Constitutional Law Issue, Brett H. Pritchard Sep 1995

Constitutional Law Issue, Brett H. Pritchard

Brigham Young University Prelaw Review

In Fall Semester 1995 the area of emphasis was Constitutional Law with a focus on Church and State issues. Separation of Church and State, by Robert L. Cord, and The Right to Religious Liberty: A Basic ACLU Guide, by Bany Lynn, Marc D. Stem, and Oliver S. Thomas were used as texts. Students had the opportunity to research two church-state cases. Some of the cases students chose were: Everson v. Board of Education, Engel v. Vitale, Corporation of the Presiding Bishop v. Amos, Abington v. Schempp, and Lemon v. Kurtzman. These papers represent the best of the student research in …

Lemon V. Kurtzman (Lemon I), 1971, Nathan Dorius Sep 1995

Lemon V. Kurtzman (Lemon I), 1971, Nathan Dorius

Brigham Young University Prelaw Review

Since the authors of the Constitution first gathered to create the supreme law of the land, the relationship between church and state has often been at the forefront of debate. The contention has been over interpretation of the First Amendment's Religion Clause: "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof;... " This portion of the First Amendment has been divided by the courts into two separate "clauses", one being the Establishment Clause and the other being the Free Exercise Clause. In 1947 the United States Supreme Court (hereafter referred to as "the …

States Overstepping The Constitutional Bounds In Religious Activities As Demonstrated In Abington V. Schempp, James J. Dickey Sep 1995

States Overstepping The Constitutional Bounds In Religious Activities As Demonstrated In Abington V. Schempp, James J. Dickey

Brigham Young University Prelaw Review

Do states overstep constitutional bounds when they conduct religious exercises? This is the question argued before the Supreme Court in 1963 in the landmark case School District of Abington Township, Pennsylvania, et al. v. Edward Lewis Schempp et al. (Abington v. Schempp) (374 U.S. 203). This paper will answer the previously asked question by addressing the following areas as they relate to the Abington v. Schempp case:

  • Facts of the case

  • Arguments of each side of the case

  • Majority and minority opinions of the Justices

  • Opinion of prominent writers

  • My personal opinion

  • Impact of this case on the interpretation of …

The Rising Wall: Everson V. Board O(Education, Rose Lindsay Sep 1995

The Rising Wall: Everson V. Board O(Education, Rose Lindsay

Brigham Young University Prelaw Review

The interlocking of church and state has been one of the most prolific sources of human strife. The American founding fathers recognized the precarious nature of the relationship between church and state. They accepted the basic premise, enunciated by James Madison in his Memorial and Remonstrance Against Religious Assessments, "religion is not within the cognizance of Civil Government"(Cord 1982, 247). To prevent the treacherous combination of religious power with federal power, the founding fathers added the First Amendment to the United States Constitution in 1791. Breaking sharply with the past's tradition of melding church and state, they declared. "Congress shall …

Prayer In School: Engel V. Vitale, Douglas Marteeny Sep 1995

Prayer In School: Engel V. Vitale, Douglas Marteeny

Brigham Young University Prelaw Review

As another election year approaches, the issue of prayer in school is revisited in many political debates. The conservatives often demand their right to pray in school should be protected by the Constitution, whereas, on the other end of the spectrum citizens argue for a stronger, higher wall separating church and state. In this report I will first discuss the Engel v. Vitale case, as argued before the Supreme Court, which deemed illegal prayer-in-school. I will then highlight some commentaries given regarding this case. Lastly, I will offer my own resolution to the many debates surrounding the prayer in school …

Corporation Of The Presiding Bishop V. Amos, Matthew David Dimick Sep 1995

Corporation Of The Presiding Bishop V. Amos, Matthew David Dimick

Brigham Young University Prelaw Review

The Supreme Court has long sought for a consistent principle in constitutional theory that will "be a master principle that can guide the interpretation of both religion clauses" (Tushnet, 1691). Indeed, at times both the Establishment Clause and the Free Exercise Clause seem to contradict. Such an instance arose in Corporation of the Presiding Bishop v. Amos. In this case the Court applied the religious accommodation principle to allow a religious group the right to remain an autonomous entity thereby maintaining protection guaranteed under the Free Exercise Clause, also recognizing "that the government may (and sometimes must) accommodate religious practices …

Poetic Diction And Parallel Word Pairs In The Book Of Mormon, Kevin L. Barney Jul 1995

Poetic Diction And Parallel Word Pairs In The Book Of Mormon, Kevin L. Barney

Journal of Book of Mormon Studies

Hebrew poetry is based on various patterns of parallelism. Parallel lines are in turn created by the use of parallel words, that is, pairs of words bearing generally synonymous or antithetic meanings. Since the 1930s, scholars have come to realize that many of these “word pairs” were used repeatedly in a formulaic fashion as the basic building blocks of different parallel lines. The Book of Mormon reflects numerous parallel structures, including synonymous parallelism, antithetic parallelism, and chiasmus. As word pairs are a function of parallelism, the presence of such parallel structures in the Book of Mormon suggests the possible presence …

