The Possible Future Of Private Rights Of Action For Proxy Fraud: The Parallel Between Borak And Wilko, C. Steven Bradford

This is a story of parallels-two cases decided by the United States Supreme Court eleven years apart, one now overruled, the other unchallenged for over twenty-five years. Both cases are important federal securities law decisions, but substantively they are quite different. In Wilko v. Swan, a 1953 decision, the Supreme Court held that predispute agreements to arbitrate claims arising under the Securities Act of 1933 (1933 Act) were unenforceable because arbitration would not adequately protect the rights the 1933 Act gave injured investors. In J.I. Case Co. v. Borak, decided in 1964, the Court held that persons injured …

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State

The State Department of Highways and Public Transportation (SDHPT) conducted archaeological testing within the right-of-way of FM 1929 at site 41CN218 in Coleman County, and in the vicinity of site complex 41CC48/49/50/51 and 41CC52 in Concho County. Intensive surface survey and mapping was also undertaken at site 41CC246 in Concho County. This report details the work undertaken, and summarizes the cultural sequence of the area.

Excavations at site 41CN218 did not reveal any evidence of discrete cultural stratigraphy. Rather it appeared that artifacts were scattered throughout an upper brownish soil horizon, which in places reached depths of about 2 meters. …

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State

The State Department of Highways and Public Transportation (SDHPT) conducted archaeological significance testing at Sites 41FY170 and 41FY509 which are within the right-of-way proposed improvements to State Highway 71 in the vicinity of Plum, a community in Fayette County. As the construction will use federal funding, the testing was undertaken under the guidelines of the National Historic Preservation Act of 1966 and its implementing regulations, 36CFR, Part 800, and the National Environmental Policy Act.

Testing at Site 41FY170 revealed both prehistoric and historic artifacts. The prehistoric artifacts, none of which are temporally or culturally diagnostic, indicate that the area was …

The Mohawk Glass Trade Bead Chronology: Ca. 1560-1785, Donald A. Rumrill

BEADS: Journal of the Society of Bead Researchers

Early glass beads acquired by the Mohawk Indians of New York state were a mixture of whatever was made available to them by European traders. By the second quarter of the 17th century, the beads reflected a dominance of particular types and/or colors as villages were relocated. This phenomenon appears to have ritualistic connotations and suggests that the bead-selection process was a part of the ceremonialism practiced in the daily, seasonal and annual life modes of the Mohawk. Excerpt: "At the age of eighteen, American youths must make an ideological decision about war. Although most probably perceive selective service registration as little more than a rite of passage, others struggle with the ethics of military service and options of conscientious objection.

What can be said of youths who decide, for moral and religious reasons, that they will not be involved in warfare? To date, no descriptive studies have been reported that address this question. This is quite a long book, with a misleading subtitle, about two quite small Welsh settlements in the Maritime Provinces. Even the author admits that the settlements at Cardigan and New Cambria "were insignificant by most of the measures historians commonly use." Nor can it be very highly recommended, even to ethnic students in Canada, because about half of the material is about Welsh maritime history and Canadian provincial politics.

During the summer of 1857, Colonel Edwin Vos Sumner and his troops invaded Cheyenne and Arapaho land. By the 1851 Treaty of Fort Laramie the two tribes were recognized as the occupants of western Kansas and eastern Colorado between the Platte and Arkansas rivers. The treaty also tried to prevent intertribal warfare and to protect emigrants and commerce over the platte River road and the Santa Fe Trail. Careful students of the American West have long realized that making valid generalizations about the officers who served in the frontier army is extraordinarily difficult. For example, a major theme in Soldier West: Biographies from the Military Frontier (1987), edited by Paul Andrew Hutton, was the rich variety in experiences, interests, and personalities among army officers. Now, Smith, an assistant professor of history at the University of Texas at El Paso, demonstrates how ambivalent and contradictory the officers were in their perceptions of virtually every aspect of Indian affairs. The 1960s brought the promise of a new era of social justice for all Americans. Indeed, the overturning of official, state-sanctioned racial structures was a watershed in national life. During the 1970s and 1980s, however, the earlier momentum of the civil rights period dissipated as the end of the postwar economic expansion ushered in a crisis of American culture and polity. "Symbolic racism" emerged as a powerful political and ideological instrument to buttress resistance to racial and ethnic equality. The emphasis on temporal and geographic scale of the French Annales school of history (cf. Braudel 1980; Baker 1984; Lewthwaite 1988) is the inspiration for this paper. Braudel (1980) divides time into three durations: short term events (days, weeks, months, a few years), medium length conjunctures (years, decades, even major portions of centuries), and long term structures (which may last centuries, even millennia). This last duration is the longue durée. If you mix cowboys, Indians, Danes and paint, you come up with two remarkable artists, Olaf Seltzer and Olaf Wieghorst. These two men came to America from Denmark and, after living and working here for numbers of years, produced art that is as American as American art can get. Their subject was the Old West. Although their trips were 27 years apart, both Seltzer and Wieghorst came to America in their teens. Organizations can respond to change in their environments in a variety of planned and unplanned ways. In complex organizations, when the environment is unstable, managers need to examine their assumptions about how organizations function in order to develop effective strategies for introducing creativity and change. This essay reviews the assumptions behind theories of organizational decision making, explores how those assumptions affect how managers decide strategies for introducing change, and offers some ideas on how to introduce creativity into organizations that face ambiguous internal and external environments.

Masters Culminating Experiences (1993-2011)

This thesis examines the automation of the Directorate of Research and Development Contracting at Wright-Patterson Air Force Base. Background information on the Directorate is given along with the previous methods of producing contractual documents. The central problem of the thesis is to determine if the benefits of automating the Directorate outweigh the costs. A cost benefit analysis was used to make this determination. Each cost and each benefit is discussed in great detail along with the methodology used to measure each particular cost and benefit. The results of the study showed that the net present value of all benefits was …
