One Act, Many Crimes? Analyzing The Court’S Decision In People V. Almond, 2015 Il 113817, 32 N.E.3d 535, Rahnesha Williams
Southern Illinois University Law Journal
One act should only amount to one crime. Illinois employs the one-act, one-crime doctrine which, as the name states, only allows a defendant to be convicted of one offense, based on a single act. The Illinois Supreme Court has constantly redefined and changed the circumstances of when this rule applies. More recently, it has failed to apply this rule in situations that it was created to prevent.
In People v. Almond, the Illinois Supreme Court decided not to apply the one-act, one-crime doctrine where the defendant had been charged with two crimes—possession of a gun and possession of the …

Rap Lyrics, Schools, And Free Speech: Examining The Limits Of Free Speech Of Students Outside Of Schools And On Social Media, Bret M. Thixton
Southern Illinois University Law Journal
With the rise of the political correctness movement, the education system is split on how best to handle issues revolving around student speech. Some institutions clamp down on students by creating safe spaces or instructing teachers and professors to avoid certain words; others continue to allow students to exercise their various forms of speech nearly unabridged. Each institution has its own speech policy, and policies can vary from extremely limiting to a nearly free-range for ideas, speech, and expression. While the Constitution allows for freedom of speech, the Supreme Court has found that in certain situations, that right may be …
(Re)Defining Transnational Identities Through Diaspora Philanthropy In South Asian Indian Non-Profit Organisations, Noorie Baig
(Re)Defining Transnational Identities Through Diaspora Philanthropy In South Asian Indian Non-Profit Organisations, Noorie Baig
Kaleidoscope: A Graduate Journal of Qualitative Communication Research
Abstract
This paper identifies “diaspora philanthropy” as an important dimension to maintaining transnational identities among South Asian Indian Americans. Several South Asian initiatives and organisations promote involvement to the motherland (homeland) as individuals negotiate a sense of belonging in a migrant context. It is important to explore the motivations behind this new type of socio-political activism that is fuelled by a sense of responsibility to the motherland. I examine three non-government, South Asian Indian organisation websites that are shaped by globalisation, as a means explore new trends in diaspora philanthropy. A critical intercultural communication framework is used to explore how …

Application Of Environmental Tracers In The Memphis Aquifer And Implication For Sustainability Of Groundwater Resources In The Memphis Metropolitan Area, Tennessee, Daniel Larsen, Brian Waldron, Scott Schoefernacker, Haley Gallo, John Koban, Elizabeth Bradshaw
Journal of Contemporary Water Research and Education
Fourteen years of results from environmental tracer sampling for 3 H, He isotopes, noble gases, and SF 6 in production wells screened in the Memphis aquifer in Memphis, Tennessee, are presented and used to determine the age and mass proportion of modern water (<60 years old) pumped from this regionally important public supply aquifer. The results indicate persistent presence of modern water in water pumped from one or more production wells in most of the well fields sampled. The percentage of modern water is quantified by three methods: tritium-loading history, inverse geochemical modeling, and lumped parameter modeling. The mixing percentages and ages determined from each technique are generally in agreement, but also emphasize the unique information provided by each tracer and associated modeling approaches. The implications of the tracer data for sustainability and vulnerability are also considered, especially in regard to potential water quality threats to the water supply in the Memphis, Tennessee, metropolitan area.
Issues Of Stream-Aquifer Interactions In Grout Lined Channels In Urban Watersheds, Barry Hibbs, Michael Harrison, Mercedes Merino
Issues Of Stream-Aquifer Interactions In Grout Lined Channels In Urban Watersheds, Barry Hibbs, Michael Harrison, Mercedes Merino
Journal of Contemporary Water Research and Education
Grout lined storm drains are used worldwide to convey storm runoff away from urban areas. They also convey dry weather flows such as car wash runoff, lawn runoff, and other "nuisance flows" in urban centers. Areas in Southern California and elsewhere have shallow water tables where dry weather flows in grout lined storm drains consist primarily of perennial groundwater baseflows. In these areas, groundwater leaks through cracks, joints, weepholes, and intentional dewatering structures into storm drains and eventually flows into natural channels, coastal wetlands, and estuaries. The "lined" sections of these channels are not always impervious; in fact, the lining …

