilities of teaching EMT. A few major themes from the literature …

Weaving Care Threads: Matrixial Encounters In Teacher Professional Learning, Misty Paterson Dec 2024

Weaving Care Threads: Matrixial Encounters In Teacher Professional Learning, Misty Paterson

Artizein: Arts and Teaching Journal

The need for increased care in today’s classrooms is becoming undeniable. Yet, teacher shortages, budget cutbacks, and mental health crises makes injecting care into our field feel evermore demanding and depleting. What if abundant and systemic care was at our fingertips? This article shares the voices and processes of six seasoned, “non-artist” educators as they co-created a learning space that prioritized a relational, social-based, caring sensibility through art-care practices. The author brings the lens of Ettinger's Matrixial Theory to her practitioner inquiry into caring affect through Spontaneous Creation-Making (Bickel & Fisher, 2023) with promising and pragmatic implications for teacher educators.

A Matrixial Museum: Education In Almost-Impossible Spaces, Valerie Oved Giovanini Dec 2024

A Matrixial Museum: Education In Almost-Impossible Spaces, Valerie Oved Giovanini

Artizein: Arts and Teaching Journal

This paper is meant to scaffold an imaginary space for what is currently an almost impossible museum. It would reside on a border between Gaza and Israel. Artists and participants would be able to enter from both sides of the border into a circular and cavernous space to make, share and experience art together. In artwork that values its relational capacity to affect another, the move from aesthetics to ethics recalls our mutual place of origin understood in Bracha L. Ettinger’s Matrixial Theory (EMT) as “the matrixial womb.” Griselda Pollock’s Virtual Feminist Museum, Gur-Ze’ev’s counter-education, feminist pedagogy, and Art-care activism …

Understanding The Relationship Between Humble Leadership, Reflecting Dialogue, Psychological Safety And Job Satisfaction: A Study Of Japanese Correctional Officers, Yayoi Kimura

Theses

This study investigates the relationships between humble leadership, reflecting dialogue, psychological safety, and job satisfaction among correctional officers in Japanese correctional institutions. Correctional officers face high levels of stress due to their demanding roles in rehabilitating and managing inmates, yet the impact of organizational factors on their job satisfaction remains underexplored. As Japan undergoes significant changes in its penal system, understanding the factors that contribute to a supportive work environment is crucial. First, this study examines the relationship between psychological safety and job satisfaction among correctional officers. Second, it explores whether facilities that practice reflecting dialogue and humble leadership experience …

Artificial Intelligence, Machines, Devices, And Robots: Mobilizing Humanness And Intelligence In The American Techno-Landscape, Carlos A. Batres Dec 2024

Artificial Intelligence, Machines, Devices, And Robots: Mobilizing Humanness And Intelligence In The American Techno-Landscape, Carlos A. Batres

Dissertations

This dissertation is an ethnographic inquiry of artificial intelligence (AI) in the techno-landscape of three major metropolitan areas in the United States. It traces the ways in which both experts and non-experts talk about their interactions with AI via machines, robots, and other devices, and how the ways in which people deal with AI-technologies have come to shape how we think about our own ways of going about doing things. The goal is to discern what the social ramifications of this technology may be as relationships and relations are formed betwixt and between people and artificially intelligent things.

Second- And Third-Party Punishment In Common-Pool Resource Management, Jacquelyn Spence Dec 2024

Second- And Third-Party Punishment In Common-Pool Resource Management, Jacquelyn Spence

Theses

Common-pool resources play a significant role in many economies, especially in developing countries where they are a critical source of food, income, and employment for communities. Long term management of common-pool resources can be challenging because the continued existence of the resource depends upon balancing the rate of resource depletion with the rate of repletion. Effective management of these resources is vital for protecting the environment and preserving the resources for future generations as overuse and degradation can have serious impacts on ecosystems and biodiversity. Elinor Ostrom’s design principles for common-pool resource (CPR) management provide valuable insight into human interaction …

Examining The Relationship Between Internalizing, Externalizing, And Psychotic Psychopathology At Five Levels Of Criminal Risk, Cooper Mitchell Sparks Dec 2024

Examining The Relationship Between Internalizing, Externalizing, And Psychotic Psychopathology At Five Levels Of Criminal Risk, Cooper Mitchell Sparks

Theses

Though it is well established that mental illness is not a primary risk factor for criminal justice involvement, the relationship between mental illness and criminal risk with justice-involved persons with mental illness is not well understood (Bonta, et al., 1998; Morgan, et al., 2010; Skeem, et al., 2014). Specifically, psychopathology has not been understood at different levels of criminal risk. Using the Five-Level Risk and Needs System for criminal risk (Hanson, et al., 2017), the current study aimed to identify mean differences between different domains of psychopathology (i.e., internalizing, externalizing, and psychotic psychopathology) across five levels of criminal risk. Data …

