Foster Parents Versus Agencies: A Case Study In The Judicial Application Of "The Best Interests Of The Child" Doctrine, Sanford N. Katz
Michigan Law Review
A recurring problem which courts face is the need to resolve the conflict which arises when foster parents challenge the decision of agencies that have disqualified these persons from continuing their relationship with or adopting their foster child. This article will explore the role of courts in resolving these disputes and will suggest some criteria by which the courts may be guided in deciding such questions.

The veterinarian's liability is measured by the same basic standards applicable to physicians and surgeons. In both fields the technical nature of the malpractice action creates special problems. To determine the issue of liability the jury must identify both the historical facts and the standard of care. Attempting to resolve issues of medical fact may be difficult for a lay jury; such resolution demanding as it does, not merely an appraisal of the witnesses' demeanor and character, but an evaluation of their stories in the context of the situation giving rise to the cause of action.

Reasonable Mistake Of Age: A Needed Defense To Statutory Rape, Larry W. Myers

Hernandez represents the first positive judicial step toward changing the irrational rules which currently control the crime of statutory rape, and its import should furnish a touchstone for the future development of the law of all sex crimes. In the brief period since the Hernandez decision was handed down it has been reaffirmed by its authors, and the legislatures in two other states have enacted statutes which embrace its sound reasoning. However, at least one state has evidenced an intent to follow the traditional judicial approach of imposing strict liability, notwithstanding the defendant's reasonable mistake with respect to the true …

I. The Background of the Conflict
In the summer of 1932, while the world's attention was focused upon Japanese aggression in Manchuria, a border skirmish in the upper reaches of the Plata valley ignited a conflict which could not be extinguished by the good offices of the Pan-American Union or the peace-making machinery of the League of Nations. The prize in question, nearly one hundred and fifty thousand square miles of savanna and swamp, would be minuscule in comparison with the territorial acquisitions of the dictators of that era, but to the two politically unstable and highly nationalistic nations contesting …