The cell membrane is the interface that volumetrically isolates cellular components from the cell’s environment. Proteins embedded within and on the membrane have varied biological functions: reception of external biochemical signals, as membrane channels, amplification and regulation of chemical signals through secondary messenger molecules, controlled exocytosis, endocytosis, phagocytosis, organized recruitment and sequestration of cytosolic complex proteins, cell division processes, organization of the cytoskeleton and more. The membrane’s bioelectrical role is enabled by the physiologically controlled release and accumulation of electrochemical potential modulating molecules across the membrane through specialized ion channels (e.g., Na+, Ca2+, K+ channels). The membrane’s biomechanical functions include …
Design Techniques For Direct Digital Synthesis Circuits With Improved Frequency Accuracy Over Wide Frequency Ranges, Stefan Leitner, Haibo Wang, Spyros Tragoudas
Design Techniques For Direct Digital Synthesis Circuits With Improved Frequency Accuracy Over Wide Frequency Ranges, Stefan Leitner, Haibo Wang, Spyros Tragoudas
Articles
Recently, there are increasing interests in impedance sensors for various applications. Direct digital synthesis (DDS) circuits are commonly used in such sensor circuits for generating stimulus signals, due to the advantages of accurate frequency control, drift-free performance, etc. Previously reported DDS circuits for sensor applications typically maintain superb frequency accuracy within relatively small frequency ranges. This paper investigates techniques to improve frequency accuracy over wide frequency ranges. In addition, it presents an analytical framework to estimate the signal to noise ratio (SNR) of the generated signal and derives guidelines for optimizing DDS circuit configurations. Both simulation and hardware measurement results …

The Presidential Election In Illinois: 2016 Compared To 2012 And 2008., John Jackson
The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)
This paper describes and analyzes the 2016 general election results in Illinois and compares those results to the 2012 and 2008 presidential elections. The primary unit of analysis in this paper is the 102 counties in Illinois and the aggregate vote results at the state and county level. Those aggregate data voting returns are supplemented with statewide survey data taken from the Paul Simon Institute’s periodic polls which allows an individual voter level of analysis to add to the aggregate data.

Post Occupancy Evaluation An Academic Building: Lessons To Learn, Reza T. Ahmadi, Diana Saiki, Charles Ellis
Post Occupancy Evaluation An Academic Building: Lessons To Learn, Reza T. Ahmadi, Diana Saiki, Charles Ellis
Journal of Applied Sciences and Arts
Post occupancy evaluation (POE) is a tool used to determine the users’ satisfaction of a building after its completion. Most educational facilities do not conduct a post occupancy evaluation due to the absence of it in the contract agreement between the institution and architect. The client often chooses to bypass the POE to reduce the cost of the project. The purpose of this research is to conduct a POE of an academic building and identify areas of user dissatisfaction in order to enhance future projects. An academic building on a major, Midwestern university campus was remodeled during the academic year …
Complexity As A Narrative, Giacomo Pala
Complexity As A Narrative, Giacomo Pala
Journal of Applied Sciences and Arts
In this paper an attempt is made to discuss how the computer has imposed new conventions to architecture over the last thirty years. The paper’s aim is to discuss how the introduction of digital media has forced architecture to find ways to deal with new technologies and to develop new disciplinary meanings. First, the paper addresses the question of complexity and chaos in the postmodern discussion by the reading of Lyotard’s theories. Therefore, the essay pinpoints attempts of developing new conceptions of “complexity” in architecture derived from the post-modern sciences of indetermination. Interengsly enough, this was doable because both these …

An Analysis Of Academic Library 3d Printing Libguides, Jennifer J. Horton
Articles
3D Printing is increasingly becoming a popular service provided by academic libraries throughout the United States. Many patrons have little or no awareness of this subject matter, so library staff have created LibGuides to promote resources. One hundred LibGuides from academic libraries were analyzed to find which types of resources and which specific titles are being promoted surrounding the subject of 3D printing. Three types of resources emerged in this study: 3D printing and 3D modeling software titles, 3D model repositories, and books related to 3D printing. This article lists and analyzes 3D printing resources.