A Focus On The Social Validity Of Treating Stereotypy Using Response Interruption And Redirection, Maggie Grace Ratcliff Dec 2024

A Focus On The Social Validity Of Treating Stereotypy Using Response Interruption And Redirection, Maggie Grace Ratcliff

Theses

Stereotypy refers to a class of operant repetitive motor and vocal responses with no readily apparent goal or purpose (Rapp & Vollmer, 2005; Singer, 2009; Wunderlich et al., 2023). Although most stereotypy is clinically insignificant and does not warrant treatment (i.e., nail biting, hair twirling), some stereotypy persists at a frequency or severity which interferes with skill acquisition, social interactions, and daily living skills. Stereotypy which persists at this level is considered clinically significant and is often the target of treatment (Wunderlich et al., 2023). A variety of evidence-based treatments for the reduction of stereotypy exist, though some neurodiversity advocates …

Using Stimulus Equivalence Procedures To Increase Police Officers' Identification Of Behavioral Functions, Caitlin Sturges Dec 2024

Using Stimulus Equivalence Procedures To Increase Police Officers' Identification Of Behavioral Functions, Caitlin Sturges

Theses

Mentalistic constructs and theories have been spouted since the dawn of mankind to explain the many behaviors of humans. These philosophies, however, leave many unanswered questions in society’s understanding of why complex behaviors (e.g., the multifaceted behaviors between police officers and citizens) occur. Society has entered an era of policing reform. Moreover, society is in search of answers as to why violent and seemingly complex behaviors are on the rise between law enforcement officials and citizens. The purpose of this study was to teach police officers the four functions of behavior utilizing equivalence-based instruction (EBI). Three active-duty law enforcement officials …

Exploring Subclinical Delusional Ideation Within The Psychological Flexibility Model, Caleb Spencer Fogle Dec 2024

Exploring Subclinical Delusional Ideation Within The Psychological Flexibility Model, Caleb Spencer Fogle

Dissertations

Delusional thoughts are defined as stable beliefs that are not amenable to change when conflicting evidence is presented. Like psychosis broadly, endorsement of delusional ideation appears to exist on a continuum ranging from severe to common endorsement in non-clinical samples. Delusional ideation, particularly in a subclinical conceptualization, fails to receive adequate attention in psychological research despite potential connections to both negative (i.e., symptoms of psychopathology) and positive (i.e., quality of life) outcomes. The psychological flexibility model, a conceptualization of human wellness in Acceptance and Commitment Therapy (ACT), may explain delusional ideation. The current study aimed to fill these gaps in …

New American Terminology And The Immigrant Identity, Sheyla Finkelshteyn, Kate Nimako Nov 2024

New American Terminology And The Immigrant Identity, Sheyla Finkelshteyn, Kate Nimako

Kaleidoscope: A Graduate Journal of Qualitative Communication Research

Many cities in the US have a “new” American Welcoming Center with welcoming programs aimed at helping immigrants integrate into American society (NAWC, 2022; COC, 2022a). The language used by these centers implies that (1) there is a desire for immigrants to change to fit into the society (Wang & Mallinckrodt, 2006), (2) all immigrants are new to America and need to fit in and (3) American identity is the primary identity of a new immigrant. 19 immigrants shared their stories with us. We used Riessman’s (2008) thematic and dialogic analysis approach to analyze their identity and attitude toward the …

Co-Ethnic Voting And The Analysis Of Trust Levels In Nigeria, Ayorinde Olanrewaju Nov 2024

Co-Ethnic Voting And The Analysis Of Trust Levels In Nigeria, Ayorinde Olanrewaju

Research Papers

Hale's (2008) relational theory posits that when less politically relevant ethnic groups experience marginalization and exploitation from the dominant ethnic groups, it creates an orientation in which these groups trust only their co-ethnics in distributing patronage and public goods. To what extent do variations in institutional trust among ethnic groups influence co-ethnic voting behavior? I argue that levels of trust in the president can be understood as one of the conditions under which voters use ethnic identity to decide their vote choice. When trust in a co-ethnic candidate is high, members of an ethnic group will prefer to vote along …

Federal Precedents And State Consequences: Tracing The Impact Of Recent Federal Environmental Decisions On Illinois Law, Arielle Mcpherson Aug 2024

Federal Precedents And State Consequences: Tracing The Impact Of Recent Federal Environmental Decisions On Illinois Law, Arielle Mcpherson

Southern Illinois University Law Journal

In recent years, the landscape of environmental law has been reshaped by a series of landmark federal court decisions. This Article explores the transformative impact of three pivotal environmental decisions—Juliana v. United States, Board of County Commissioners of Boulder County v. Suncor Energy, Inc., and Sackett v. Environmental Protection Agency—on the environmental legal landscape in Illinois. These cases collectively challenge boundaries and raise critical questions about federal government accountability for climate change, corporate environmental liability, and the delicate balance between federal and state governance over environmental issues. First, this Article will examine the important rulings from each case dissecting the …
