Methods Of Wage Policy I, Max Rheinstein

Social science has a threefold task: first, that of describing the phenomena of social life; second, that of classifying and arranging these phenomena in a systematic order; and, finally, that of investigating regularities of relations between social phenomena in the order of cause and effect. Wages and governmental efforts to influence their level are social phenomena. In the following article an attempt will be made to classify various methods of governmental wage policy under certain type situations and to arrange these type situations in a systematic order. Legal education in the United States has become more and more a part of university education and the activity of the American university law school is a matter which invites comparison with the law schools of foreign universities. This is true particularly because the system of university legal education has recently also become a "problem" in this country. In 1930 Abraham Flexner published his instructive, but possibly not altogether unbiased, book on universities in which he pictured American, English and German universities. A democratic government such as ours, based upon the theory of popular sovereignty, presents many curious political phenomena. For example: in order to insure a proper balance of the powers, it has been necessary for the Supreme Court to assume the onerous task of passing upon the constitutionality of congressional legislation. It is unfortunate, but necessary, that the Court be obliged to exercise this power of judicial review at a time when the entire country is suffering from the effects of a severe and sustained economic depression. It is unfortunate, too, that the legislation under judicial examination should involve questions …

As upon certiorari, the New Mexico Supreme Court considered the question, whether it is "within legislative competence to declare a public use in the industry of coal mining, so as to permit taking private property in aid of it." Plaintiff had obtained a judgment of condemnation, and defendant attacked it as offensive to the New Mexico constitutional provision: "Private property shall not be taken or damaged for public use without just compensation." The opinion recognized the existence of an "orthodox" and a "liberal" doctrine of construing "public use." While the court found that, unlike Nevada's or Utah's, New Mexico's well-being …
