The purpose of this study is to analyze Supreme Court pronouncements concerning a right of public access to criminal proceedings in order to determine to what extent the Court has recognized a constitutional guarantee of a public trial as it may apply to the accused and to the public and press. Because the question of public access to the courtroom is a relatively new one, this study is principally centered on recent cases which were decided exclusively by the Burger Court, providing a unique opportunity for a "case study." In this paper we examine the sanctioning of one type of political deviance, draft resistance, in two different social and political contexts: an era of coercive control and a period of cooptive control. A focus on the sanctioning of draft resisters allows a unique opportunity to examine the societal response to what the New Criminologists (Taylor et al., 1973:267) describe as the "purposive creator and innovator of action" whose crimes are the product of ". . . individual or collective action taken to Resolve... inequalities of power and interest." In the United States, the rendering of police service is carried out by some of the world's finest forces which operate immediately adjacent to other agencies which have made no earnest move toward improving their methods in field operations since World War II. These deficient agencies seem to cling to tradition and oppose change even when innovations exist which have been shown to be more effective than present methods or when present methods are shown to be ineffective.

In the following pages, I shall outline the basics of a method for studying the motivations of trial judges - or any public officials, for that matter - that I find particularly interesting and fruitful - "incentive theory". The use of incentive theory is, in my view, a preliminary contribution to an ongoing movement to fill glaring gaps in the literature on judicial motivation and trial judging.

The justice of the peace system has long been a part of the judicial process in the United States. The system originated in Great Britain and was transferred to the British colonies in the seventeenth century. Through the years the duties of the justice of the peace increased in number and importance. In recent years the powers of the office have declined and criticism of the system has mounted. As a result sane state governments have eliminated the justice of the peace system entirely and instituted the magistrate system. Two states which have taken such action are Virginia and West …

Four hundred and fifty-four jurors who served on forty-three criminal trials in Syracuse, New York, were sent questionnaires designed to elicit information concerning their deliberative behavior. One hundred and ninety-four jurors representing 42.6 percent of the total sample returned the survey instrument. This figure represents the efforts of one initial survey and two follow-up surveys.
The purpose of the research is to gain insights into individual and collective juror behavior. After a review of the traditional, legal realist, and behavioral literature concerning deliberative behavior several hypotheses were generated and tested. Sociological theory has provided two models that attempt to explain social power and decision making in America, the elite model (Mills) and the pluralist model. Mills saw power in America like particles dispersed in a triangle--with more and more power at the top, but more people at the base of the triangle. For Mills there was a powerful elite that ruled almost like a monarchy and decision making on all fronts was vested in them.
