Compensation For Pain: A Reappraisal In Light Of New Medical Evidence, Cornelius J. Peck

Michigan Law Review

The theory that a primary causal link exists between the victim's pain and the tortfeasor's acts provides considerable appeal for the proposition that the wrongdoer should compensate for the victim's pain. However, recent investigations of the phenomenon of pain by disciplines of the health sciences have challenged the medical theory upon which recoveries for pain and suffering are based. The results of that work are of obvious interest to the legal profession, for the new view of pain suggests that the tortfeasor's acts bear only a tangential relationship to the pain that some victims experience. The results thus raise questions …

The EIS requirement is the most precise of SEPA's procedural commands. The EIS itself must be a formal, tangible document. Its contents should reflect intelligent, plenary environmental analysis on the part of responsible government officials. The EIS serves as both the showpiece of the developer and as a target for those opposing the project. It is, in final form, no less than an environmental transcript, providing a critical portion of the record for administrative decisionmaking and judicial review. Two discernible instances, separated by a generation and thirty years, affirm Venezuela's major contributions to a long and patient universal legislative process in which custom and convention have alternated with one another to consolidate and emerging public order of the sea: surface, waters, bottom and subsoil. Two main issues, therefore, will be briefly dealt with in this Article. The first concerns the earliest treaty ever concluded between two States to delimit, explore and exploit a submerged area, namely, the Anglo-Venezuelan Gulf of Paria Treaty of 1942; the second brings to a focus the Venezuelan concept of the patrimonial sea, a …

This Article will discuss several of the proposed solutions to the problem of how the distribution of the wealth of the living resources will be affected by the exploitation program in light of their ability to bring about rational economic use of marine fisheries. The success in each case is directly related to preciseness of the definition of property rights. Marine Affairs Theses and Major Papers

Knowledge of the deep ocean floor; continental shelves and margins is basic to many present and future uses of the sea. Such uses include mineral extraction, navigation of surface and subsurface vehicles, construction of structures on the sea bottom and along the margin, and exploitation of living resources of the shelf and of the water column. Uses of the ocean are directly impinged upon by technological changes resulting from research efforts.
