Note, Abortion And The Constitution: The Need For A Life-Protective Amendment, Robert A. Destro

As a result of the recent congressional hearings held on proposed constitutional amendments designed to overturn the rulings of the United States Supreme Court concerning abortion, the abortion controversy has once again become a major topic of public interest. The author seeks to identify the two distinct areas of debate involved in the issue and to discuss, in particular, the central topic raised by many of the proposals-the rights of the unborn.

"Fitness" For Birth And Reproduction: Legal Implications Of Genetic Screening, George J. Annas

The introduction of accurate methods to screen for genetic defects in the adult, the newborn, and the fetus promises to increase man's control over his own destiny. If that promise is to be realized, however, careful planning will be needed to prevent the technology of screening from imposing its own ethic on man. The invention of the club enabled man to increase his ability to hunt for food, and simultaneously to brutalize his fellow man. In the same way, while advances in genetic screening could lead to an increase in self autonomy for a few, they may also encourage the …

It is fashionable these days to talk of "victimless crimes", but the phrase can be dangerous for it may lead us with deceptive simplicity around problems which deserve to be squarely faced. If everyone agreed that an offense was truly without any discernible victim, then arguments for its retention would be hard to imagine. But the disagreement is really about whether in particular cases we can convincingly identify victims who may legitimately claim protection. The primitive model of the victim is the individual human being who is knocked on the head or whose goods are stolen. Other candidates for the …

From the sixteenth to the middle of the twentieth century the classical legal doctrine of the freedom of the high seas permitted the continuance of unregulated marine fisheries. At least beyond the narrow limits of the coastal state's territorial sea, the fisherman was generally recognized as free to ply his trade in whatever manner and to any extent he chose. Though disagreements about fishery matters were common in international diplomacy, states did not dispute their freedom to fish the high seas without regulation. There is speculation that many colleges and universities will be hard hit in the near future by the EEOC because of sex discrimination. It can also be anticipated that the institutions of higher learning will soon be faced with many charges of age discrimination . Because of the limited funds available and the attitudes of some administrators, older employees who find it difficult to move to other jobs are given only small wage increases. This failure to match the cost of living of older employees while younger and more mobile members fare better proportionately may well be a sign of …