Marriage Equality Laws Are A Threat To Religious Liberty, L. Darnell Weeden
Marriage Equality Laws Are A Threat To Religious Liberty, L. Darnell Weeden
Southern Illinois University Law Journal
The First Amendment of the United States Constitution contains dual concepts related to religion: freedom to believe and freedom to act. Recent litigation, addressing the conflict between public accommodation of sexual orientation and religious liberty, reveals how legislative and judicial measures diminish the freedom to act in accordance with religious beliefs. The Supreme Court’s decision in Obergefell v. Hodges, which recognized that same-sex couples are afforded the fundamental right to marry, provided more uncertainty for religious liberty and incited debates as to whether this novel right is superior to the long-standing constitutional rights protecting religious liberty.
This Article examines …

Retiring Pension Reform: An Analysis Of In Re Pension Reform Litigation, 2015 Il 118585, 32 N.E.3d 1, Casey Fitzgerald
Southern Illinois University Law Journal
Illinois’ dwindling financial condition is near an all-time low. In response, the Illinois General Assembly has attempted to reduce the fiscal burden by statutorily decreasing the benefits allotted to state pensioners, despite the pension protection clause of the Illinois Constitution. In 2013, the General Assembly passed Public Act 98-599, which lowered the pension benefits allotted to state employees who began contributing to the pension system before January 1, 2011. In In re Pension Reform Litigation, the Illinois Supreme Court deemed this measure unconstitutional.
This Note argues that the Illinois Supreme Court reached the correct decision. However, rather than determining …

Tweet Along: Analyzing The Relationship Between Social Media And Television Ratings, Christian Holt
Research Papers
Television ratings affect everything from advertising rates to the time a show is scheduled, and ultimately, its success. In recent years, rating methods have been updated not only to include live viewings, but also viewers who record and stream shows on the Internet. This is the result of living in a digital age. The pressure put on those who create television shows to get high ratings is even more intense, and viewers now expect a level of interaction from actors, writers and television staff on social media. This study examines the importance of the relationship between social media presence and …

As a GTA working in a critically oriented Communication Studies department at Southern Illinois University, Carbondale, I am encouraged to be(come) an instructor whose teaching methods are steeped in the principles of critical pedagogy. One of the most inhibiting things I have come across as I have made attempts to uphold such principles of critical pedagogy is the issue of time.
This research report is about the problematic tension of trying to uphold a critical pedagogy in a system – a capitalist system – in which time is hard to come by. How can we perform an ethic of …
The Ncaa’S Losing Battle: What Happens When Paying Student-Athletes Meets Title Ix?, Lisa M. Scott
The Ncaa’S Losing Battle: What Happens When Paying Student-Athletes Meets Title Ix?, Lisa M. Scott
Southern Illinois University Law Journal
Compensating student-athletes is no longer a far-fetched idea. Lawsuits against the National Collegiate Athletic Association (NCAA) are gaining traction in federal courts, and the NCAA will soon be required to adjust its regulations regarding student-athlete compensation. Any potential compensation must be given to both male and female student-athletes in substantially proportionate numbers under Title IX of the Education Amendments of 1972. The Office of Civil Rights (OCR) determines what constitutes substantially proportionate numbers under Title IX, and therefore, the OCR will determine if collegiate institutions are providing proportionate compensation to student athletes.
This Comment argues that allowing collegiate institutions to …

American Nationalism And The “Curse Of Rurality”: Urban-Rural Differences And The Notion Of National Belonging, Milos Djeric
Research Papers
Relationship between nationalism and urban or rural environment is not one that is often studied, apart from traditional historical interpretation of it being a modern, urban phenomenon, characterized by imagery and discourse of rurality. Yet it seems that, in the last several decades, not only have nationalist conflicts mostly been rooted within the countryside and nationalist agendas won on elections in them, but that there is a more fundamental connection between nationalism and rurality. While briefly addressing this issue, this paper focuses on the analysis of 2014 GSS data, exploring the relationship between the place of living and the notion …

Auditory Fatigue Model Applications To Predict Noise Induced Hearing Loss In Human And Chinchilla, Pengfei Sun, Daniel Fox, Kathleen Campbell, Jun Qin
Articles
Noise induced hearing loss (NIHL) remains a severe health problem worldwide. Current noise metrics and models have assessment limitations on gradually developing NIHL (GDNIHL). In this study, we apply a complex velocity level (CVL) auditory fatigue model to quantitatively assess the impact of basilar membrane (BM) movement on GDNIHL. The transfer functions of chinchilla and human auditory systems, including the triple-path nonlinear (TRNL) filters to simulate the inner ear responses, are applied to obtain BM velocity distribution. Chinchilla and human experimental hearing loss data are used to validate the proposed CVL model’s effectiveness. The results reveal that the developed CVL …
