Autonomy And Secondhand Oil Dependency Of The Yemen Arab Republic, Sheila Carapico

Recent scholarship on state autonomy in the Third World has been influenced by the dependency thesis that capital accumulation at the core of the world economy is associated with economic underdevelopment and political dependency at the periphery. Dependency reasoning is rooted in a devastating empirical critique of the once prevalent modernization paradigm, in which national state policy was the central independent variable. According to dependency theory, peripheral nations' subordinate structural positions in the international political economy results in sacrifice of authoritative policy making to foreign investors, bankers, experts, governments, and institutions or their local counterparts. All societies are more or less complex systems of rules, of symbols andsigns directing and constraining individual behavior. The task of thesocial theorist is to analyze and uncover what order may underlie suchstructures. In this regard he faces at least two major problems. First, hehas to determine how far the rules or norms which govern human action define the distribution of power, responsibility and resources, andso determine the relative value placed upon such goods as education, art and scientific inquiry, and how far the existing structure of distribution of power and resources is itself responsible for the prevalence ofparticular rules. …

Foreign States And The Constitution, Lori Fisler Damrosch

This article does not advocate judicial abstention from deciding the constitutional claims of foreign sovereigns. Rather, the argument is that constitutional claims against the actions of the federal political branches must fail on the merits because of the relationship of foreign states to the federal structure. When, on the other hand, a claim does not directly confront or conflict with the political branches' foreign policy, the federal courts should adjudicate the merits of foreign state claims by applying constitutional jurisprudence to sustain or reject the claim. The Separation Of Law And Morals, Noel B. Reynolds

The classic opposition of legal positivism and natural law theory resurfaces continually and reminds us that we have yet to resolve this key conflict in our ways of understanding the moral authority of law. The strengths and weaknesses of the two theories are reviewed—both have fatal flaws. Conventionalism is proposed as a means of finding internal standards in a man-made system of law. The naturally emerging standards for a conventionalist system of law turn out to be the already familiar principles of the rule of law.

United States Military Special Operations Forces: Why They Are Our Best Military Assets For Low-Intensity Conflicts, Stephen Leslie Robinson

This thesis addresses the development of United States military assets for dealing with revolutionary warfare, terrorism, and other threats which could be identified under the rubric, "low-· intensity conflict." Elite military units, collectively identified as Special Operations Forces (SOF), are examined for the character- !sties and attributes which promote misunderstanding and mistrust about their capabilities. Some analytical distinctions are developed which may be useful in defining roles and missions for SOF elements. Cultural impediments which may inhibit SOF activities are considered as well.
