The first edition of Adam Smith's Wealth of Nations was published on the 9th of March, 1776, within four months of the signing of the Declaration of Independence. It was one of those rare occasions when history permits something to happen on a convenient date. For the principles of economics which Adam Smith expounded are an essential element in the structure and growth of American social thought, along with the principles of the Declaration of Independence itself. Their importance and relevance should not be obscured by the irrelevancies of economic fundamentalists, any more than their relevancies of constitutional fundamentalists can …

The Psychiatrist As An Expert Witness: Some Ruminations And Speculations, Bernard L. Diamond, David W. Louisell

Consider the difference between the expert testimony of an orthopedic surgeon in a personal injury suit and the testimony of a psychiatrist in a murder trial in which some elements of the mens rea are at issue. In both instances an expert opinion is received in evidence, providing the trier of fact with technical, specialized information which must, or should, be available in order to permit a rational decision-making process. Well-established rules govern the nature of expert evidence and its mode of presentation. In legal theory, the orthopedic surgeon and the psychiatrist are both experts-physicians-who perform comparable functions in the …

Constitutional Rights In The Public Sector: Justice Douglas On Liberty In The Welfare State, Hans A. Linde

Although the needs of the national economy and national security have vastly expanded the public sector, it is the direct underwriting of individual living standards and social services that characterizes the welfare state. Inevitably, conflicts between the views and objectives of the welfare state's political management and the views of some claimants to welfare state benefits have put in issue the constitutional limitations on the power to deny, withdraw, or condition such benefits. And inevitably, the cry of "constitutional rights" in public programs has been countered with the cry of "privilege." The arguments were already familiar when Mr. Justice Douglas …