Soft Sediment Benthic Macroinvertebrate Communities Of The Green River At The Ouray National Wildlife Refuge, Uintah County, Utah, Eric R. Wolz, Dennis K. Shiozawa Jul 1995

Soft Sediment Benthic Macroinvertebrate Communities Of The Green River At The Ouray National Wildlife Refuge, Uintah County, Utah, Eric R. Wolz, Dennis K. Shiozawa

Great Basin Naturalist

Benthic macroinvertebrates from four habitat types (river channel, ephemeral side channel, river backwater, and seasonally inundated wetland) were examined from the Green River at the Ouray National Wildlife Refuge, Uintah County, UT, June–August 1991. For major taxa (Nematoda, Oligochaeta, Diptera: Ceratopogonidea, and Chironomidae) were quantified. Cluster analysis of densities showed that habitat types with comparable flow conditions were the most similar. Highest to lowest overall benthic invertebrate densities of the four habitats were as follows: ephemeral side channel, river backwater, seasonally inundated wetland, and river channel. Nematodes were the most abundant taxon in all habitat types and sample dates except …

Benthic Community Structure In Two Adjacent Streams In Yellowstone National Park Five Years After The 1988 Wildfires, G. Wayne Minshall, Christopher T. Robinson, Todd V. Royer, Samuel R. Rushforth Jul 1995

Benthic Community Structure In Two Adjacent Streams In Yellowstone National Park Five Years After The 1988 Wildfires, G. Wayne Minshall, Christopher T. Robinson, Todd V. Royer, Samuel R. Rushforth

Great Basin Naturalist

Physical characteristics, benthic macroinvertebrates, and periphyton assemblages in two adjacent headwater streams in Yellowstone National Park were evaluated five years after the 1988 wildfires. The catchment of one stream was burned by wildfire (burned stream) while the other catchment was unburned (unburned stream). Physical measures revealed channel alteration in the burned stream relative to the unburned stream. Periphyton biomass was lower in the burned than the unburned stream (29.2 vs. 50.5 g/m2 AFDM, respectively), further demonstrating the unstable physical conditions of that system. Kendall's coefficient of concordance (an index of similarity) between diatom assemblages was 0.22, indicating distinct assemblage …

Effects Of Browsing By Native Ungulates On The Shrubs In Big Sagebrush Communities In Yellowstone National Park, Francis J. Singer, Roy A. Renkin Jul 1995

Effects Of Browsing By Native Ungulates On The Shrubs In Big Sagebrush Communities In Yellowstone National Park, Francis J. Singer, Roy A. Renkin

Great Basin Naturalist

The effects of elk (Cervus elaphus), pronghorn (Antilocapra americana), and mule deer (Odocoileus hemionus) browsing on shrubs in big sagebrush (Artemisia tridentata) communities were monitored over a 31-year period in Yellowstone National Park. Ungulates were restricting Wyoming big sagebrush (spp. wyomingensis) heights, size, and recruitment on the lower-elevation stratum only, while no such suppression was observed on the high-elevation stratum. Parallel increases in mountain big sagebrush (spp. vaseyana) densities and cover occurred over the study period on both browsed and unbrowsed sites at the higher-elevation stratum, although big sagebrush, green …

Liquid Crystal-On-Silicon Implementation Of The Partial Pixel Three-Dimensional Display Architecture, M. W. Jones, Gregory P. Nordin, M. Friends, S. T. Kowel, J. H. Kulick, R. G. Lindquist, P. J. Nasiatka

Faculty Publications

We report the implementation of a liquid crystal-on-silicon, three-dimensional 13-D2 diffractive display based on the partial pixel architecture. The display generates multiple stereoscopic images that are perceived as a static 3-D scene with one-dimensional motion parallax in a manner that is functionally equivalent to a holographic stereogram. The images are created with diffraction gratings formed in a thin liquid crystal layer by fringing electric fields from transparent indium tin oxide interdigitated electrodes. The electrodes are controlled by an external drive signal that permits the 3-D scene to be turned on and off. The display has a contrast ratio of 5.8, …

Youth Gang Violence: Community Interventions, Dale F. Pearson Apr 1995

Youth Gang Violence: Community Interventions, Dale F. Pearson

Issues in Religion and Psychotherapy

The rise of gang activity and crime--such as homicides, drive-by shootings, drug trafficking, burglary, and graffiti--poses a serious threat to many communities, including Utah. While juvenile homicides are relativety rare and constitute a fraction of all juvenile crime, its prevalence at all is a serious concern to parents, schools, and families in general. Some core problems which have given rise to the increase in violent gangs in society are discussed. Strategies and community interventions are recommended for this escalating social concern.
